AN ORDINANCE REGULATING PUBLIC DANCES AND PROVID-
ING FOR THE LICENSING THEREOF, AND PROVIDING PEN-
ALTIES FOR VIOLATIONS, AND REPEALING ORDINANCE NO.
311 AND ORDINANCE NO. 893 , PASCO MUNICIPAL CODE
CHAPTER 5.24.
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. The term "public dance" means any dance to which the public
generally may gain admission with or without the payment of an admission fee.
Section 2. No person, firm, corporation or co -partnership shall hold any
public dance within the City of Pasco without having first procured a license
from the City Clerk subject to review by the Chief of Police for compliance with
the provisions of this Ordinance. A license for a single public dance shall be
good only for the day and place specified in the license. Such license shall be
issued upon payment of a fee of $10.00 per hour to allow for public safety
assistance to be provided by the City. Such fee may be increased to $15.00
per hour or decreased to $5.00 per hour in special cases depending upon the
size of the dance at the recommendation of the Chief of Police.
Section 3. No license for public dance shall be issued unless the appli-
cant is of good moral character, and in the case of a corporation, shall be issued
in the name of the manager or other directing head thereof.
Section 4. No public dance shall be conducted between the hours of 1:00
o'clock (A.M.) and 6:00 o'clock (A.M.)
Section 5. All peace officers of the City, County and State shall have
free access to public dances for the purpose of inspection and to enforce com-
pliance with this Ordinance.
Section 6. Violations of this Ordinance shall be punished by fine not ex-
ceeding $500.00, or by imprisonment not exceeding six months, or by both fine
and imprisonment.
Section 7. Ordinance Nos. 311 and 893 and Pasco Municipal Code, Chapter
5.24, be and they hereby are repealed.
Section 8. This Ordinance shall be in full force and effect after its pas-
sage and publication as required by law.
PASSED by the City Council and APPROVED as provided by law this 2
day of March 1971.

Dear Sir:
We, the members of the Pasco Police Officers Association respectfully request
that the Pasco Municipal Code 5.24.020 be amended to read as follows:
"No person, firm, corporation, or co -partnership shall hold any
public dance within the city without having first procured a
license from the city clerk, subject to review by the Chief of

license for a single public dance shall he good only for the day
and nl ace specified in the license. Such license shall be issued
upon payment of a fee of fifteen dollars per hour. to allow for
public safety assistance to be provided by the city. Such fee
may be increased tp twenty two dollars and fifty cents per hour
or decreased to seven dollars and fifty cents per hour in snAcial
cases dependinq upon the size of the Vance at the recommendation
of the Chief of Police.
We the Pasco Police Officers request the chance in the rate of hourly pay
from $5.01 per hour to X7.50) per hour for each officer working off duty hours
at public dances to bring the rate of pay un to our present average overtime
pay paid by the Police Department. 14e also feel the change in rate of hourly
nay_iould put our department on an equal hourly pay rate with the Kenneaick
and Richland Police denartments.

SUBJECT: . Requested change in fee for dance ordinance
As you requested I am submitting some comments relative
to the request submitted by the Pasco Police Officers
Association.
The officers have requested an increase in the dance fee
in order to raise the pay they receive for working these
dances.
The current rate is $5.00 per hour as established in the
ordinance. Prior to the enactment of the ordinance the
officers were paid, in cash, by the sponsor at the time
of the dance. The rate of $5.00 per hour has been
established as the "going rate" for the past 5 or 6 years.
The Kennewick officers still work on basis of $6.00 per
hour and are paid in cash by the sponsor at the time of
the dance.
Richland officers are paid by the city at their respec-
tive rate of overtime pay if they work dances off duty.
The request received from our officers is that the dance
ordinance be amended to increase the fee from $5.00 per
hour to $7.50 per hour. The $7.50 per hour figure is
roughly equivalent to the average overtime rate for our
officers. It appears to me that the request is reasonable
as the officers have been working extra "off-duty" functions
at a rate considerably less than the current overtime rate.
