ORDINANCE NO. 1219
AN ORDINANCE approving and confirming the
assessments and assessment roll of Local
Improvement District No. 73, which has been
created and established for the purpose of
paying a part of the cost of improving "A"
Street from Chase Avenue to Oregon Avenue and
certain other streets and avenues within the
City of Pasco, Washington, as provided in
Ordinance No. 1211, and levying and assessing
the amount thereof against the several lots ,
tracts , parcels of land and other property
shown on said roll.
WHEREAS, the assessment roll levying the special assessments
against properties located in Local Improvement District No. 73 in the City
of Pasco, Washington, created under Ordinance No. 1211, has been filed
with the Clerk of the City of Pasco, as provided by law; and
WHEREAS, notice of the time and place of hearing thereon
and of making objections and protests to said roll was duly published at
and for the time and in the manner provided by law, fixing the time and
place of hearing thereon for the 21st day of December, 1965, at the hour of
8 o'clock p.m. (PST) in the Council Chambers in the City Hall, Pasco,
Washington, and further notice thereof was duly mailed by the City Clerk
to each property owner shown on said roll; and
WHEREAS, at the time and place fixed and designated in said
notice the hearing was duly held and all protests made in writing were read
and considered by the City Council and all persons who desired to be heard
were heard and as a result of such protests and requests for changes to be
made on the assessment roll the City Council determined to make certain
revisions on such assessment roll and to overrule all other protests and
requests for changes, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON,
DO ORDAIN as follows:
Section 1. The following assessments appearing on the
assessment roll of Local Improvement District No. 73 against the following

Section 2. The assessments and assessment roll of Local
Improvement District No. 73,, which has been created and established for
the purpose of paying part of the cost of improving "A" Street from Chase
Avenue to Oregon Avenue and certain other streets and avenues within the
City, as provided by Ordinance No. 1211, as the same now stands after
the above reductions , be and the same are hereby in all things and respects
approved and confirmed, in the total amount of %� �!7 5 -
Section 3. Each of the lots, tracts, parcels of land ! nd,,
other property shown upon the said roll is hereby determined and declared J
to be specially benefited by said improvements in at least the amount charged
against the same and the assessment appearing against the same is in proportion
to the several assessments appearing upon said roll. There is hereby levied
and assessed against each lot, tract, parcel of land and other property
appearing upon said.roll the amount finally charged against the same thereon.
Section 4. The assessment roll as approved and confirmed
shall be filed with the Treasurer of the City of Pasco, Washington, for col-
lection and said City Treasurer is hereby authorized and directed to publish
notice as required by law stating that the roll is in her hands for collection
and payment of any assessment thereon or any portion of the assessment
can be made at any time within thirty days from the date. of the first publication
of said notice without penalty, interest or cost, and that thereafter the sum
remaining unpaid may be paid in ten equal annual installments with interest
thereon hereby fixed at the rate of ° per annum. The first installment of
assessments on said assessment roll shall become due and payable during the
thirty -day period succeeding the date one year after the date of first publication
by the City Treasurer of notice that the assessment roll is in her hands for
collection and annually thereafter each succeeding installment shall become
due and payable in like manner. If the whole or any portion of the assessments
remains unpaid after the first thirty -day period, interest upon the whole unpaid
sum shall be charged at the rate of S V4%annum and each year thereafter one
of said installments, together with interest due on the whole of the unpaid balance ,

shall be collected. Any installment not paid prior to the expiration of the
thirty -day period during which such installment is due and payable shall
thereupon become delinquent. All delinquent installments shall be subject
to a charge for interest at 5 1/4% per annum and for an additional charge of 6%
penalty levied upon both principal and interest due upon such installment
or installments. The collection of such delinquent installments will be
enforced in the manner provided by law.
PASSED by the City Council of the City of Pasco, Washington,
at a regular meeting thereof , and APPROVED by the Mayor this day of
1966.

Greenlee was absent from the meeting.

APPROVAL OF MINUTES:
Motion made by Robinson, seconded by Bailey that the minutes of the Regular
Council Meeting held January 18, 1966, be approved as written. Motion Carried.

ORDINANCES:
ORDINANCE NO. 1219
AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT
ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 73, WHICH HAS BEEN CREATED AND
ESTABLISHED FOR THE PURPOSE OF PAYING A PART OF THE COST OF IMPROVING
"A" STREET FROM CHASE AVENUE TO OREGON AVENUE AND CERTAIN OTHER STREETS
AND AVENUES WITHIN THE CITY OF PASCO, WASHINGTON, AS PROVIDED IN ORDINANCE
NO. 1211, AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL
LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY SHOWN ON SAID ROLL.
Motion made by Bailey, seconded by Robinson to read Ordinance No. 1219 by
title only. Ordinance No. 1219 was read by title. Motion made by Wiseman,
seconded by Robinson that Ordinance No. 1219 has been read. Motion Carried.
Motion made by Robinson, seconded by Stork that the assessment of $2,958.00
be reduced by $66.00 to $2,892.00 on the following described property:
The E. 200' of that portion of blocks 17,18,19,24, 6 A of
O'Keefe's 3rd Addn. tog. with vacated streets and alleys
adjoining said blocks, lying southerly of Hopkins (Frontage Road),
except the South 207.0' thereof and except Hopkins Street, MOTION CARRIED.
Motion made by Robinson, seconded by Stork that the assessment of $798.00
be reduced by $84.00 to $714.00 on the following described property:
The east 200' of Blk 17, O'Keefe's 3rd Addition, tog. with vac,
streets 6 alleys adjoining, lying South of Primary State Highway #3
6 North of Hopkins (Frontage Road). MOTION CARRIED.
Motion made by Bailey, seconded by Stork to adopt Ordinance No. 1219 as
amended. Motion carried by roll call vote of six (6).

Re: Local Improvement District No. 73
In accordance with your letters of January 3 and 4, I have
prepared and am enclosing an original and five copies of the ordinance
approving and confirming the assessment roll for consideration by your
City Council at its January 20 meeting. You will note reference is made
in the last description as to name of property owner to show the Spokane,
Portland & Seattle Railway Company as owner instead of the Northern
Pacific Railway. If this ordinance meets with your approval and it is
passed by the City Council at the January 20 meeting, I should appreciate
your returning to me one certified copy, together with certified excerpts
from the minutes of the Council meeting showing the passage of the
ordinance and the Affidavit of Publication of the ordinance after it
has been published.
I assume that as soon as the 30 -day cash prepayment
period has expired I will be advised of the amount collected and I can
then prepare an ordinance providing for the issuance and sale of the
local improvement district bonds. Will the City be taking an install-
ment note as an investment for one of its own funds or will bonds be
issued and,if so,who will be buying the bonds?
