HomeMy WebLinkAbout1590 Ordinance1590 ORDINANCE NO. AN ORDINANCE PROHIBITING THE SALE OR DISPLAY FOR SALE OF OBSCENE MATERIALS IN THE CITY OF PASCO, AND PROVIDING PENALTIES FOR VIOLATIONS. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. It is unlawful for any person, firm, or corporation to sell or display for sale any obscene material within any public place in the City of Pasco. Section 2. As used in this ordinance, "obscene material" includes but is not limited to stage performances, motion pictures, photographs, pictures, books, newspapers, magazines, printed materials, billboards, and other objects the dominant theme of which, taken as a whole, appeals to the prurient interest in sex, and which is offensive because to the average person it affronts contemporary community standards of candor in the description or representation of sexual matters, and is utterly without any redeeming social importance. Section 3. As used in this ordinance, a "public place" is any area generally visible to public view and includes streets, sidewalks, bridges, alleys, plazas, parks, driveways, parking lots, automobiles (whether moving or not) and buildings open to the general public, including but not limited to those which serve food or drink, or provide entertainment and the doorways and entrances to buildings or dwellings and the grounds enclosing them. Section 4. As used in this ordinance, "sell or display for sale" requires either actual or constructive knowledge of the contents, or general knowledge of the content of the materials which are stocked for sale. Section 5. Any person, firm, or corporation violating this ordinance shall be guilty of a misdemeanor and upon conviction shall be fined in: -.a sum not to exceed $500. 00, or shall be imprisoned in the city jail for a period not exceeding six months, or shall be punished by both fine and imprisonment. Section 6. This ordinance shall be in full force and effect after its passage and publication as required by law. PASSED by the City Council and APPROVED as provided by law this 1st May day of 1973.
