HomeMy WebLinkAbout1403 OrdinanceORDINANCE NO. 1403 AN ORDINANCE AMENDING SECTIONS 28, 30, 41, 42 (as amended by Ordinance No. 1192 and Section 1 of Ordinance No. 1255), 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59 and 60 of ORDINANCE NO. 990 and PASCO CITY CODE NUMBERS 3-1. 68, 3-1. 76, 3-1. 90, 3-1. 94, 3-1. 98, 3-1. 102, 3-1. 106, 3-1. 108, 3-1. 110, 3-1. 114, 3-1. 118, 3-1. 122, 3-1. 126, 3-1. 130, 3-1. 134, 3-1. 138, 3-1. 142, 3-1. 146, 3-1. 150, 3-1. 154, 3-1. 158 and 3- 1. 162, BEING AN ORDINANCE LICENSING THE BUSINESS ACTIVITIES CARRIED ON IN THE CITY OF PASCO; LICENSING ALL SHOWS, EXHIBITIONS AND LAWFUL GAMES CARRIED ON IN THE CITY OF PASCO AND WITHIN ONE MILE OF THE CORPORATED LIMITS THEREOF AND PROVIDING PENALTIES FOR VIOLATIONS. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. Section 28 of Ordinance 990 and Pasco City Code 3- 1. 68 are hereby amended to read as follows: "Section 28. Maximum fee. No annual license fee shall exceed One Hundred Fifty Dollars ($150. 00) per year. " Section 2. Section 30 of Ordinance No. 990 and Pasco City Code 3- 1. 76 are hereby amended to read as .follows: "Section 30. Square footage charges. The first three thousand (3, 000) square feet of floor space is included in the basic fee. The sum of Eleven Dollars and Twenty -Five Cents ($11. 25) shall be added for each additional three thousand (3, 000) square feet of floor space, or any fraction thereof. " Section 3. Section 41 of Ordinance No. 99.0 and Pasco City Code 3- 1. 90 are hereby amended to read as follows: "Section 41. Apartments --Fees. Any person renting apartments to the public and who has four or more such units available shall pay One Dollar Fifty Cents ($1. 50) per unit per year. Provided, that if a person owns or controls apartments and/or sleeping rooms, and/or commercial rentals, all units shall be added together in computing the license fee. " Section 4. Section 42 of Ordinance No. 990, as amended by Ordinance No. 1192 and Section 1 of Ordinance No. 1255, and Pasco City Code 3-1. 94 are hereby amended to read as follows: "Section 42. Auction sales --Fees. All auction sales shall pay One Hundred Fifty Dollars ($150. 00) per day and all auctioneers conducting or crying any sale shall pay Thirty Seven Dollars Fifty Cents ($37. 50) per day. Provided, however, that the fee requirements of this section shall not be.. applicable to persons, firms or corporations having established places of business in the city and having valid business licenses issued by the city, who wish to hold an auction for the purpose of disposing of excess inventory, damaged goods, or for promiton; provided, however, that any Auction conducted under this provision shall not exceed one day in length, and the person, firm or corporation holding such auction shall, as a condition precedent, file written notice with the city clerk of the date, time, place and nature of the goods to be auctioned and the reason(s) for conducting the auction. Notice as required herein shall be filed with the city clerk at least five days prior to the date the auction is to be held, and provided further, that no person, firm or corporation shall be entitled to hold more than one auction each calendar year under this provision without being required to pay the fee required above. This provision shall not apply in the following cases: (a) Judicial sales held pursuant to an order of the court; or (b), Nonjudicial sales held under the authority of and pursuant to a Federal or State statute; or (c) Wholesale auctions and stockyard auctions which will be required to pay the regular license fee; or (d) Those auctions having a permanently established place of business within the city; maintaining regular business hours; and open to the general public on a regular basis of five or more days each week which will be required to pay the regular license fee." Section 5. Section 43 of Ordinance No. 990 and Pasco City Code 3-1.98 are hereby amended to read as follows: "Section 43. Banks and finance agencies --Fees. All banks and finance agencies shall pay One Hundred Twelve Dollars and Fifty Cents ($112.50) per year." Section 6. Section 44 of Ordinance No. 990 and Pasco City Code 3-1.102 are hereby amended to read as follows: "Section 44. Bowling Alleys --Fees. Bowling alleys shall pay annually Twenty Two Dollars Fifty Cents 22.50) for the first alley and Three Dollars Seventy Five Cents ($3.75) for each additional alley." Section 7. Section 45 of Ordinance No. 990 and Pasco City Code 3-1.106 are hereby amended to read as follows: "Section '45. Circuses and tent shows --Fees. Circuses and tent shows shall pay Seventy Five Dollars 75.00 per day." Section 8. Section 46 of Ordinance No. 990 and Pasco City Code 3-1.108 are hereby amended to read as follows: "Section 46. Commercial rentals• -Fees. Any person renting or subletting any type of property, unimproved or improved, other than apart- ments and sleeping rooms, and who has four or more of such properties or units available shall pay annually Twenty Two Dollars Fifty Cents plus One Dollar Fifty Cents ($1.50) per property or unit per year. Each separate tenant in a building or of a tract of land shall constitute a separate unit for purposes of this chapter." s Section 9. Section 47 of Ordinance No. 990 and Pasco City Code 3- 1. 