AN ORDINANCE FIXING THE AMOUNT OF THE
AD VALOREM TAX LEVIES NECESSARY TO RAISE
THE ADDITIONAL AMOUNTS NEEDED BETWEEN
ESTIMATED REVENUES FROM SOURCES OTHER
THAN AD VALOREM TAXES FOR CERTAIN FUNDS
AND ESTIMATED EXPENDITURES, AND FOR THE
PAYMENT OF PRINCIPAL AND INTEREST UPON
THE GENERAL BONDED INDEBTEDNESS OF THE
CITY OF PASCO FOR THE FISCAL YEAR 1971;
AND TO LEVY THE ANNUAL AD VALOREM TAXES
OF THE CITY OF PASCO FOR THE FISCAL YEAR
1971 AND APPORTIONING THE SAME TO CER-
TAIN FUNDS FOR CERTAIN PURPOSES.
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1 . That the annual amount of ad valorem tax levies of the City of
Pasco for the fiscal year 1971 necessary to raise the additional amounts needed
between estimated revenues from sources other than ad valorem taxes and expendi-
tures, be and the same are hereby levied upon real and personal property subject
to taxation in said City and all assessment districts thereof and upon each dollar
of taxable value as follows, to -wit:
In all Assessment Districts for payment to:

General, City Street, Park, Recreation,
Library, and Urban Renewal Funds: $360,000. (max)
Firemen's Pension Fund 24,800. (approx) 0.50
1963 General Obligation Bond Fund 2,500.
1968 General Obligation Bond Fund 10,200.
1969 General Obligation Bond Fund 3,800.
Sub -Total Levy: $401,300.
1965 General Obligation Bond Fund 55,000.
In the Library Assessment District for Payment to:
1961 General Obligation Bond Fund $ 26,600.
TOTAL LEVY: $482,900.
Section 2. That said taxes herein provided for are levied for the purpose
of raising revenues sufficient to pay the principal and interest upon the general
bonded indebtedness of the City of Pasco and for a portion of the General, City
Street, Park, Recreation, Library and Urban Renewal Funds and for the operation
of the several departments of the Municipal Government of the City of Pasco for
the fiscal year beginning January 1, 1971 and ending December 31, 1971.
Further, said taxes are hereby levied upon all the real and personal property as
shown by the assessment in the County of Franklin as finally fixed by the County
Ordinance No. 1443

and the State Board of Equalization, and as extended upon the books of the
County Assessor, showing the property within said City subject to taxation for
municipal purposes, and upon the amount of said real and personal property as
certified by the County Assessor, which certificate was heretofore received by
the City of Pasco, all pursuant to and under and by virtue of the laws of the
State of Washington.
Section 3. That the taxes collected from the levies hereby fixed, together
with the estimated revenues from sources other than ad valorem taxation which
constitute the appropriations of the City of Pasco for the fiscal year 1971, will
be appropriated as itemized and classified in the Annual Budget for the fiscal
year 1971.
Section 4. This ordinance shall be in full force and effect, after its
passage and publication as required by law. -

Subject: Certifying Annual Tax Levies of Cities and Towns with
Boards of County Commissioners
Prior to the enactment of RCW 35.33.135, the entire budget
of cities under 300,000 was certified and filed with the Clerk of the
Board of County Commissioners, in accordance with the provisions of
RCW 84.52.020. Each budget contained the amount of ad valorem taxes
to be levied, if any. RCW 35.33.135, however, requires only that the
ordinance fixing the amount of ad valorem taxes to be levied, be certi-
fied by the Clerk to the Board of County Commissioners, thus raising
the question of legislative intent.
We are advised by the Attorney General's Office in their
informal opinion dated September 23, 1970,
"that the city need only certify 'the ordinance
fixing the amount.of ad valorem taxes to be levied'
to the Clerk of the Board of County Commissioners. "
Therefore, all cities subject to RCW 35.33.135 will file
only the ordinance fixing the tax levy whereas all other taxing dis-
tricts subject to RCW 84.52.020 will continue to file their budgets
as heretofore.
