AN ORDINANCE GOVERNING THE PERMISSION OF CARNIVALS, CIRCUSES,
AMUSEMENT RIDES, STREET SHOWS, OR. SHOWS COMMONLY CLASSED AS
A CARNIVAL, PROVIDING FOR LICENSING AND TAXING OF THE SAME
AND REGULATING THE OPERATION OF CARNIVALS, CIRCUSES AND
AMUSEMENT RIDES, REPEALING ORDINANCE NOS. 601 AND 1405, PASCO
MUNICIPAL CODE CHAPTER 5.16, AND ALL OTHER ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH AND FIXING A PENALTY FOR
THE VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. DEFINITION CARNIVAL - CIRCUS: The term "Carnival", as
set out in this Ordinance shall be construed to mean every device, institution
or assemblage of devices or institutions the purpose whereof is that of pro-
viding entertainment, amusement, sport, pastime, or merriment for the patrons
thereof, and shall include roller coaster, merry-go-round, swing, ferris
wheel, kiddie rides, games of shooting, throwing, pitching, phenomenal ex-
hibitions and everything of like character.
The term "Circus" as set out in this Ordinance, shall be construed to mean any
institution whose general occupation is that of exhibiting wild animals, feats
of horsemanship, animal stunts and acrobatic or anuatic'sports, to which a fee
is charged for admission.
Section 2. LICENSE REQUIREMENTS: It shall be unlawful for any
carnival, circus, amusement rides, street shows, or shows commonly classed as
carnivals to show or give any performance in the City of Pasco without first
having obtained approval from the Building Inspector and Fire Chief for site
location, at which time the City Clerk shall issue the license providing the
applicable fees are paid.
Section 3. WAIVER OF LICENSE FEE: When a celebration is put on by Civic
organizations of the City, and a carnival or street show purchases or gets a con-
cession from said such an organization for performances during said celebration,
no license fee or admission charge or tax for the City shall be collected. If any
shows or performances other than those authorized by said Civic organizations are
given or performed, the regular license fee and admission tax shall be paid to
the City.
Section 4. LICENSE FEES: The fee for a circus shall be $50.00. Every
carnival, amusement rides, street shows or shows commonly classed as a carnival shall
pay a maximum license fee of Fifty Dollars ($50.00) per day for each and every day
the same shall perform within the City, or $10.00 a day for each major ride (defined
as a ride for which the charge is over 25¢), each game of skill and each side show.
Further, a charge of $5.00 per day for each minor ride (defined as a ride for which
the charge is 25¢ or under), each food booth, and each merchandise booth or concession,
and in addition thereto, shall pay the regular admission tax on all admission
tickets or admissions for which a charge is made except as set out in Section 3.
The license -fee is paid in advance for each day the said show or carnival proposes
to show within the City, and the admission tax shall be paid each day in advance.
Section 5. INSURANCE: Before any license shall be granted, the
applicant must present a copy of his insurance with a "Hold Harmless" clause to
the City of Pasco and guarantee, in writing, that said carnival circus or show commonly
classed as a carnival, will leave the premises on which the show is given in as good
condition as to cleanliness and sanitation as it was at the time of setting up said
carnival, circus or show.

Section 6. PENALTY: Any violation of this Ordinance shall be deemed
a misdemeanor and any person violating any of the terms of this Ordinance
shall be subject to a fine of not more than $300 or by imprisonment for not
more than 90 days, or by both such fine and imprisonment.
Section 7. SEVERABILITY: Ordinance Nos. 601 and 1405, Pasco
Municipal Code Chapter 5.16 and all other Ordinances or parts of Ordinances in
conflict herewith are hereby repealed. Such repeal shall not reactivate any
Ordinances or parts of Ordinances.
Section 8. This Ordinance shall be in full force and effect after
its passage and publication as required by law.
