HomeMy WebLinkAbout1424 OrdinanceORDINANCE NO. 1424 -AN ORDINANCE REGULATING THE PLACEMENT OF MOBILE HOMES IN CERTAIN PLATTED AREAS WITHIN hE CITY OF PASCO THAT HAVE BEEN DESIGNATED AS MOBILE HOME SUBDIVISIONS; DESIGNATED YARD AREAS AND WIDTHS; REQUIRING PERMITS FOR PLACEMENT OF SAID MOBILE HOMES AND RELATED ACCESSORY BUILDINGS; SETTING PERMIT FEES;. AND PROVIDING PENALTIES FOR __-..VIOLATIONS THEREOF. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. Definitions: For the purpose of this Ordinance, the following words and phrases shall have the meaning ascribed to them in.this section. Accessory Building - means any building other than the dwelling unit or main structure erected on the lot. Building Inspector - means the Building Inspector of the City of'Pasco or his duly authorized representative. Dependant Mobile Home - means a mobile home which does not have a flush toilet and a bath or shower. Independent Mobile Home - means a mobile home which has a flush toilet and a bath or. shower. Mobile Home - means any construction which might permit occupancy for dwelling or sleeping purposes for one or more persons, originally designed or subsequently renovated to permit movement from one place to another, either under its own power oras towed or propelled by a motor vehicle or other instrument capable of towing or propelling same mobile home. Mobile Home Lot - means a plat or tract of land occupied or proposed to be occupied by e mobile home or other building or an integrated group of mobile homes, and which has its principal frontage upon a street or place. Mobile Home Subdivision - means a subdivision designed'to accommodate mobile homes and in which lots are intended to be sold for this purpose. May - shall be deemed as permissible. Permit - means the .written permit issued by the Building Inspector to grant permission to locate a mobile home or accessory building upon a lot. Person - means any individual, firm, partnership, corporation, company or association. Shall - shall be deemed as mandatory. Street - means any way for vehicular traffic designated as a street, highway, thoroughfares parkway, road, avenue, boulevard, lane, drive, place or otherwise. Section 2. Permits: It shall be unlawful for any person to place a mobile home or erect an accessory building upon any lawfully designated lot within a mobile home subdivision without first obtaining a permit from the Building Inspector. Except, a mobile home may be placed within a designated Mobile Home Park as regulated by the Mobile Home Ordinance (Ord. No. 858). Section 3. Permit Fee: Any person desiring a permit as required by this ordinance, shall at the time of making application, pay the following fee to the Building Inspector. Placement of mobile home on designated lot - - - - - - - - - - - - - - - $25.00 Accessory building or other structure - - - - - - - - - - - - - - - - - Fee shall be in accordance with the currant building permit fee schedule. 6. No additions shall be built onto or become a part of any mobile home unless it is of the type which is built by the manufacturer of the mobile home, or if built by the individual will be compatible to the design of the mobile home. All additions to the mobile home shall meet the minimum standards of the Pasco Building Code. Section 5. Accessory Buildings: All accessory buildings shall be constructed in con- formance with the Pasco Building Code and placed upon the lot in accordance with the required yard set backs as listed under Section II of this Ordinance. Section 6. Sanitation: Only independent mobile homes will be permitted to locate with- in any Mobile Home Subdivision within the City of Pasco. Section 7. Water Supply: An adequate safe and potable supply of water shall be installed to every mobile home. Each mobile home shall be hooked up to the City.Water System with an individual water meter. Section 8. Sewage Disposal: All plumbing in a Mobile Home Subdivision shall comply with State and local plumbing laws and regulations. Connections shall be made to the City Sewer System. The sewer connection shall be provided with suitable fittings so that a water -tight connection can be made between the mobile home drain and the sewer connection. Such individual mobile home connection shall be so constructed that it can be closed, when not linked to a mobile home, and shall be capped so as to prevent any escape of odors. Section 9. Accessory Uses: All accessory uses permitted in any residential district shall be permitted in any mobile home subdivision. Section 10. Lot Coverage. No mobile home or accessory building, or combination thereof, shall cover more than sixty (60) percent of the lot area. Section 11. Yard Requirements: a. Front Yard: The front yard shall have a depth of not less than ten (10) feet which shall be measured from the platted right-of-way line. b. Side Yard: The minimum side yard shall be five (5) feet for any mobile home and shall be measured from the platted side property line. c. Pear Yard: The minimum rear yard shall be ten (10) feet. d. Minimum distance between structures: There shall be an open space between any two 2 buildings on a lot not less than ten (10) feet in width. e. Reduced side and rear yards: An accessory building not used for human habitation may be constructed to within two (2) feet of a side or rear lot line, provided said building is no closer than 50' to the front property line. Section 12. Severability: Should any section or provision of this Ordinance be declared by the courts to be unconstitutional or invalid, such decision shall not affect the validity of the Ordinance as a whole or any part thereof, other than the part so declared to be un- constitutional or invalid. Page 3. Section 13. Violations: Any person violating any of.the provisions of this ordinance. shall b. deemed guilty of -a misdemeanor and upon conviction of any such .violation such person shall be punishable by a fine of not more than $300.00, or by imprisonment for not more than 90 days, or by both,such fine and imprisonment. Section 14. Effective Date: This ordinance, shall be in full force and effect after its passage and publication as required by law.
