ORDINANCE NO._L ,
AN ORDINANCE REGULATING THE CONSTRUCTION, REPAIR, CLEANING,
MAINTENANCE AND RE iNlE1.1AL OF SIDEWALKS AND VEHICULAR DRIVE-
WAYS ACROSS AND ALONG THE SIDEL-IALKS OF THE CITY OF PASCO;
PROVIDING CERTAIii CONDITIONS, PROVIDING PERMITS FOR AND
INSPECTION OF THE CONSTRUCTION AND REPAIR THEREOF, AND
PROVIDING PENIALTIES: AND REPEALING ALL ORDINANCES AND.
PARTS OF ORDINANCES IN CONFLICT HEREWITH.
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. DEFINITIONS:
SIDEWALK - Improved walkway bordering private property for pedestrian use.
PRIVATE DRIVEWAY - Any driveway intended for use by the occupant as access
to his property.
SERVICE DRIVEWAY - Any driveway intended for use by the public as access
to any place of business,
ABUTTING PROPERTY - All property having a frontage on the sidewalk margin
of any street or other public place.
RESIDENTIAL USE - Any property, either zoned or actually being used for
residential purposes.
COMMERCIAL USE - Any property, legally zoned, being used for business
purposes.
Section 2. RIGHT OF ABUTTERS TO MAKE CERTAIN IMPROVEMENTS.
Any abutting property owner or owners are hereby granted the right to con-
struct sidewalks, crosswalks, curbs, gutters or driveways in front of their
property when constructed i,n conformity with this chapter, and such.rules
and regulations as may be prescribed from time to time by the City Council.
Section 3. IMPROVEMENTS TO BE CONCRETE - SUPERVISION
All construction of sidewalks, crosswalks, curbs, gutters, and driveways
by private contract shall be of concrete as hereinafter specified and shall
be constructed under the immediate supervision of an inspector appointed
by the City.
Section 4. PERMIT REQUIRED
Before any person, firm or corporation commences to improve any of the
public streets or alleys within the corporate limits of the City of Pasco
by the erection or construction of sidewalks, crosswalks, curbs, or drive-
ways, -or to do any work in or upon said streets and alleys whatsoever, he
or they must first obtain a permit from the city building inspector. No
permit will be issued for any such work upon any street or alley within the
corporate limits of the City of Pasco when the grade has not been properly
established or while a proposition to alter or amend the grade thereof is
pending before the City Council, or after the City Council has granted a
petition, or adopted a resolution to improve the streets or alleys in
question by the formation of a Local Improvement District, and no permit
shall be issued if, in the judgement of the City Council the improvement
proposed to be made, is not a suitable one or will not be uniform with
and conform to existing or proposed improvements of streets or alleys in
the immediate vicinity of said proposed improvements.
Section 5. PERMIT RECORD TO BE MAINTAINED.
It shall be the duty of the City Building Inspector to keep a record of all
permits issued for construction under the provisions of this chapter, which
records shall show the date of issue thereof, to whom issued, a description
of the property in front of which the improvement is to be made, the nature
of the improvement, and an estimate of the quantity of work and the cost
thereof, fees collected, and when accepted by the City Building Inspector,
and the date of such acceptance,
Section 6. FEE SCHEDULE
The City Building Inspector is hereby authorized to charge for inspection
of sidewalk and driveway improvements in accordance with the Uniform Building
Code Fee Schedule, Section 303A, Table No. 3-A.
Section 7. SURVEY SPECIFICATIONS
Upon the granting of a permit by the City Building Inspector, it shall be
the duty of this office, in conjunction with the City Engineer, to cause
said proposed improvements to be staked out, giving lines and grades there-
of, and shall furnish data and specifications to which the improvement
must conform. The person or persons performing the work shall take proper
precaution to protect the stakes set by the building inspector or City Engi-
neer, and any and all stakes lost or destroyed shall be replaced only by the
City Building Inspector or City Engineer at the expense of the person obtain-
ing the permit.
