ORDINANCE NO. 1279
AN ORDINANCE APPROVING AND CONFIRMING THE
ASSESSMENTS AND ASSESSMENT ROLL FOR THE
CONSTRUCTION OF SIDEWALKS AS PROVIDED BY
RESOLUTION NO. 709 AND LEVYING AND ASSESSING
THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS,
TRACTS, PARCELS OF LAND AND OTHER PROPERTY
SHOWN ON SAID ROLL.
WHEREAS, the assessment roll for the construction of
sidewalks in the City of Pasco, under Resolution No. 709, has been
filed with the City Clerk, and
WHEREAS, notice of the time and place of hearing thereon
and of making objections and protests to said roll was duly set for the
6th day of June, 1967, at 8:00 o'clockp. m. (PDST), in the Council Chambers
in the City Hall, Pasco, Washington, and proper notice of the time and
place of hearing was given by the City Clerk, and
WHEREAS, at said hearing the City Council considered the
assessment roll and all persons appearing at said hearing were heard,
and requests for changes in said roll denied, NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO
ORDAIN AS FOLLOWS:
Section 1. That the assessments and assessment roll for
the construction of sidewalks in the City of Pasco, under Resolution No.
709, as the same now stands, be, and the same hereby are, in all things
approved and confirmed.
Section 2. Each of the lots, tracts, parcels of land and
other property shown upon the said roll is hereby determined and declared
to be specially benefited by said improvements in at least the amount
charged against the same and the assessment against the same is in
proportion to the several assessments appearing upon said roll. There

is hereby levied and assessed. against each lot, tract, parcel of land and
other property appearing upon said roll the- amount finally charged against
the same thereon.
Section 3. The assessment roll as approved and confirmed
shall be filed with the City Treasurer of the City of Pasco for the collection
of the, assessments fixed and set forth therein pursuant to law. The City
Treasurer is hereby authorized and directed to publish notice stating that said.
roll is in her hands for collection and payment of any assessment or any portion
of said assessment can be made at any time within thirty days from the date of
first publication of said notice without penalty, interest or cost, and that thereafter the
sum .remaining unpaid may be paid in Ten equal Annual installments
with interest thereon fixed at the rate of 6% per annum.
The first installment of assessments on said assessment roll
shall become due and payable during the thirty -day period succeeding the date
one year after the date of first publication by the City Treasurer of notice that the
assessment roll is in her hands for collection and -annually thereafter each succeed-
ing installment shall become due and payable in like manner. If the whole or any por-
tion of the assessments remains unpaid after the first thirty -day period, interest upon
the whole unpaid sum shall be charged at 6% per annum and each year thereafter
one of said 'installments, together with interest due on the whole of the unpaid
balance shall be collected.
Any installment not paid prior to the expiration of said thirty -day
period during.which such installment is due and payable shall thereupon become
delinquent,. -All delinquent installments shall be subject to a charge for interest
at 6% per annum and for an additional charge of 6% penalty levied upon both prin-
cipal and interest due upon such installment or installments. The collection of
delinquent installments will be enforced in the manner provided by law.
Section 4. The City may., following the initial thirty -day pre-
pay period sell an. Installment `Note in the amount of the unpaid assessments to
a City Fund as an investment for such fund as. the City Council shall hereafter
determine.

Section S . This ordinance shall be in full force and effect
after its passage and publication as required by law.
PASSED by the City Council of the City; of Pasco and
APPROVED as provided by law this 6th. day of June, 1967.
