HomeMy WebLinkAbout1323 OrdinanceORDINANCE NO. 1323 AN ORDINANCE CREATING'THE CITY VIEW CEMETERY9 ESTABLISHING AND OBLIGATING THE CITY TO ENDOWEMENT CARE, ESTABLISHING RULES AND REGULATIONS, SETTING RATES FOR.SERVICES AND ENDOWEMENT CAREE CREATING METHODS OF PAYMENT, AND SETTING. INTEREST RATES FOR TIME PAYMENT; AND REPEALING ALL PREVIOUS AND CONFLICTING ORDINANCES RELATING TO THE CEMETERY, THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. Cemetery Established: The tender of the tract of land dedicated By— rant in Lodge OU KnightS'OtPythias, known as the City View Cemetery, be, and the same is hereby, accepted and the same shall hereafter continue to be known as the City View Cemetery. Section 2. Definitions: The word "lot" shall mean and refer to the tract o?"aT nd `occupie y asingle grave or tract approximately nine feet long and three feet wide; that the words "block" and "section" shall mean and refer to units larger than lots with areas as defined on the official plat of said cemetery. Section 3. Endowement Care-. The obligation to be assumed by the City of Pasco un er the proves -ons of this chapter are declared to be the following, viz: to irrigate the lots, to seed the lots and keep the graves thereon green and neatly mown; to trim and prune the flowers and shrubbery permitted to grow on said lots under the terms of this chapter, and to fill in and keep the general level of such graves as may sink in or cave in; but the City of Pasco shall not be obligated out of the revenue derived from such fund, or otherwise, to dig any graves or erect any head or foot stones or monuments; nor replace any flowers or shrubbery which shall die or become killed through no fault of such trustee. Section 4. City manager Responsibilities -The City Manager shall be responsible for the operation o e ceme ery. The City Manager shall have full supervision, charge and control of the CityView Cemetery, and particularly, all matters pertaining to the maintaining thereof and to the opening and closing of all graves and setting and placing of all monuments and markers, and to the care of the graves and plots in said cemetery contained, and to the seeding to grass in all parts of said cemetery entitled to endowment care; and he shall do such other things in reference to said cemetery as may be required. He may, in his discretion, keep the cemetery closed to vehicular traffic at such times as in his judgment it -may be deemed best from the standpoint of the upkeep of the roads and driveways therein. Section 5. Cit Mana er Delegation of Responsibility: The City Manager may assign personne to t e emetery to carry out the provisions of Section 4. The City Manager may appoint a Cemetery Superintendent who shall have free use of the buildings, on said cemetery grounds, and he shall receive such monthly salary as shall be fisted by Budget. =lm t Section 60Vases Flowers or Containers-, The City shall not be, in any way, responsible for vases, flowersp or containers left in said cemetery by any person whatsoever. Section 7. Eligibility for Endowment. Care-, All lands included in and comprising cityView cemetery 6e and are hereby declared eligible to endowment care by the City of Pascoe Section 0e. Endowment Care Required on Unsold Lots-, All unsold lots, blocks, or parts thereof in city view cemetery may De an are hereby withdrawn from general sale and the same are hereby reserved for sale exclusively to purchasers buying same with provision for the endowment care thereof by the City of Pasco. Section 90 Separate Sections for Organizations-, The City Council may, from eme otime, set apart certain sections of sai cemetery for the exclusive use of any religious or fraternal organizations as they may deem proper and expedient, and make such regulations concerning the use and care of same as may be proper and necessary. Section 10, Trees and Shrubs ==Monuments-. No trees, plants or shrubs shall hereaffer be set in t e cemetery excepn under the immediate supervision of the City Manager or his designee. All grave stones and monument bases shall be of granites marble, limestone, or other natural stone; no cement or other composition stones of any kind shall be permitted. All grave stones and monuments shall be set flush with the ground in Blocks 4, 59 12 and 13. Upright monuments will be permitted in all other blocks. No monuments, markers, or grave stones shall be placed in said cemetery except when done under the direct supervision of the City Manager or his designee. Section IL Holidays ' olida s-, No interments, disinterments, and removals, cremation or° ns a interment service ll be permitted on Sundays, or on any of the following holidays-, New Year's Day, Memorial Day, Independence Day, Labor Day, Armistice Day, Thanksgiving Day or Christmas Day, without the special written permission of the City. When any of the before mentioned holidays falls, or is legally observed, on a Saturday or Monday, funerals will be received on the last business day preceding the holiday up to 12 o'clock noon, but no further or final disposition will be made. Section 12. Monday Morning Funerals-, Monday morning funerals will be permi a on y a e grave for said funeral is selected before noon on the previous Saturday. Section 13, Saturda Funerals-, A fee of twenty=five dollars ($25), in a �t�on o all other fees, must be paid for Saturday funerals. Section 14. Endowment Care -Charges . ­Use,bf Proceeds-, The objects, uses and source of revenue of such funds are: (a) The charges