HomeMy WebLinkAbout1342 OrdinanceCITY OF PASCO, WASHINGTON ORDINANCE NO. 13412 AN ORDINANCE specifying and adopting a system or plan for making additions to and betterments and extensions of the waterworks utility of the City of Pasco, including the sanitary sewerage system and the system of storm or surface water sewers as a part thereof; declaring the estimated cost thereof as nearly as may be; providing for the issuance and sale of not to exceed $1,000,000.00 par value of water and sewer revenue bonds in one or more series to obtain a part of the funds with which to pay the cost of such system or plan; creat- ing a special fund .to provide for the payment of such bonds; ratifying the action of the City offi- cials in calling for construction bids and awarding the construction contract to Jensen -Green, Inc., of Spokane, Washington, covering a reservoir addition; authorizing and directing the City officials to pro- ceed with the remaining portions of the improvement; and providing for the issuance of interest-bearing warrants pending the sale of such bonds. 11 WHEREAS, the City of Pasco, Washington, by Ordinance No. 531, passed March 7, 1944, provided that the system of sewerage of the City, including all additions, extensions and betterments thereto, should be operated as a part.of and as belonging to the waterworks utility of the City pursuant to the provisions of Chapter 193 of the 1941 Session Laws of the State of Washington (R.C.W. 35.67.320 et seq.) and the words "waterworks utility of the City" shall hereinafter mean the combined sanitary sewerage system and water system of the City, together with the storm or surface water sewers heretofore authorized to be constructed and installed as a part of such combined systems, and together with all additions thereto and betterments and extensions thereof hereafter made; and WHEREAS, the existing waterworks utility of the City is in urgent need of the construction and installation of certain additions to the water system and to the sanitary sewerage system and the public health and welfare require and it is in the best interests of the in- habitants of the City of Pasco that improvements be made to the water- works utility of the City as hereinafter set forth, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO OR- DAIN as follows: Section 1. The City of Pasco hereby specifies and adopts a system or plan for making additions to and betterments and exten- sions of the waterworks utility of the City which shall consist of the following additions to the water system and to the sanitary sewer- age system: A. Water System Additions 1. There shall.be provided and installed a 30 -inch and 24 -inch diameter water pipeline in S. 12th Avenue from the vicinity of the railway to the water treatment plant with flow meter and recorder. 2. There shall be provided and installed in the water treatment plant additional pumping and electrical equipment, including discharge piping, control valves, surge protection facilities and structural improvements necessary to install the new equipment. 3. There shall be provided and installed a 24 -inch diameter and 30 -inch diameter water pipeline in S. 13th Avenue from the water treatment plant to Ainsworth Avenue with flow meter and recorder. 4. There shall be provided and installed a 30 -inch diameter water pipeline in Ainsworth Avenue from S. 13th Avenue to West "A" Street. 5. There shall be provided and installed a 24 -inch diameter water pipeline in Dakota Avenue from West "A" Street to Bonneville Street. 6. There shall be provided and installed a supervisory control system to transmit water system pressure information from a central control at City Hall to the water treatment plant; and provision shall be made for starting and stopping one or more pumps in the water treatment plant from the central control and transmitting operational data and alarm functions to the central control. 7. There shall be provided and constructed a five - million -gallon addition to the existing five -million gallon concrete water reservoir, with necessary control valves and appurtenances. 8. There shall be provided and installed other unspeci- fied facilities for the general improvement of the water system. Pipes, valves and fittings are to meet standard requirements of the American Water Works Association for construction of this type. -2- There shall be included in the foregoing all necessary wyes, valves, couplings, connections, and appurtenances, together with all work as may be incidental and necessary to the foregoing construction and installation... B. Sewerage System Additions 1. There shall be provided and installed at the sewage treatment plant the necessary facilities to provide primary and secondary treatment of sewage from an equivalent population of 30,000 persons to meet the effluent requirement of the State of Washington Pol- lution Control Commission. 2. There shall be provided and installed from the sew- age pumping station at Fifth Street and Ainsworth Avenue to the sewage treatment plant a sewage pump- ing main in Ainsworth Avenue, "E" Street and Grey Street. 3. There shall be provided and installed in the sewage pumping station at Fifth Street and Ainsworth Avenue additional pumping facilities. 4. There shall be provided and installed in the sewage pumping station at Ninth Street and Ainsworth Avenue an air compressor with necessary appurtenances. 5. There shall be provided and installed other unspec- ified facilities for the general improvement of the sewerage system. Materials used in the construction of the sewage pumping main, the sewage treatment plant improvements, and other sewerage sys- tem improvements shall meet the requirements of good practice for con- struction of this type. There shall be included in the foregoing all necessary wyes, valves, couplings, connections, manholes and appurtenances, together with all work as may be incidental and necessary to the foregoing con- struction and installation. The City shall acquire all property, both real and personal or any interest therein, equipment, rights-of-way, easements and fran- chises necessary to carry out said plans, which are all as more par- ticularly set forth in maps, plans and specifications prepared by Cornell, Howland, Hayes & Merryfield, consulting engineers of Seattle, Washington. -3- The City Council may make such changes in the details of said plans, either prior to or during the course of actual construc- tion, which may be found necessary and desirable as long as such changes do not substantially affect or change the main general parts of said plans or the services to be rendered thereby. Section 2. The gross revenues and benefits to be derived from the operation and maintenance of the waterworks utility of the City at the rates to be charged for water and for sanitary sewage disposal service on the entire utility will in the judgment of the City Council be more than sufficient to meet all expenses of opera- tion and maintenance thereof and to permit the setting aside into a special fund out of the gross revenues of the waterworks utility of the