HomeMy WebLinkAbout1539 OrdinanceORDIIIANCE NO. 1539 AN ORDINANCE ADOPTING A FIRE PREVENTION CODE PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION AND ESTABLISHING STANDARDS FOR SAFETY RELATING THE='FTO.AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: 15-4q Section 1. Adoption of Uniform Fire Code. There is hereby adopted by the City Council of the City of Pasco for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion that certain Code known as the Uniform Fire Code, recommended by the Western Fire Chief's Association and the International Conference of Building Officials, being particularly the 1971 Edition thereof and .the whole thereof, save and except such portions as are hereinafter deleted, modified or amended of which Code not less than three copies have been and,now are filed in the Office of the Clerk of the City of Pasco, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this Ordinance shall take effect the provisions thereof shall be con- trolling within the corporate limits of the City of Pasco. Section 2. Definitions. (a) Wherever the term "Bureau of Fire Pre- vention" is used in the Uniform Fire Code, it shall mean the Fire Department. (b) Wherever the term "Chief of the Bureau of Fire Prevention" is used in the Uniform Fire Code, it shall mean the Fire Chief or his designee charged with the duties of administering and enforcing this Ordinance. (c) Wherever the term "Corporation Counsel" is used in the Uniform Fire Code, it shall mean the City Attorney. (d) Wherever the term "Fire Zone" is used in Uniform Fire Code, it shall mean Fire Zone No. 1. (e) Wherever the term "Municipality" is used it shall mean the City of Pasco. (f) Wherever the term "nationally recognized the Uniform Fire Code, it shall mean those practices and publications listed in Appendix D of the Uniform this Ordinance or in the in the Uniform Fire Code, good practice" is used in prescribed in the standards Fire Code. Section 3. Establishment of Limits of Districts in Which Storage of _ Explosives and Blasting Agents is to be Prohibited. The limits referred to in Section 11.106b of the Uniform Fire Code in which storage of explosives and blasting agents is prohibited is hereby established to be Fire Zone No. 1. Section 4. Establishment of Limits of Districts in Which Storage of Flammable Liouids in Outside Above Ground Tanks is to be Prohibited. (a) The limits referred to in 15.201(A) of the Uniform Fire Code in which storage of flammable liauids in outside above ground tanks is prohibited, is hereby established as Fire Zone No. 1. (b) The limits referred to in Section 15.601 of the Uniform Fire Code in which new bulk plants for flammable or combustible 1iOUids are prohibited, are hereby established as Fire Zone No'. 1. Section 5. Establishment of Limits in Which Bulk Storage of Linuified Petroleum Gases is to be Restricted. The limits referred to in Section 20.105TA) of the Uniform Fire Code in which bulk storage of liquified petroleum gas is restricted, are hereby established as Fire Zone No. 1. Section F. Substitution for Section 12.103 of the Uniform Fire Code. Section -12.103 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place. 4 I "Section 12.103. Insurance Renuired. The permittee shall filei%f � t h the Fire Chief. a public liability and property damago insurance policy providing coverage with limits not less than $50,000 to the applicant for liability for the payment of damages which may he caused either to a person or to property by reason of the permitted display, and arising from a-ny acts, or failure to act, of the permittee, his agents, employers or subcontractors, unless he is ex- cused from filing such policy by reason of any of the pro- visions of the Laws of the State of Washington." Section 7. Substitution for Section 12.106 of the uniform Fire Code. Section 12.106 of the Uniform Fire Code shall be omitted and the following sha?'i be substituted in its place: "Section 12.106. Seizure of Fireworks. Any member of the Pasco Police or Fire Departments is hereby authorized and empowered to seize, take, remove or cause to be removed at the expense of the owner, any and all stocks of fireworks offered or exposed for sale, stored, or transported, or held in violation of this article." Section 8. Substitution for Section 27.101 of the Uniform Fire Code. Section ^27.101 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place: "Section 27.101. Bonfire and Outdoor Rubbish Fires. Bonfires and outdoor rubbish fires prohibited. Exceptions: This regulation shall not apply to the following: a) Fires for religious, ceremonial, cooking or like social purposes. b) Fires authorized by the Fire Chief for the prevention of a fire hazard, provided no alternate means of disposal is reasonably available. c) Fires