HomeMy WebLinkAbout1452 OrdinanceORDINANCE NO. 1452 AN ORDINANCE AMEiiDING SECTION 2.3 OF ORDINANCE NO. 1203, PASCO MUNICIPAL CODE 22.24.020 AND SECTION 2.5 OF ORDINANCE NO. 1203, PASCO MUNICIPAL CODE 22.24.040, AND BEING AN ORDINANCE ESTABLISHING COMPREHENSIVE ZONING REGULATIONS FOR THE CITY OF PASCO, AND PROVIDING FOR THE ADMINISTRATION, ENFORCEMENT, AND AMENDMENT THEREOF IN ACCORDANCE WITH THE PROVISIONS OF R. C. W. 35.63. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. Section 2.3 of Ordinance No. 1203 and Pasco Municipal Code 22.24.020 are hereby amended to read as follows: Section 2.3 PERMITTED USES The following uses shall be permitted in the R-7 Suburban Zone: (1) Residential dwellings; (2) Public and private elementary schools, high schools, colleges, universities, public parks and playgrounds; (3) Fire department station houses; (4) Churches where off-street parking is provided as set forth in Section 22,84.010 (2); (5) Nothing herein contained shall be deemed to prohibit the use of vacant property for gardening or fruit raising. (6) (a) The keeping of animals shall be permitted on tracts consisting of more than one half acre of irrigated pasture land. On tracts of irrigated pasture over one half acre and up to 2.5 acres one animal units (as hereinafter defined) per acre will be allowed in addition to fifty (50) fowl and one hundred (100) fryers. On tracts of irrigated pasture over 2.5 acres, two animal units (as hereinafter defined) per acre will be allowed in addition to fifty (50) fowl and one hundred (100) fryers., two (2) goats; and five (5) sheep per acre. Provided, That such activities shall not become of such intensity so as to become a nuisance as defined by Ordinance No 1091. The term "animal unit" shall be defined to any one of the following animals: beef cattle, milk cow, or horse, and providing further, that for the purpose of this defi- nition, calves and colts shall be excluded until such time as they cease to be suckling. (b) All of the above will be permitted as accessories to a family dwelling, providing further, that all barns, barnyards or corrals shall be located not less than seventy-five (75) feet from any public highway, not less than fifty (50) feet from any property held under separate ownership adjoining the premises on either side, and all chicken houses, yards, or runs, shall be located not less than fifty (50) feet from any public highway, and further, not less than fifty (50) feet from any adjoining or abutting property .held under separate ownership. Section 2. Section 2.5 of Ordinance 1203 and Pasco Municipal Code, 22.24.040, are hereby amended to read as follows: Section 2.5 PERMITTED CONDITIONAL`USES Uses permitted upon issuance of a special permit as provided in Chapter 22.80: (1) Churches and similar places of worship where off-street parking is not provided are permitted'when,approved by the Planning Commission; (2) Recreation builings or areas operated by membership clubs for the benefit of members and not for gain; ,,�)3) School not herefore defined, public libraries, and municipal 0ffice builings; r� .i (4) Cemetery, airport, recreational camp, hospital, sanitarium, correctional institutions and institutions for the insane; (5) Private nursery school; (6) Philanthropic or eleemosynary institutions; (7) Parish house, religious education building, convent or monastery; (8) Nurseries or greenhouses. Section 3'. This Ordinance shall be in full force and effect after its passage and publication as.required by law.