Section 8. SIDEWALKS - WIDTH - MATERIALS
All sidewalks in the City of Pasco that may be constructed after the effective
date of this ordinance shall have the curb integrated with the walk, although
the curb should be clearly defined with an appropriate marking in the cement;
further, such sidewalks in a residential area shall be 5 feet in width, in-
cluding the width of the curb, with expansion joints provided at least every
40 feet; and that in business and industrial zones, such sidewalks extend
from the property line to the curb,with expansion joints at least every 40
feet. Be it further provided that should the regulations prescribed in this
section be impracticable or thought to be against the best interest of the
City of Pasco, the Director of Community Development shall be authorized
to give special permits for the construction of such walks after examina-
tion of the premises and determining that the interest of the City will be
best served by permitting sidewalk construction at variance with this section.
Section 9. NEW CONSTRUCTION - SIDEWALKS AND CURBS REQUIRED
Whenever a permit is to be granted for new construction within the City of
Pasco, the person seeking to build such new construction shall at the time
a building permit therefor is applied for, also obtain a permit as provided
for under this chapter for the construction of sidewalks, and curbs, on all
sides of such property that may adjoin a street, in conformance herewith,
and such sidewalks and curbs shall extend the full distance that such
property is sought to be occupied as a building site, and may adjoin property
dedicated as a public street.
Section 10. DRIVEWAY TO BE AT SIDEWALK LEVEL
The City Building Inspector shall issue no permit for any driveway of the
City to be constructed or repaired across or along any sidewalk of the City
of Pasco unless the same shall be upon the level of the sidewalk from a
point not exceeding four feet from the curb line of said sidewalk.
Section 11. NUMBER OF DRIVEWAYS PER LOT RESTRICTED
For each 50 feet of continuous frontage upon a street or avenue, one service
driveway, not exceeding 30 feet in width, shall be permitted.
One private driveway, not exceeding 20 feet in width, shall be permitted for
each 50 feet of continuous frontage upon a street or avenue in the residential
zone.
The Building Inspector may refer any request for a permit for a service or
private driveway to the City Council for approval or disapproval if
he deems it advisable that the City Council consider such request for reasons
of public safety or for any other reason.
The Building Inspector may be authorized by the City Council to issue permits
for service driveways or private driveways varying from the above specifica-
tiogs, after the request is considered by the Building Appeals Committee
and is found to be safe to the users of the public ways and for the best
interests of the City of Pasco.
Section 12. ABANDONED DRIVEWAY - DUTY OF OWNER
In the event that any driveway shall be abondoned or discontinued, the
owner of the property abutting thereon shall restore the same to the level
of the adjoining sidewalk. In the event of failure so to do, the procedure
shall be the same as provided by the laws of the State of Washington relat-
ing to the repair of sidewalks.
Section 13. SUPERVISION
The person making such improvement, or his contractor or agent, shall
notify the City Building Inspector, in writing, at least 24 hours in advance
of the time when the grading will be completed and the forms set ready for
placing concrete. The City Building Inspector shall check up the forms as
to line and grade and place an inspector in charge of the work until the
same is completed, and it shall be unlawful for any contractor to commence
construction work until the forms have been checked and the inspector placed
upon the location of the job at the time such improvement is actually
installed.
Section 14. SAFETY PRECAUTIONS
The contractor or person having charge of the construction of any such
improvement shall see that good and sufficient fences or barriers shall be
kept around such work at all times, and a sufficient number of red lights
shall be placed at proper intervals upon such work during the night time
as a warning to all persons traveling upon such streets or alleys.
Section 15. INSPECTION - CONFORMANCE TO PLAN
No improvement will be accepted until the City Building Inspector is satis-
fied that the work has been performed according to the plans, profiles and
specifications furnished by him and to the lines and grades established.
Section 16. MAINTENANCE OF SIDEWALKS
Whenever any street, lane, square, place or alley in the City of Pasco shall
have been improved by the construction of a sidewalk along either side thereof,
the duty, burden, and expense of the maintenance, cleaning, repair and renewal
of such sidewalk, including the erection and maintenance of suitable barriers
of wood, iron or masonry along the outer margin of such sidewalk where the
same is elevated more than two feet above the abutting property, shall devolve
upon the owner of the private property directly abutting on said sidewalk, and
said improvement shall be made by said owner in the manner provided by the
Ordinances of the City of Pasco, and the laws of the State of Washington.
