AN ORDINANCE AMENDING SECTION -'13.1 AND 13.3 OF ORDINANCE
1441, BEING AN ORDINANCE REGULATING THE ERECTION,
ALTERATION AND MAINTENANCE OF ALL..SIGNS: PROVIDING
FOR ISSUANCE OF PERMITS AND -FIXING THE FEES THEREOF:
-PROVIDING A PENALTY FOR THE VIOLATION THEREOF.
THE CITY.COUNCIL OF. THE CITY OF PASCO DO ORDAIN.AS FOLLOWS
Section 1. Section 13.1 of Ordinance No. 1441 is hereby amended
-to read as follows:
"Section 13.1 General (a) Any nonconforming sign existing at the
time of the adoption of this ordinance shall -,be -removed or ;altered
so as' to conform with provisions of. the ordinance within'.five-(5)
years from_the date -of erection of said sign subjected to provisions
.for appeal of Section 13.3:.
(b) Every sign which, by reason of any amendment to the provisions'
of this ordinance, or by change of Zoning District or'by annexation.

conform --to• the provisions hereof,•shall 'be removed or altered so
as to conform with the provisions of this ordinance within five
years from the effective date of such amendment or change:"
-Section 2. Section 13.3 of ordinance No. 1.441 is hereby amended•to
read as follows:
"Section 13.3 Appeal- Theperiod speciffed-in Section.13.1 may be
extended by the Board. of Adjustment for eighteen (18) months upon
- application of the person maintaining such sign.if.,the Board finds
that such an :extension is. necessary for, the preservation -of substanti.al
property,ri.ghts of the appl'icant.' The application for the: -extension
shall be made irr.writ.ing.with the Secretary of -the Board within
ten`(10) days after notice to remove said sign has been.'issued by
the Building Inspector."
Section 3. Thi s ' Ordi nance shafl' be in. full force and effect after
.• its passage and publication as required bylaw.

It was our recommendation to the Planning Commission and would be
our recommendation to the Council that five years is not overly
restrictive for a sign to remain up from the date of its installation.
As a matter of fact, there will be many businesses that will suffer
severe loss from an accounting standpoint because their signs are
presently amortized over a ten-year period. In addition, many signs
are lease displays with no cancellation provision, and it would result
in the customer having to pay for the sign even though he does not
have the use of it. Most leases run for a term of five years, and
you can see what a hardship will be worked if the provisions recommended
by the Planning Commission are put into effect in the ordinance.
It certainly does not seem equitable to cause removal of any non-
conforming sign within the period of time that they recommend. I doubt
very much if you would pass an ordinance that would require the
removal of a building or other fixed pieces of property in less than
five years and in most cases, I am sure, would be a minimum of ten.