City of sufficient amounts to pay the interest on the bonds herein authorized to be issued and on the outstanding "Water and Sewer Rev- enue Bonds, 1954," dated January 1, 1954, "Water and Sewer Revenue Refunding Bonds, 1963," dated January 1, 1963, and "Water and Sewer Revenue Bonds, 1964," dated December 1, 1964, as such interest becomes due and payable, and to pay and -redeem all of said bonds at maturity. Section 3. The life of the foregoing additions to and bet- terments and extensions of the waterworks utility of the City is hereby declared to be at least thirty years. Section 4. The estimated cost, as near as may be, of the acquisition, construction and installation of the above described additions to and betterments and extensions of the waterworks utility of the City is hereby declared to be $1,316,700.00. Section 5. The cost of acquiring, constructing and making the foregoing additions to and betterments and extensions of the waterworks utility of the City shall be paid from (a) approximately $212,000.00 anticipated to be received from United States Government grants, (b) approximately $106,000.00 anticipated to be received from grants from the State of Washington, and (c) the balance from the proceeds received from the issuance and sale of water and sewer rev- enue bonds in the amount of not to exceed $1,000,000.00. It is the -4- intention of the City to acquire and construct and complete such portions of the foregoing system or plan of additions to and better- ments and extensions of the waterworks utility of the City as from time to time the City Council shall deem advisable. The bonds shall be issued in one or more series at such times as the City Council shall deem advisable. The.bonds shall be entitled "Water and Sewer Revenue Bonds, 1969," with series designation following, if issued in series. The bonds shall.bear interest at a rate or rates not to exceed the maximum rate permitted by law, payable semiannually, and shall be numbered from "one".upward, consecutively, within each series as issued. The bonds shall be issued in such series; shall be in such denominations and form; shall bear such date or dates and inter- est rate or rates; shall be payable at such place or places; shall mature serially in accordance with such schedule, beginning not earlier than one year after date of issuance and ending not later than thirty years thereafter or shall be term bonds; shall have such option of payment prior to maturity; shall guarantee such coverage and collec- tion of rates; shall provide for such additional funds and accounts; and shall contain and be subject to such provisions or covenants as shall be hereafter provided by ordinance. Section 6. The bonds shall be payable solely out of the special fund herein created and shall be a valid claim of the holder thereof only as against such special fund, and the amount of the rev- enues of the waterworks utility of the City pledged to such special fund, and shall not be a general obligation of the City of Pasco, Washington. Section 7. There shall be and hereby is created and estab- lished in the office of the Treasurer of the City of Pasco a special fund to be known as the "Water and Sewer Revenue Bond Fund, 1969," which fund is to be drawn upon for the sole purpose of paying the principal of and interest on the bonds. From and after the date thereof and so long thereafter as bonds are outstanding against such fund, the -5- City Treasurer shall set aside and pay into said fund out of the gross revenues of the waterworks utility of the City a fixed amount without regard to any fixed proportion, namely, an amount sufficient to pay the principal of and .interest on the bonds as they respec- tively become due and to create such surplus and reserve, if any, that may hereafter be prescribed by ordinance. The gross revenues from the waterworks utility of the City are hereby pledged to such payment and the bonds herein authorized shall constitute a lien and charge upon such revenues prior and superior to any other charges whatsoever, excluding charges for maintenance and operation; provided, however, that if the conditi.ons required to be met as set forth in Section 13 of Ordinance No. 768, as amended by Ordinance No. 774, shall be met at the time of..the is.suance of the bonds herein auth- orized, the lien and charge upon such.gross revenues for the bonds herein authorized shall be.on a parity of lien with the lien and charge upon such gross revenues for the outstanding "Water and Sewer Revenue Bonds, 1954," dated January 1, 1954, "Water and Sewer Revenue Refunding Bonds, 1963," dated January 1, 1963, "Water and Sewer Rev- enue Bonds, 1964," dated December 1, 1964, and for any additional water and sewer revenue bonds that may be hereafter issued pursuant to the provisions of Section13 of Ordinance No. 768, as amended by Ordinance No. 774. Otherwise, the lien and charge upon such gross revenues for the bonds herein authorized shall be subordinate and in- ferior to the prior lien and charge upon such gross revenues for all of said bonds above described. Section 8. The City Council and corporate authorities of the City of Pasco hereby declare that in creating the said special fund and in fixing the amounts to be paid into it as set forth herein they have exercised due regard to the cost of operation and mainten- ance of the waterworks utility of the City and the assumed debt ser- vice requirements of the above described outstanding bonds, and the City of Pasco has not bound and obligated itself and will not bind and obligate itself to set aside and pay into such special fund a greater amount or proportion of the revenues of the waterworks util- ity than in the judgment of the City Council will be available over and above such costs of maintenance and operation and debt service requirements of the above described outstanding bonds. Section 9. The proceeds from the sale of the foregoing bonds shall be used for the sole purpose of making the additions to and betterments and extensions of the waterworks utility of the City, as herein authorized, and of paying the cost and expenses connected therewith. The action of the City officials in heretofore calling for construction bids and awarding a construction contract on February 4, 1969, to Jensen -Green, Inc., of Spokane, Washington, covering the reservoir addition is hereby ratified and confirmed and the City, through its proper officers and agents, shall proceed with carrying out the remaining portions of such improvements in the manner provided by law. Section 10. Pending the issuance and sale of the "Water and Sewer Revenue Bonds, 1969," herein authorized to be issued, the City may issue interest-bearing warrants drawn against the "Water and Sewer Construction Fund" of the City, to bear interest at such rate as mayhereafter be determined and to be redeemed from the proceeds received from the sale of such revenue bonds within one year from the date hereof. PASSED by the City Council of the City of Pasco, Washington, and approved by its Mayor at a regular meeting thereof held on the 18th day of February, 1969.