for endowment care shall be as follows-, Baby $10,00 Juvenile $1:5000 Adult $15,00 Urn $ 5,00 =2 (b) Any and all such sums shall be paid directly to the City of Pasco and held in the City View Cemetery Trust Fund, (c) The City of Pasco hereby obligates and binds itself to safely keep the monies paid to said fund; to invest the same so as to bring the largest amount of income that can safely be realized thereon; and to use the income so realized in caring for, maintaining and beautifying the said lots and graves thereon, in the manner hereinafter specified. Section 15, Certificate Prior to Pa mento Before the City of Pasco shall rem de ve rom any person or persons being a owner or owners of any lot, block, or fraction thereof, the payment hereinafter specified, the owner or owners shall present a certificate, in writing, attested as to its correctness by the City Manager or his designeeo to the following effect: (a) That the said lot, block, or fraction thereof, describing it or them has been placed on the grade required, and established in that locality; (b3 That the graves thereon have been levelled so that the surface of the grave conforms to the general level of the surface of said lot or block; (c)' That all fancy and temporary ornaments, and all flowers or shrubbery, except such as are perennial in their habits or nature, have been removed therefrom. Section 16. Record of Graves --Deeds of Sale -=Collection-, The City Manager or his designee, s a eep a comp e e recor o graves,"lots or tracts sold, to whom sold, whether perpetual care or nonperpetual care and shall providefor, and issue certificates or deeds of sale upon payment of the price thereof, together with charges hereinbefore mentioned or hereafter to be provided for; shall properly describe the property sold by grave, lot or tract, both in such certificate and upon the record to be kept by him and in case the sale is made to the county or other corporation, require that vouchers be filed for the collections of said chargeso then he shall prepare such voucher and make collections of the amount due, Section 17, Endowment Care --Record of Lots-, The City Manager or his designee, shall eep a book which shall `e we oun and properly indexed, in which he shall, upon the payment into said City View Cemetery Trust Fund as hereinabove provided, record the description of such lots, blocks,, or fractions thereof" as are entitled to endowment care under the provisions of this Ordinance. Section 18, Graves Classification-, Graves shall be classified as follows: Baby-, All burials for a person under three years of age, Juvenile-, All ourials for a person from three to ten years of age, inclusive. Adult-, All burials for a person over ten years of age. Urn-. All burials of cremated remains. Section 19. Charges --Cemetery Lots-, The cost of all graves shall be as follows; exclusive o en owment care-, Baby $25,00 Juvenile $50,00 Adult r :_ - $185,00 Adult, two tat one time $245,00 Urn $45000 -3- Y Section 20. -Char es --Pa ment for Cemetery Lots: All graves sold music be paid for in cash, e,t era the time a saidgrave p o ,s sold, or before the same is opened; provided, however, upon application made to the City of Pasco, graves may be sold on time, not exceeding eighteen months; provided that the purchaser thereof shall give a note therefore, payable to the City of Pasco, and running for a period of not more than eighteen months., with sureties to be approved by the City. Such note at the time of the sale, and the execution thereof, shall be filed with the City Manager or his designee for collection. Failure to pay the cgntract on a regular and con- sistent basis shall make the total callable. Section 21. Interest Charges: Interest shall be charged at the rate of six (6%) per cent, per annum, on all accounts not paid in full within sixty (60) days of purchase. Section 22. Charges --02ening and Closing of Graves: All graves must be opened an c ose y City o Pasco personnel, or Under the immediate supervision of City of Pasco personnel. The charges for opening and closigg shall be as follows: Baby $2.00 Juvenile $50.00 Adult $60.00 Urn $10.00 Section 23. Charges --Concrete Liners: A concrete liner, or its equivalent, must e OroVidea Provide,n each grave before any interment is made therein; the City Manager or his designee, will determine what is equivalent to a concrete box or vault, and his determination shall be final. Concrete boxes and concrete vaults may be provided by the City of Pasco. The charges for concrete liners. shall be as follows: Baby $20.00 Juvenile $50.00 Adult $60.00 Urn $10.00 Section 24. Charges -<Concrete Markers: Each grave shall have a concrete marker w icb shall e put in place y, y o asco personnel. A charge for all concrete markers shall be five dollars ($5.00). Section 25. Charges for Setting Permanent Memorial: City of Pasco personnel shall set -all permanent memorials on a labor and equipment cost basis, except that a minimum of $20.00 shall be charged. Veteran's markers shall be set by City of Pasco personnel for a fee of $20.00. -4- Section 26. Ordinance Nos. 329,-358, 439, 5739 6680 6879 8429 933, 934, R37073 1057, a37073 are hereby repealed, and all Ordinances or parts of Ordinances in conflict with, or inconsistent with, the provisions of this Ordinance, are also repealed. Section 27. This Ordinance shall be in full force and effect after its passage and publi ion as required by law. PASSED by the City Council and APPROVED this 6th day of November, 1968.
