AN ORDINANCE VACATING THAT PORTION OF THE NORTH SOUTH ALLEY LYING BETWEEN LOTS 1 AND 28, INCLUSIVE , BLOCK 9, WEHE'S ADDITION TO PASCO, AS RECORDED ON PAGE 55, VOLUME "B" OF PLATS, RECORDS OF FRANKLIN COUNTY, WASHINGTON. WHEREAS, there has heretofore been filed with the City Council of the City of Pasco by the abutting property owners a valid petition requesting the vacation of that portion of the north south alley lying between Lots 1 and 28 incluseve, Block 9, Wehe's First -Addition to Pasco as recorded on page 55, Volume "B" of Plats, records of Franklin County, Washington..and WHEREAS, a public hearing was held in the Council Chambers of the City of Pasco before the City Council on January 7, 1969, and it appearing that there were no objections to the vacation of said alleys, and it being deemed to the best interest of the City of Pasco to vacate said alleys. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. That section of the north south alley lying between Lots 1 and 28 inclusive, Block 9, Wehe's First Addition -to Pasco as recorded on page 55, Volume "B" of Plats, records of Franklin County, Washington, shall be and hereby is declared to be vacated of any,further public use whatsoever, provided, that the City of Pasco hereby retains an easement and the right to exercise and grant easements in respect to the vacated land for the construction, repair and maintenance of public utilities and services. Section 2. This ordinance shall be in full force and effect after its passage and publication as required by law.
