ORDINANCE NO.
AN ORDINANCE CREATING A CITY PLANNING COMMISSION:
DEFINING MEMBERS; TERMS OF OFFICE; VACANCIES AND
REMOVAL FROM OFFICE; POWERS AND DUTIES; AND RE-
PEALING RESOLUTION 129 AS AMENDED BY RESOLUTIONS
NO. 368, 629 AND ALL OTHER ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH.
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. MEMBERS. Persuant to the authority conferred by RCW 35.63 there is
created a City Planning Commission, consisting of nine members, who shall be
residents of the City or the immediate surrounding service area of the City,
selected as follows: The Mayor shall be an ex officio member of the commission
during the period of his incumbency in such office; the other eight members
shall be appointed by the Mayor and confirmed by the City Council.
Section 2. TERM OF OFFICE. The term of office of the eight members appointed by
the Mayor shall be six years.
Section 3. VACANCIES AND REMOVAL FROM OFFICE. Vacancies occuring otherwise than
through the expiration of terms shall be filled for the unexpired terms. Members
may be removed, after public hearing by the Mayor, with the approval of the City
Council, for inefficiency, neglect of duty or malfeasance in office. The members
shall be selected without respect to political affiliations, and they shall serve
without compensation.
Section 4. POWERS AND DUTIES. The Planning Commission shall have all the powers
and perform each and all of the duties specified by RCW 35.63 together with any
of the other duties or authority which may hereafter be conferred upon them by
the laws of the State of Washington, the performance of such duties and exercise
of such authority to be subject to each and all the limitations expressed in such
legislative enactment or enactments.
Section 5. Resolution 129 as amended by resolutions No. 368 and 629 are hereby
repealed, as are all other ordinances or parts of ordinances in conflict herewith.
Section 6. EFFECT OF ORDINANCE ON EXISTING COMMISSION. All members of the City
Planning Commission who are serving at the time this ordinance is passed shall
continue in office for the remainder of their unexpired terms as though this
ordinance had not been enacted.
Section 7. This ordinance shall be in full force and effect after its passage and
publication as required by law.
PASSED by the City Council of the City of Pasco, Washington this 5 day of
December 1972.
