HomeMy WebLinkAbout1304 OrdinanceORDINANCE NO. 1304 AN ORDINANCE DECLARING CERTAIN -STREETS OR PARTS THEREOF WITHIN THE CITY LIMI' S TO BE LIMITED ACCESS STREETS; DECLARING THE CITY'S POLICY IN RELATION THERETO; ESTAB- LISHING PROCEDURES FOR THE CLASSIFICATION OR WITHDRAWAL OF STREETS AS LIMITED ACCESS STREETS AND ESTABLISHING PROCED- URES FOR THE ISSUANCE OF ACCESS EASEMENTS. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS.: Section 1. Unrestricted access to and from public streets has resulted in conjestion and peril for the traveler. It has caused undue slowing of all traffic in certain areas. It is therefore the declared policy of the City of Pasco to limit access to certain streets within the City in the interest of safety and for the preservation of the public's investment in its streets. Section 2. For the purpose of this ordinance a limited access street is defined as a street which has been designated by the City Council as being limited access, and which is designed for through traffic, and over, from, or to which the owners or occupants of abutting land or other persons have no right or easement of access, or has been so designated for any other reason by the City Council to accomplish the purpose of this Ordinance. Section 3. The City Council shall have the power to designate by ordinance, from time to time, those streets or parts thereof which are limited access streets consistant with the policy of this Ordinance, or to withdraw streets or parts thereof from the limited access classification. Section 4. Ther City Council shall have the power to grant to abutting property owners' access easements to limited access facilities where in the judgment of the City Council the grant shall not interfere with or detract from the policy of this Ordinance. Application for access easements shall be in writing and shall be subject to such terms and conditions as the City Council deems necessary to protect and carry out the policy of this Ordinance. Access easements, if granted, shall be in writing and shall be signed by the Mayor of the City of Pasco and by the grantee. Section 5. The following streets or parts thereof are hereby declared to be limited access facilities: Lewis Street from the South city limits to Illinois Street. Section 6. This Ordinance shall be in full force and effect after its passage and publication as required by law. PASSED by .the City Council and APPROVED as provided by law this 14 day ary`, 1968.