authorized by the Fire Chief for instruction in the method of fighting fires, or testing of fire - resistive materials and fire protective equipment." Section 9. Substitution for Section 27.112 of the Uniform Fire Code. Section 27.112 of the Uniform Fire Code shall be omitted and the following shall be substituted in its place: "Section 27.112. Incinerators and Hours of Burning. No combustible waste matter shall be disposed of by burning except as follows: a) All burning shall be done in an approved incinerator. b) All burning shall take place between the hours of 6:00 A.M. and 6:00 P.M." Section 10. Addition to Article I. The following shall be added to Section 1.216, under the National Fire Protection Association: INFPA No. 101.. Fire Exits Code, 1970, National Electric Code, NFPA No. 70, 1968, and National Fire Codes, Volumes I, II, III, IV, VII, VIII, IX, X, 1970-71. -2- Section 11. Mbdifica.t.ions. The Chief of the Bureau of Fire Prevention shall have the pourer to mod i fy any of the provisions of the Uniform Fire Code upon application in writing by the owner or lessee of his duly authorized agent and there are practical difficulties in the way of carrying out the strict letter of this Code, provided that the spirit of the Code shall be observed, public: safety secured, and substantial justice done. The particulars of such modifications, when granted or allowed, and the decision of the Chief of the Bureau of Fire Prevention thereon, shall be entered upon the records of the Department and a signed copy shall be furnished to the applicant. Section 12. Appeals. j1henever the Chief of the Fire Department shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of this Code do not apply or that the true in- tent and niean-ino of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the City Council of the City of Pasco within 30 -days from the date of the decision appealed from. .Section 13. New Materials,_ Processes, or Occupancies Which May RenUire Permits. The Building Inspector, Fire Chief, and the Officer designated by the Fire Chief as the Chief Enforcing Officer of this Code, shall act as a committee to determine and specifv, after raving given affected persons an opportunity to be heard, any neva materials, processes, or occupancies, in addition to those now enumerated in this Code, ;which shall reouire permits, during the 90 -days next follovwina such determination. The Chief of the Bureau of Fire Prevention shall post a list of such new materials, processes, and occupancies in a conspicuous place in his office and shall distribute copies thereof to interested persons. The committee shall promptly make recommendations to the City Council for changes in or additions to this Ordinance relating to such neva uses, processes, or occupancies. Section 14. Violations--- Penalties. (a) Every person convicted of a violation of any provision of this Ordinarice shall be punished by a fine of not more than fiVR hundred dollars ($500.00) or by imprisonment of not more than six monthis, or by i'ot-h such fine and imprisonment. b) Every firm or corporation convicted of a violation of any provision of this Ordinance shall be punished by a fine of not more than five hundred dollars ($500.00). Section 1': Severability. The invalidity of any article, section, sub- section, :ovision, clZ:use, or portion thereof, or the invalidity of the appli- cation thereof to an' person or circumstances, shall not affect the validity of the remainder of this Ordinance or the validity of its application to other persons or circumstances. Section lf. Effective Date. This Ordinance shall be in full force and effect after its passage and publication as reouired by law. BOX 293, PASCO,WASHINGTON, 99301 May 9, 1972 509-547-2104 Re: Recommending Adoption of the 1971 Uniform Fire Code Submitted for council consideration for adoption, the 1971 Uniform f Fire Code, to replace the present 1970 Fire Prevention Code. The Uniform Fire Code was develo ed by the I.C.B.O. (International Conference of Building Officials , and the W.F.C.A. (Western Fire Chief's Association). The provisions of the Uniform Fire Code and the Uniform Building Code have been correlated so there is no con- flict between them. At present, the City of Pasco has adopted the Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code and the Uniform Housing Code. Adoption of the Uniform Fire Code will give the City a complete and comprehensive program of Codes that are compatible with each other. Adoption of the Uniform Fire Code by the Washington State Fire Marshall's Office on January 24, 1972 does apply to jurisdictions within the State where there are no comprehensive local fire pre- vention and safety codes. Attached is new and substitution sections of the Uniform Fire Code.
