HomeMy WebLinkAbout1458 OrdinanceORDINANCE NO. 1+58 AN ORDINANCE AMENDING SECTION 12, SECTION 35, SECTION 39, SECTION 43, SECTION 45, SEC- TION 47, SECTION 49, SECTION 50, SECTION 54, SECTION 68 AND ADDING A NEW SECTION 74 TO ORDINANCE NO. 1306, BEING AN ORDINANCE RE- LATING TO CITY SERVICES, ESTABLISHING RULES GOVERNING HOURS OF WORK, PROVISIONS FOR SICK AND VACATION TIME, HOLIDAYS, TRAVEL EXPENSES, COMPENSATION AND OTHER PRACTICES AND REPEAL- ING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; ALL BEING A PORTION OF CHAPTER 2.42 OF PASCO CITY CODE THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. Section 12 of Ordinance No. 1306, Pasco City Code 2 .42.030(9) is hereby amended to read as follows: "Probationary Employee" means any employee who is serving his probationary period of 6 months of continuous service prior to being per- manently appointed to a.position" . Section 2. Section 35 of Ordinance No. 1306, Pasco City Code 2.42.080 'is hereby amended to read as follows: "VACATION CREDIT". All employees, except firemen working a 56 -hour average work week, shall receive vacation credit subsequent to permanent appointment at the rate .of one work day for each month of continuous service start- ing from the date of. his probationary employ- ment. After entering his 10th year of continu- ous service each. employee_ shall earn vacation credit at the rate of 1-1/4 work days per month. After entering his fifteenth year of continuous service, each employee shall earn.'vacation credit at, the rate of 1-1/2 work days per month. Firemen working a 56 -hour average work week shall receive vacation credit subsequent to permanent appointment at the rate of 10 hours for each month of continuous service starting from the date of his probationary employment. Upon completion of his 10th year of continuous service each employee!�,shall accrue vacation credit at the rate of 12 hours for each month of continuous service. Upon completion of his 15th year of continuous service each employee shall accrue vacation credit at the rate of 13 hours for each month of continuous service . " Section 3 . Section -39 of Ordinance No. 13 06, Pasco City Code 2.42. 22 0 is hereby amended to read -a-s follows: "VACATION AND SICK LEAVE -- PAYMENT IN LIEU OF " . An employee who is discharged for any reason shall receive all accrued vacation unless such separation is made during his entrance probationary period. Each employee at the time of leaving the employment of the City, except for any such employee who is terminated for just cause, shall have 25% of his accumulated and un -used sick leave converted to and be added to any other accrued vacation time. " Section 4. Section 43 of Ordinance No. 1306 Pasco City Code 2.42 .290 is hereby amended to read as follows: 'Holidays . The following, and such other days as the City Council by Resolution may fix, are official holidays for all regular employees of the City: January 1st being New Years Day; The 3rd Monday in February being celebrated as Wash- ington's Birthday;. The last Monday in May being celebrated as Memorial Day;. The 4th of July being celebrated as Independence Day; The first Monday in September being celebrated as Labor Day; _ The fourth Monday in October being celebrated as Veterans' Day; The fourth Thursday in November being celebrated as Thanksgiving Day; The day following Thanksgiving Day;. The 25th day of December being celebrated as Christmas; The day on which any General Election is being held throughout the State. When any of these holidays falls on a Saturday, the Friday immediately preceding such holiday shall be observed as the holiday. When any of these holidays fall on a Sunday, the Monday immediately following- shall be observed as the holiday. All City Offices shall be closed on these official holidays with the exception of those offices involving emergency services. For shift workers the first scheduled day of rest shall be con- sidered as Saturday and the second scheduled day of rest shall be considered Sunday." Section 5. Section 45 of Ordinance No. 1306, as amended by Ordinance No. 1339, Pasco .City- Code 2 .42 .3.10 is hereby 'amended to read as follows: "ACCRUAL OF SICK LEAVE. Sick leave shall accrue at the, rate of one day for each month for each regular employee, except firemen, to a; maximum accumulated sick leave of 90 days. Firemen working a 56 -hour average work week shall accrue sick leave at the rate of 14 hours per month for each month of continuous service to a maximum of 42 '24-hour 'shifts." Section 6. Section 47 of Ordinance No. 1306, Pasco City Code 2.42'.330 is hereby amended to read as follows: "SICK LEAVE WITH PAY. Employees shall earn. and may be granted time off with pay covering periods of illness or involuntary physical incapacity except time off caused by accident connected withc:other gainful employment to the extent that sick leave has accrued.' In order to be granted sick leave with pay, an employee must meet the following conditions: 1) Report to his department head, immediate supervisor or designated representative the reason for the absence. . Sick report must be made not later than two hour s after beginning of the scheduled work day. 2) ,Keep his department head informed of his condition if the absence is of more than 3 working days duration. 