HomeMy WebLinkAbout1205 Ordinancel CITY OF PASCO, WASHINGTON, ORDINANCE NO. 1205 AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF Ldcal IMPROVEMENT DISTRICT NO. 69, WHICH HAS BEEN CREATED AND ESTABLISHED FOR THE PURPOSE OF PAYING A PART OF THE COST OF IMPROVING SOUTH ELM STREET FROM ALTON STREET TO "All STREET BY THE CONSTRUCTION AND INSTALLATION OF CURBS AND SIDEWALKS, AS PROVIDED IN ORDINANCE NO. 11779 AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY SHOWN ON SAID ROLL. WHEREAS, the assessment roll levying the special assessments against properties located in Local Improvement District -No. 69 in the City of Pasco, Washington, created under Ordinance No. 1177, has been filed with the Clerk of the City of Pasco, as provided by law; and WHEREAS, notice of the time and place of hearing thereon and of making objections and protests to said roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 7th day of September, 1965, at the hour of 8:00 o'clock p.m.(PDST), in the Council Chambers in the City Hall, Pasco, Washington, -and further notice thereof was duly mailed by the City Clerk to each property owner shown on said roll; and WHEREAS, at the time and place fixed and designated in said notice the hearing was duly held and. all protests made in writing were read and considered by the City Council and all persons who desired to be heard were heard and as a result of such protests and requests for changes to be made on the assessment roll, the City Council determined to make certain revisions on such assessment roll and to overrule all other protests and requests for changes, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO$ WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following assessment appearing on the assessment roll of Local Improvement District No. 69 against the following described property is hereby changed and revised as follows: 4 PROPERTY DESCRIPTION AND ORIGINAL AMOUNT APPEARING PROPERTY OWNERS ON ASSESSMENT ROLL REVISED AMOUNT Lot 46, Block 3, Terrace $82.50 -0- Heights Addition Milton & Jas. Norwood, Jr.. 1811 E. Howell Street Seattle, Washington Lot 47, Block 3, Terrace $82.50 -0- Heights Addition Milton & Jas. Norwood, Jr. 1811 E. Howell Street Seattle, Washington Section 2. The assessments and assessment roll of Local Improvement District No. 69, which has been created and established for the purpose of paying a part of the cost of improving South Elm Street from Alton Street to "A" Street by the construction and installation of curbs and sidewalks, as provided in Ordinance No. 1177, as the same now stands, after the above reduction, be and the same are hereby in all things and respects approved and confirmed. Section 3. Each of the lots, tracts, parcels of land and other property shown upon the said roll is hereby determined and declared to be specially benefited by said improvements in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments appearing upon said roll. There is hereby levied and assessed against each lot, tract, parcel of land and other property appearing upon said roll the amount finally charged against the same thereon. Section 4. The assessment roll as approved and confirmed shall be filed with the Treasurer of the City of Pasco for collection and that said City Treasurer is hereby authorized and directed to publish notice as required by law stating that said roll is in her hands for collection and that ',payment of any assessment thereon or any portion of said assessment can be made at any time within thirty days from the date of the first publication of said notice without penalty, interest or cost, and that thereafter the sum remaining unpaid may be paid in ten equal annual installments with interest thereon hereby .fixed at the rate of. 5% per annum. The first installment of assessments on said assessment roll shall become due and payable during the thirty=day period succeeding the date one year after the date of first publication by the City Treasurer of notice that the assessment roll is in her hands for collection and annually thereafter -2- each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessments remains unpaid after the first -thirty-day period, interest upon the whole unpaid sum shall be charged at the rate of 5% per annum and each year thereafter one of said installments, together with interest due on the whole of the unpaid balance, shall be collected. Any installment not paid prior to the expiration of the said thirty -day period during which such installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest at 50 per annum and for an additional charge of -6% penalty levied upon both principal and interest due upon such installment or installments. The collection of such delinquent installments will be enforced in the manner provided by law. PASSED by the City Council of the City of Pasco, Washington, at a regular meeting thereof, and APPROVED by the Mayor this 7th day of September, 1965. �,.
