HomeMy WebLinkAbout1321 OrdinanceCITY OF PASCO, WASHINGTON ORDINANCE NO. �a AN ORDINANCE approving and confirming the assessments and assessment roll of Local Im- provement District No. 77, which has been cre- ated and established for the purpose of improv- ing certain properties along Ruby Street, Pearl Street, Leola Street, Road 24, 23rd Avenue, 22nd Avenue, Sprouse Avenue and Chase Avenue by constructing and installing a system of san- itary sewer lines, as provided by Ordinance No. 1310, and levying and assessing the amount thereof against the several lots, tracts, par- cels of land and other property shown on the roll. WHEREAS, the assessment roll levying the special assessments against properties located in Local Improvement District No. 77 in the City of Pasco, Washington, created under Ordinance No. 1310, has been filed with the Director of Administration and ex officio City Clerk of the City of Pasco, as provided by law; and WHEREAS, notice of the time and place of hearing thereof and of making objections and protests to said roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 15th day of October, 1968, at the hour of 8:00 o'clock p.m. (P.D.T.), in the Council Chambers in the City Hall at Pasco, Washington, and further notice thereof was duly mailed by the Director of Administration and ex officio City Clerk to each property owner shown on the roll; and WHEREAS, at the time and place fixed and designated in the notices, the hearing was duly held and the City Council heard all per- sons who wished to be heard at such hearing and duly considered all protests made in writing and overruled the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN, as follows: Section 1. The assessments and assessment roll of Local Improvement District No. 77, which has been created and established for the purpose of improving certain properties along Ruby Street, Pearl Street, Leola Street, Road 24, 23rd Avenue, 22nd Avenue, Sprouse Avenue and Chase Avenue by constructing and installing a system of sanitary sewer lines, as provided by Ordinance No. 1310, as the same now stands, be and the same is hereby in all things and respects ap- proved and confirmed in the total amount of $43,616.40. Section 2. Each of the lots, tracts, parcels of land and other property shown upon the roll is hereby determined and declared to be specially benefited by said improvements in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments appearing upon the roll. There is hereby levied and assessed against each lot, tract, parcel of land and other property appearing upon the roll the amount finally charged against the same thereon. Section 3. The assessment roll, as approved and confirmed, shall be filed with the City Treasurer of the City of Pasco, Washington, for collection and the City Treasurer is hereby authorized and directed to publish notice as required by law stating that said roll is in her hands for collection and payment of any assessment thereon or any por- tion of the assessment can be made at any time within thirty (30) days from the date of the first publication of said notice without penalty, interest or cost, and thereafter the sum remaining unpaid may be paid in ten equal annual installments with interest thereon hereby fixed at the rate of 6% per annum. The first installment of assessments on the assessment roll shall become due and payable during the 30 -day period succeeding the date one year after the date of first publica- tion by the City Treasurer of.notice that the assessment roll is in her hands for collection and annually thereafter each succeeding install- ment shall become due and payable in like manner. If the whole or any portion of the assessments remains unpaid after the first 30 -day period, interest upon the whole unpaid sum shall be charged at the rate of 6% per annum and each year thereafter one of said installments, together - 2 - with interest due on the whole of the unpaid balance, shall be col- lected. Any installments not paid prior to the expiration of the 30 -day period during which such installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest at 6% per annum and for an additional charge of 6% penalty levied upon both principal and interest due upon such installment or installments. The collection of such delinquent installments will be enforced in the manner provided by law. PASSED by the City Council of the City of Pasco, Washington, at a regular meeting thereof and APPROVED by the Mayor of the City this 15th day of October, 1968. After the ordinance has been passed, I should appreciate your re- turning to me one certified copy, together with certified excerpts from the Minutes of the Council meeting showing the adoption of the ordinance and the affidavit of publication of the ordinance after it has been published. I should also appreciate receiving the affidavit of mailing of the notice of hearing on the roll to the various property owners and an affidavit of publication of such notice of hearing.