3) If absence extends beyond 3- working days duration, the employee will be required, at the option of the de- partrrient head, to submit a medical certificate signed by a physician.;stating the kind or nature of sickness or injury, that the employee has been incapacitated for work for a period of absence or quarantine or required to receive out-patient care and is again physically able to perform his duties. 4) Permit the City to make a medical examination or nursing visit if the City deems -it so desirable. The ex- pense of such a medical examination or nursing visit shall be paid by the City. " Section 7. Section 49 of Ordinance No. 1306, Pasco City Code 2.42.350 is hereby amended to read as follows: "NEW EMPLOYEES -- EMPLOYEE BENEFITS. New employees beginning work for the City prior to midnight of the 15th of the month shall earn vacation and sick leave credits from the first of the month. All employees beginning work for the City after 12:01 A.M. on the 16th of the month shall not earn vaca- tion and sick leave credits until the first of the succeeding month. " Section 8. Section 50 of Ordinance No. 1306, Pasco City Code 2.42..360 is hereby amended 'to read as follows: "LEAVE FOR DEATH IN IMMEDIATE FAMILY SICKNESS IN IMMEDIATE FAMILY. 1) Leave with pay shall be granted by the Department Head up to a maximumcf four work days in any calendar year for =r each death in the immediate family -if any. All time off for a death in the family in excess of four days in any one year shall be charged to sick leave. Such leave may be extended in special circumstances with the approval of the City Manager. Immediate 3 family shall include only father, mother; father-in-law, mother=in-law, spouse, brother, sister or children -of the employee . Firemen working a 56 -hour average workweek may be granted up to a maximum of 2 duty shifts in a 12 - month period for a death in the immediate family. 2) Employees shall be allowed up to4 work days sick leave for any one illness in:the immediate family requir- ing his presence. However the Department Head may re- quire the employee to furnish satisfactory proof that such presence is in fact required. Immediate family shall include only father, mother, spouse or children of the employee . The time off for such family illness shall be charged to sick leave." Section 9. Section 54 of Ordinance No. 1306 Pasco City Code 2.42:400 is hereby amended to read as follows: "COMPENSATION FOR OTHER THAN FULL TIME .REGULAR EMPLOYEES. Part time personnel who are regularly em- ployed shall be entitled to holiday, vacation and sick leave allowances in proportion to hours worked except that no part time worker who works less than 20 -hours per week and for 6 consecutive months dating from be- ginning of employment shall be eligible for vacation and sick leave allowances. Full time temporary employees shall receive the same paid holidays as regular employees provided that the holiday falls within his specified period of employment. Temporary employees shall receive the same vacation and sick leave allowances as regular em- ployees provided they are continuously employed at least six months. " Section 10. Section 68 of Ordinance No. 1306 Pasco City Code 2.42.540 is hereby amended to read as follows: "WORKING AGREEMENTS . In determining salaries, wages, hours and working conditions for employment in the City service the. City Council through the City Manager may bar- gain collectively, with any employee .group or representative thereof and enter into such formal -"agreement as is permitted by law.. In the event of conflict between such an agreement and provisions of this code the agreement. shall govern." Section 11. A new Section 74 is hereby added to Ordinance.No. 1306: "Section 74. CLASSIFICATION AND SALARIES. Position. titles grades, and annual salary ranges, including steps, may be included in the annual budget. In the event position titles by grades, together with salary schedules are in- cluded in the budget, .these shall be considered a part of the personnel policy of the City." Section 12. Sections 12, 35, 39, 43, 47, 49, 50, 54 and 68 of Ordinance No. 1306; Section 45.of Ordinance No. 13.06 as amended by Ordinance No. 1339; and Pasco Municipal Code 2.42.030(.9), 2.42.080, 2.42.220, 2.42.290, 2.42.310, 2.42.330, 2.42.350, 2.42.360, 2..42.400 and 2.42.540 are hereby repealed and a.new section, a being Section 74, is hereby added to. Ordinance No. 1306. Section 13. This ordinance shall be in full force and effect after its passage and publication as required by law.