Section 17. SCOPE OF CHAPTER
It is the purpose of this chapter to require uniform development and construc-
tion of curbs, sidewalks and driveways within the City of Pasco, but shall not
alter or effect those curbs, sidewalks and driveways presently in existence.
In the event, however, any of such presently constructed curbs, sidewalks and
driveways are to be altered, modified, improved or changed, then such alter-
ation, modification, improvement, or change shall be in accordance with the
provisions herein outlined.
Section 18. PENALTY
Any person, firm or corporation who violates, disobeys, omits, neglects or
refuses to comply with or who resists the enforcement of any of the pro-
visions of this chapter shall be deemed guilty of a misdemeanor and shall
be fined not more than $300.00, or imprisoned in the city jail for a term
not to exceed 90 days, or both such fine and imprisonment.
Section 19. REPEALING CERTAIN ORDINANCES
Ordinances No. 472, 521, 688, 847, 853, 891 and 939, relating to the same
subject, are hereby repealed.
Section 20. EFFECTIVE DATE
This ordinance shall.be in full force and effect from and after five (5)
days from the date of its passage and publication as provided by law.

Meeting called to order by Chairman Elvrum.
Minutes of the Regular Meeting of November 11, 1967 read and approved.
The following items were discussed with the recommendations as indicated.
SWIMMING POOL CODE: After discussion of -various items of the proposed ordin—
ance, motion was made by Bob Randolph, seconded by Mark Pence, that this code
be forwarded to the City Council with recommendation for approval. Motion
carried by majority vote.
SIDEWALK ORDINANCE• Following discussion, Section 6 (Fee Schedule) was changed

was changed to allow one private driveway for each fifty fbot of the parcel;
Section 8 (Width & Materials) was changed to include an expansion joint each 40
feet rather than each 20 feet; Section 11 was also changed to delete the Board
of Adjustment and place this under the jurisdiction of the Building Appeals
Commission. . Motion was made by Mark Pence, seconded by Bob Randolph, that this
code be forwarded to the City Council with recommendation for approval as amended.
Motion carried by majority vote. I
AUTOMATIC SPRINKLER SYSTEMS IN BASEMENTS (FIRE ZONE #1):' After much discussion,
pro and con, it was decided to table this proposed ordinance for further study,
and to call a Special Meeting on October 16, 1968, to discuss it. It was felt
that all Board Members should be present at this meeting as this is bound to be
a controversal ordinance.
UNIFORM PLUMBING_ CODE: Recommendation is that the Uniform Plumbing Code be adopted
in place of the National Plumbing Code, with some amendments and deletions. These
amendments were discussed and all approved with the exception of the Fee Schedule,
which ill felt should be in line with the Uniform Building Code. This change was
made and a motion was made by Bob Randolph, seconded by Mark Pence, that this code
be forwarded to the City Council with recommendation for approval. Motion carried
by a majority vote.
There being no further business, the meeting was adjourned at 10:35 p.m.

Re: Sidewalk, Curb and Driveway Ordinances
Dear Mr. Menasco:
The present ordinances regulating curbs, sidewalks and driveways are
contained in several ordinances scattered throughout the City Code book,
some being duplicated and othersin conflict with each other. Most are
archaic and in need of upgrading. This proposed ordinance will gather all
regulations pertaining to curbs, sidewalks and driveways into one section,
set them out in order, and make necessary corrections. It also defines
the different types of sidewalks and driveways and changes the fee
schedule to correspond with the Uniform Building Code, changing from the
square footage charge to the dollar value schedule.
Expansion joints have been changed from 20' separation to 40' as it has
been determined by the Code Review Board that there is no need for them
every 20'.
Permitted driveways have been changed to allow more than one to each parcel.
Under existing code, only one driveway is permitted per parcel, however
due to the increased size of the lots and the increased demand for circular
driveways a change to allow more curb cuts per parcel is recommended.
A variance clause has been added to allow the Director of Community Develop-
ment to issue waivers on sidewalk widths rather than have the owner bring
up such a small matter before the City Council as is the present policy.
The Commercial width has also been reduced to a 9' maximum.
