HomeMy WebLinkAbout1562 OrdinanceORDINANCE NO. 1562 AN ORDINANCE AMENDING SECTIONS 3 AND 10 OF ORDINANCE NO. 1537, AND BEING AN ORDINANCE RELATING TO HEALTH AND SANITATION; PROVIDING FOR AND REGULATING THE COLLECTION, TRANSPORTATION AND DISPOSAL OF SOLID WASTE IN THE CITY OF PASCO; PROVIDING FOR RATES AND CHARGES THEREFOR; CREATING A "SOLID WASTE FUND"; PROVIDING FOR THE VIOLATION THEREOF. WHEREAS, certain revisions to Ordinance No. 1537 will result in more equitable service and charges to the public in the process of maintaining health and sanitation within the City of Pasco, and WHEREAS, the Contractor and the City have amended the contract providing for the collection, transportation and disposal of solid waste to be in accordance herewith, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. Section 3 of Ordinance No. 1537 is hereby amended to read as follows: "Supervision by the City. The City Manager is hereby Empowered and authorized to appoint a suitable and qualified person(s), subject to budget provisions, to supervise the collection, transportation and disposal of solid waste and garbage and for the supervision of the sanitary land -fill operation. Inspection of the solid waste collection, transportation and disposal within the City is designated to be performed by the Benton -Franklin Health District. All inspections shall meet all City and State Department of Ecology requirements. "The Benton -Franklin Health District may order the removal of any solid waste or rubbish at any time and from any :Locality where it is determined by said authorities that such removal is necessary for the protection and preservation of public health, sanitation and cleanliness. In all cases, the Benton -Franklin Health District shall :notify the Contractor that such removal is necessary. The Contractor shall remove such solid waste and rubbish as ordered by the District. Further, the Contractor shall charge the City and the City in turn shall charge the occupant or the person who allows the deposit of solid waste or rubbish to accumulate a sum equal to three times the amount usually charged for such special service. If the premise is unoccupied, as an alternate, the City will then charge the owner of said premises a sum equal to three times the amount usually charged for such special service." Section 2. Section 10 of Ordinance No. 1537 is hereby amended to read as follows: "SCHEDULE OF SERVICE CHARGES: a) Occupied Residence. The person responsible for water service to each residence or separate unit therefore shall be charged $2.25 per month for each occupied residence or unit thereof for the weekly removal of up to two cans per week of solid waste from each residence or unit therefore. In addition, a special rate of $1.70 per month for the weekly removal of one can per week from each residence or unit therefore is hereby established. To qualify for this special rate, the person responsible must be at least sixty (60) years of age. In addition, he must be on or qualify for public assistance under the Law of the State of Washington and certify on an appropriate :form at the City Hall that one can per week is at least or more than adequate to meet his normal needs. In the event such person signs for this special service and :requirements for compulsory and/or universal solid waste collection are subsequently eliminated, his application for such special service shall be voided. "b) Occupied Multi -Family Residence. The person responsible for water service to each unit or units of a multi -family residence shall be charged $2.10 per month per unit for the weekly removal of up to two cans per week of solid waste from each residence unit of the premise. As an alternate the person responsible for water service may contract for centralized container service at the rate specified herein. As a further alternate, the person responsible for water service may contract for a special rate based on fewer than two cans per week, but not less than one can per week, from each residence unit of the premise. Such a special rate shall be mutually agreeable to the person responsible, the Contractor and the City. The additive for billing costs shall not be over $2.00 per month per account. "c) Commercial Establishment. The minimum monthly charge shall be $3.40 per month for the weekly removal of up to two cans per week of solid waste from the premises. As an alternate, container service may be contracted for at the rate specified herein. As a further alternate, commercial accounts may be covered by a special rate. Such special rates shall be mutually agreeable to the person responsible, the Contractor and the City. The additive for billing shall not be over $2.00 per month per account. "d) Public Food Establishment. The charge for a public food establishment shall be $10.00 per month per can for daily service as described herein. The minimum monthly charge shall be $10.00. As an alternate, the person responsible for water service to the public food establishment may contract for container service at the rate specified herein. "e) Extra Can or Bag Charges. There shall be a charge of $0.20 per can or bag per week for the removal of each can or bag in excess of two (2) cans or bags per week." Section 4. EFFECTIVE DATE: This ordinance shall be in effect on the first day of January, 1973, and after its passage and publication as required by law. PASSED and APPROVED this Lday of December, 1972.