110 are hereby amended to read as follows: "Section 47. Dances --Fees. Any dance, or person giving or managing.a dance, to which the general public is invited or admitted, whether a charge is made or not, shall pay a license fee of Four Dollars Fifty Cents ($4. 50) per hour per dance for the matron's fee. " Section 10. Section 48 of Ordinance No. 990 and Pasco City Code 3- 1. 114 are hereby amended to read as follows: "Section 48. Dray and transfer --Fees. All persons engaged in the business of draying or transferring, or the moving of goods and commodities for hire, shall pay Twenty Two Dollars Fifty Cents ($22. 50) per year on the first truck or conveyance, and Three Dollars ($3. 00) for each additional truck or conveyance. If a storage or warehousing business is carried on in conjunction with the dray and transfer business, square footage charges shall also be paid. " Section 11. Section 49 of Ordinance No. 990 and Pasco City Code 3- 1. 118 are hereby amended to read as follows: "Section 49. Hotels, motels and cabin courts --Fees. All hotels, motels and- cabin courts, or places where rooms are kept for rent for the accommodation of the traveling public, whether rented by the day, by. the week or month, shall pay Twenty Two Dollars Fifty Cents ($22. 50) per year plus One Dollar Fifty Cents ($1. 50) for each rentable unit." - Section 12. Section 50 of Ordinance No. 990 and Pasco City Code 3-1. 122 are hereby amended to read as follows: "Section 50. Liquor sales= -Fees with and without dancing. Any place serving beer, wine or other intoxicating liquor shall pay Seventy Five Dollars ($75. 00) per year, plus square footage charges. Any place serving beer, wine or any other intoxicating liquor and providing dancing shall pay One Hundred Twelve Dollars Fifty Cents ($112. 50) per year, plus square footage charges. If dancing alone. is provided in conjunction with some other business not involved in the sale of beer, wine or other intoxicating liquor, the fee shall be Twenty Two Dollars Fifty Cents ($22. 50) per year, plus square footage charges. " Section 13. Section 51 of Ordinance No. 990 and Pasco City Code 3- 1. 126 are hereby amended to read as follows: "Section 51. Mortuaries --Fees. Mortuaries shall pay Thirty Seven Dollars Fifty Cents ($37. 50) per year. " Section 14. Section 52 of Ordinance No. 990 and Pasco City Code 3- 1. 130 are hereby amended to read as follows: "Section 52. Businesses located outside city --Fees. All persons not having a business location in the city but engaging in any business within the city shall pay Twenty Two Dollars Fifty Cents ($22. 50) per year. Out- of-town persons merely taking orders from any individual or business in the city shall not be subject to this chapter. " Section 15. Section 53 of Ordinance No. 990 and Pasco City Code 3- 1. 134 are hereby amended to read as follows: "Section 53. Professional boxing and wrestling exhibitions ---Fees. All persons stating professional boxing or wrestling matches shall pay Twenty Two Dollars Fifty Cents ($22. 50) per show. " Section 16. Section 54 of Ordinance No. 990 and Pasco City Code 3- 1. 138 are hereby amended to read as follows: "Section 54. Service stations --Fees. Service stations shall pay Twenty Two Dollars Fifty Cents ($22. 50) per year. This section shall not apply to places where motor vehicles are kept for sale or display. " Section 17. Section 55 of Ordinance No. 990 and Pasco City Code 3-1. 142 are hereby amended to read as follows: "Section 55. Sleeping rooms and rooming houses --Fees. Any person renting sleeping rooms by the month or week only and not by the day or night and who has four (4) or more such rooms or units available shall pay .One Dollar Fifty Cents ($1. 50) per room or unit per year." Section 18. Section 56 of Ordinance No. 990 and Pasco City Code 3- 1. 146 are hereby amended to read as follows: "Section 56. Telegraph office --Fees. Any person operating a telegraph office shall pay Seventy Five Dollars ($75. 00) per year. " Section 19. Section 57 of Ordinance No. 990 and Pasco City Code 3- 1. 150 are hereby amended to read as follows: "Section 57. Theaters and moving picture shows --Fees. Theaters and moving picture shows shall pay Seventy Five Dollars ($75. 00) per year. " Section 20. Section 58 of Ordinance No. 990 and Pasco City Code 3-1. 154 are hereby amended to read as follows: "Section 58. Used car lots --Fees. Used car lots shall pay Twenty Two Dollars Fifty Cents ($GG. 5U) per year. '' Section 21. Section 59 of Ordinance No. 990 and Pasco City Code 3- 1. 158 are hereby amended to read as follows: "Section 59. Vaudeville and traveling shows --Fees. Vaudeville and traveling shows shall pay Twenty Two Dollars Fifty Cents ($22. 50) per day. " Section 22. Section 60 of Ordinance No. 990 and Vasco City Code 3- 1. 162 are hereby amended to read as follows: "Section 60. All other businesses --Fees. All other persons engaged in business shall pay Twenty Two Dollars Fifty Cents ($22. 50) per year, plus square footage charges, plus outside area charges of Twenty -Two Dollars Fifty Cents ($22. 50) for every pe rson having an outside area as defined in this chapter. " Section 23. This Ordinance shall be in full force and effect after its passage and publication as required by law.
