ORDINANCE N0, 1442
AN ORDINANCE VACATING THE EAST -WEST ALLEY BETWEEN MYRTLE
AND CHESTNUT AVENUE AND "A" AND "B" STREETS, AS HEREINAFTER
DESCRIBED LYING WITHIN THE CITY OF PASCO, WASHINGTON.
WHEREAS, There has been filed with the City Council of the City
of Pasco, by the abutting property owners, a valid petition requesting
the vacation of the alley running east and west between Walnut and
Myrtle Avenue and "A" and "B" Streets, situated in the City of Pasco,
Franklin County, Washington.
WHEREAS, A Public Hearing was held before the City Council of the
City of Pasco on September 15, 1970, and it appearing there were no ob-
jections to said vacation, and said vacation being deemed to be in the
best interest of the City of Pasco; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. The alley running east and west between Walnut and Myrtle
Avenuand � and "B" Streets, hereinafter described shall be and hereby
is declared vacated of any future public use whatsoever, provided, that
the City of Pasco hereby retains an easement and the right to exercise
and grant easements in respect to the vacated land for the construction,
repair and maintenance of public utilities and services.
The east -west alley between Walnut and Myrtle Avenue,
and "A" and "B" Streets, adjoining Lots D and 9, and
Lots 24 and 25, Block 3, Owen's Addition to the City
of Pasco, according to the Plat thereof, recorded in
Volume B of Plats, Page 35, in Franklin County,
'Washington.
Section 2. This Ordinance shall be in full force and effect after
its passage and publication as required by law.
PASSED by the City Council and APPROVED as provided by law, this
15th day of September, 1970.
