HomeMy WebLinkAbout1182 OrdinanceCITY OF PASCO, WASHINGTON ORDINANCE NO. 1182 AN ORDINANCE ordering the acquisition of land for and the construction of certain arterial street improvements within the City as provided in Ordinance No. 1131, all in accordance with Resolution No. 634 of the City Council of the City of Pasco, Washington; establishing Local Improvement District No. 70; providing the method of assessment in said District; and providing that payment in part for said improvements be made by special assessments in the District payable by the mode of "payment by bonds. " WHEREAS , the City Council of the City of Pasco, Washington, by Ordinance No. 1131, passed by the City Council and approved by the Mayor on January 21 , 1964, provided for the acquisition of land for and the construction of certain arterial street improvements within the City and provided that the cost thereof be paid, first, from theproceeds received from the issuance and sale of not to exceed $800, 000 .00 par value of "General Obligation Arterial Street Bonds , 1964, " (now designated "General Obligation Arterial Street Bonds, 1965,") second, by the levy and collection of special assess- ments to cover a part of the cost of carrying out those improvements in a local improvement district -to be thereafter created, including within its boundaries all of the property located within the City of Pasco receiving special benefits from the construction and installation of the improvements therein specified, and, third, by the use of moneys accumulated in the City "Arterial Street Reserve Fund"; and WHEREAS, at a special election held in the City of Pasco on March 10, 1964, in conjunction with the general city election held on the same date, the proposition authorizing the incurrence of a general indebtedness and the issuance of not to exceed $800,000.00 of "General Obligation Arterial Street Bonds, 1964, " (now designated "General Obligation Arterial Street. Bonds, 1965 ") was duly approved by the qualified voters residing within the City and said bonds have been issued and sold; and WHEREAS, by Resolution No. 634, adopted February 2, 1965, the City Council of the City of Pasco declared its intention to acquire land for and construct certain arterial street improvements within the City, in accordance with the provisions of Ordinance No. 1131, passed by the City Council and approved by the Mayor on the 21st day of January, 1964, and fixed the 2nd day of March, 1965, at 8 o'clock p.m. (PST) in the Council Chambers in the City Hall, Pasco, Washington, as the time and place for hearing all matter related to said improvements and all objections thereto and for determining the method of payment for said improvements; and WHEREAS, �e.orge. R.: -"Fisher, � City:: Engineer,. has°o caused an estimate to be made of.the cost and expense of such improvements and have certified said estimate to the City Council, together with all papers and information in their possession concerning such improvements, a description of the boundaries of the District, a statement of what portion of the cost and expense of the improvements should be borne bythe property within the proposed District, a statement in detail of the local improvement assessments outstanding or unpaid against the property in the proposed District and a statement of the aggregate actual valuation of the real estate, including 25% of the actual valuation of the improvements in the proposed District according to the valuation last placed upon it for the purpose of general taxation; and WHEREAS, said estimate is accompanied by a diagram of the improvements showing thereon the lots, tracts and parcels of land and other property which will be specially benefited by said arterial street improvements, and the estimated amount of the cost and expense thereof to be borne by each lot, tract and parcel of land and other property; and WHEREAS, due notice of the hearing upon said Resolution No. 634 was given in the manner provided by law and said hearing was held by the City Council on March 2, 1965, and all written protests filed with the City Council on or before said date were duly considered and by it -2- overruled and all persons appearing at said hearing were heard; and WHEREAS, the City Council, after giving due consideration to the method of payment of said improvements, determined it to be in the best interests of the City and of the owners of property within the local improvement district that a part of the cost of carrying out such improve- ments as hereinafter set forth be specially assessed and that such improve- ments should be carried out and that a local improvement district be created in connection therewith; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN as follows: Section 1. It is hereby ordered that the City acquire land for and con s t r u'c.t• certain arterial street improvements within the City in accordance with the provisions of Ordinance No. 1131, passed by the City Council and approved by the Mayor on the 21st day of January, 1964, which ordinance is by this reference made a part hereof and incorperated herein, such arterial street improvements to be constructed and installed in accordance with the plans and specifications there for::prepared by Gray & Osborne, consulting engineers to the City. Section 2. There is hereby created and established a local improvement district to be called "Local Improvement District No. 70" of the City of Pasco, Washington, which District is more particularly described in Exhibit; A attached hereto and by this reference made a part hereof. Section 3. Not to exceed a total of $365 , 000.00 of the .cost and expense of said improvements shall be borne by and assessed against the property specially benefited by such improvements included in Local Improvement District No. 70 herein created, embracing as near as may be all of the property specially benefited by such improvements. The balance of the cost and expense of carrying out such improvement shall be paid from the proceeds received from the issuance and sale of the "General Obligation Arterial Street Bonds, 1965 , " and from moneys in the City "Arterial Street -3- Reserve Fund," if required. Section 4. The nature of the improvements provided for herein is such that the special benefits conferred upon the property in the local improvement district herein created are not fairly reflected by the use of the zone -and -termini method of assessment therefor and it is hereby provided and ordered that the assessments shall be made against the property of the District in accordance with the special benefits it will derive from the improvements without regard to the zone -and -termini method provided by statute. Section S. After the expiration of the 30 -day period for payment in cash of assessments appearing upon the final assessment roll for such District and the determination of the amount of such collections received during such 30 -day period, local improvement bonds shall be issued in an amount equal to the then remaining unpaid balance of assessments on such assessment roll. Such bonds shall bear interest at a rate to be hereafter fixed by ordinance not exceeding 6% per annum, shall be payable on or before twelve years from the date of issuance, the life of the improvement ordered being not less than twelve years, and shall be redeemed by the collection of special assessments to be levied and assessed uponthe.property within said District payable in ten equal annual installments, with interest at a rate to be hereafter fixed by ordinance not exceeding 6% per annum, under the mode of "payment by bonds" as defined by law and the ordinances of the City of Pasco. In the case of default in the payment of any assessment when the same shall become due there shall be added interest at a rate to be hereafter fixed by ordinance not to exceed 6% per annum and a penalty of 6% which shall also be collected. The exact form, amount, date, interest rate and denominations of said bonds shall be hereafter fixed by ordinance of the City Council and such bonds shall be sold in such manner as the City Council shall hereafter determine. Section 6. There is hereby created and established in the office of the City Treasurer of the City of Pasco for Local Improvement District No. 70 Em o' Reserve Fund," if required. Section 4. There is hereby created and established in the office of the City Treasurer of the City of Pasco for Local Improvement District No. 70 Em � C a special fund to be known and designated as "Local Improvement Fund, District No. 7.0,,," into which fund shall be deposited all collections pertaining to assessments on the assessment roll of the District and out of which fund shall be transferred the cash payments of assessments made during the 30 -day cash prepayment period to the Arterial Streets Fund of the City. The proceeds from the sale of the local improvement bonds to be issued shall be deposited in the Arterial Streets Fund of the City, into which Fund the proceeds from the sale of the "General Obligation Arterial Street Bonds, 19 65 , " have been deposited and out of which Fund all costs and expenses of the improvements will be paid.
