HomeMy WebLinkAbout1183 Ordinance4 ORDI.NAVCE NO. _11$3 AN ORDINANCE PRESCRIBING RULES GOVERNING VEHICLES, AND REG- ULATING PASSING ON THE RIGHT WITHIN THE CITY LIMITS OF THE CITY OF PASCO; PROVIDING PENALTIES FOR VIOLATIONS OF THIS ORDINANCE, AND REPEALING SECTION NO. 39 OF ORDINANCE NO. 1180. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. When overtaking vehicle may pass to the right. (1) The operator of a vehicle may overtake and pass upon the right of another vehicle only under the following conditions: a. When the vehicle over- taken is making or about to make a left turn; b. upon a street or highway with unobstructed pavement, not occupied by parked vehicles, of sufficient width and lanes striped for two or more lanes of moving vehicles in each direction; c. upon a one-way street or upon any roadway on which traffic is restricted to one direction movement, where the road is free from obstruction and of suf- ficient width for two or more lanes of moving vehicles. (2) The operator of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movement in safety, in no event shall such movement be made by driving off the pavement or main traveled portion of the roadway. Section 2. Penalties. Any person convicted of a violation of this ordinance shall be subject to a fine of not more than $300. 00 or imprisonment for not more than 90 days, or both such fine and imprisonment. Section 3. Section 39 of Ordinance No. 1180 is hereby repealed. Section 4. This Ordinance to be in full force and effect after its passage and publication as required by law.
