AN ORDINANCE REGULATING THE PRESENCE OF
JUVENILES BETWEEN CERTAIN AGES ON STREETS
AND PUBLIC PLACES BETWEEN CERTAIN HOURS,
DEFINING DUTIES OF PARENTS AND GUARDIANS,
PROVIDING PENALTIES FOR VIOLATIONS AND RE-
PEALING ORDINANCE NO. 503 AND PASCO CITY
CODE, CHAPTER 9.36.
WHEREAS, the City Council finds it necessary to control the presence of
juveniles in public places at night and under certain circumstances, due to the
attendant risk of mischief, and to promote the safety and good order of the com-
munity by reducing the incidence of juvenile criminal activity; NOW, THEREFORE
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1 . The activities and conduct of juveniles are hereby restricted as follows:
A. To age 11,
Monday through Thursday, 9:30 p.m. to 5:00 a.m.;
Friday and Saturday, 10:00 p.m. to 5:00 a.m.; and
Sunday, 9:30 p.m. to 5:00 a.m.
B. Between the ages of 12 and 14,
Monday through Thursday, 10:00 p.m. to 5:00 a.m.;
Friday and Saturday, 11:00 p.m. to 5:00 a.m.; and
Sunday, 10:00 p.m. to 5:00 a.m.
C. Between the ages of 15 and 17,
Monday through Thursday, 12 o'clock (midnight) to 5: 00 a.m.;
Friday and Saturday, 1:00 a.m. to 5:00 a.m.; and
Sunday, 12 o'clock (midnight) to 5:00 a.m.
Section 2, During the hours set forth in Section 1 , no persons of the ages therein
identified shall loiter or prowl on the streets or in public places . To loiter or to
prowl means in a manner not usual for law-abiding individuals under circumstances
that warrant alarm for the safety of persons or property in the vicinity.
Section 3. In addition to age and lateness of the hour, other circumstances which
may be considered in determining whether such alarm is warranted is the fact that
the juvenile takes flight upon the appearance of a police officer, refuses to identify
himself or herself, or manifestly endeavors to conceal himself or herself or any
object.
Section 4. Unless flight by the juvenile or other circumstances make it impractic-
able, a police officer shall afford the juvenile an opportunity to dispel any alarm
which would otherwise be warranted, by requesting the juvenile to identify himself
or herself and to explain his or her presence and conduct.

Section 5 . It shall be unlawful for any parent or guardian to allow his child to
be on the streets or in a public place in violation of the provisions of this ordin-
ance. To "allow" means either "permit" or "neglect to restrain or prevent", and
requires actual or constructive knowledge on the part of the parent or guardian.
Section 6. Any parent or guardian violating the provisions of this ordinance shall
be guilty of a misdemeanor and upon conviction thereof shall be punished by a
fine of not to exceed $500.00, or by imprisonment in the city jail for a period of
not to exceed six months, or by both such fine and imprisonment. Any juvenile
who shall violate any provision of this ordinance shall be dealt with in accord-
ance with the appropriate and prevailing juvenile laws of the State of Washington
pertaining thereto.
Section 7.. The term "street" as used herein, shall mean alleys, highways,
thoroughfares, pathways, sidewalks, or other places of travel open to the public.
The term "public place" shall include, but shall not be limited to, places of amuse-
ment and Entertainment, public buildings, parks, playgrounds, dance halls, lots, or
unsupervised places.
Section 8._ Ordinance No. 503 and Pasco City Code, Chapter 9.36 are hereby re-
pealed.
Section 9._ This ordinance shall be in full force and effect after its passage and
publication as required by law.
