ORDINANCE NO. 1168
AN ORDINANCE providing for the issu-
ance of an installment note payable from
the "Local Improvement Fund, District No.
68 of the City to be sold to the Firemen's
Relief and Pension Fund of the City as an
investment for such Fund.
WHEREAS, pursuant to Resolution No. 599, adopted by the
City Council and approved by the Mayor on August 4, 1964, the sum of
$16,000.00 was transferred from the Arterial Street Fund of the City to
the "Local Improvement Fund, District No. 68," as a temporary transfer
loan to make work progress payments in carrying out the improvements in
Local Improvement District No. 68, such temporary loan to be repaid by
a lump sum payment when bonds of the local improvement district were
sold; and
WHEREAS, Ordinance No. 1130 of the City provided that
the City should issue its local improvement bonds to pay for the cost
and expense of the improvement in Local Improvement District No. 68,
such bonds to be redeemed from special assessments against the property
benefited by the improvement; and
WHEREAS, the 30 -day period allowed by law for the pay-
ment of assessments in Local Improvement District No. 68 without pen-
alty or interest has elapsed, the total amount of the assessment roll as
confirmed being $13,851.36, and $3,993.65 having been collected uring
said 30 -day period, leaving an uncollected balance on said roll of
$9,857.71; and
WHEREAS, the City Council has now determined that in
lieu of issuing those local improvement bonds it is in the best interest
of the City to issue an installment note payable out of the "Local
Improvement Fund, District No. 68," and sell such note to the Firemen's
Relief and Pension Fund of the City as an investment for such Fund, and
the proceeds from the sale of such note to be used toward the repayment
of the temporary loan to the "Arterial Street Fund" of the City as aforesaid;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON,
DO ORDAIN, as follows::.
Section 1. Pursuant to Chapter 165 of the Laws of 1961 of
the State of Washington, there shall be issued one installment note payable
to the Firemen's Relief and Pension Fund out of the "Local Improvement Fund,
District No. 68, " to be dated November 1.0, 1964, and to become finally due on
Novemberl.0, 1976. The note shall be issued in the amount of $,9.,857.71
representing the balance of the cost and expense of Local Improvement District
No. 68, which is to be borne by the property owners therein, and which includes
any interest accrued on the temporary loan from the "Arterial Street Fund," as
aforesaid. The installment note shall bear interest at the rate of 4 1/4%
per annum to be paid on the unpaid balance thereof. The installment note shall
be sold to the Firemen's Relief and Pension Fund at par as an investment for such
Fund. Moneys from the "Local Improvement Fund, District No. 68" shall be paid
to the payee of such note at least once a year, beginning with the date of issue, for
the purpose of reducing the principal and interest amounts due on the installment note.
Upon receipt by the Firemen's Relief and Pension Fund, such moneys shall first
be applied toward the interest due on the unpaid balance of the installment note
and any additional moneys shall thereaf ter apply as a reduction of the principal
amount of the note.
Section 2. The installment note issued pursuant to this
Ordinance shall bear on its face (1) the name of the payee; (2) the designa-
tion of Local Improvement District No. 68 from whose funds the note is
payable; (3) the date of issue of the note; (4) the date on which the note
or the final installment thereon shall become due; (5) the rate of interest
to be paid on the unpaid balance thereof; and (6) such manual or facsimile
signatures and attestations as are required to appear on the warrants of
the City. The reverse side of the installment note shall bear a tabular

payment record which shall indicate at prescribed installment dates the
receipt of any Local Improvement District funds for the purpose of servicing
the debt indicated by the note. The tabular payment record shall, in
addition to the above, show the unpaid principal balance due on the
installment note together with sufficient space opposite each'transaction
affecting the note for the manual signature of the officer authorized to
receive the money for the payee.
Section 3. The installment note may be redeemed out of
"Local Improvement Fund, District No. 68" at any time by payment in
full of the unpaid principal balance and accrued interest to date of redemption.
Section 4. The installment note shall be issued and paid
in accordance with, and shall otherwise be subject to, the provisions of
,Chapter 165 of the Laws of 1961 of the State of Washington.
PASSED by the City Council of the City of Pasco, Washington,
at a regular meeting thereof and APPROVED by the Mayor of the City this
17th day of November, 1964.

I Might, emphasize,the feeling of the Council in passing the enclosed
Resolution-in..more detail for;you,at this time. The City,.Council
is requesting that the Highway Com,mission initiate,,a program.to im-
prove Lewis .Street and North Fourth -Avenue here in the '.City to bring
these two streets up to arterial standard. The Council, in making
this request; wishes to emphasize that these streets have been used
as, highways for a long ;period of tice and without any major improve-
ments on -them. The Council also wishes to advise the Highway Commission
that these improvements are needed because they relate to the City's
cont!ew?lated arterial street improvement program. During the month of
December, the City Council anticipates awarding contracts for4approxi-
nately,,$1,000,,000,00 worth of arterial street construction. This is a
significant piece of work on the part of the City and the streets$ as
requested by the Council for the Highway Commission to improve,, are
directly related to the arterial street prorram.
The City Council further requests the improvement of the streets at
this time by the Highway Commission because with the completion of the
Bypass Highway around the City of Pasco. It will now be much more con-
venient for the Highway Commission toperform this work than it had been.
The City of Pasco is anxious to cooperate with the Highway Coi".,is6lon
in any way that we can in improv--i-n—nit of street end traffic conditions
within the City.

Dear Mrs. Arnold:
The City Council,, at their meeting of November 17th, approved the
-repayment of funds to the State Highway Department to be used in
..agqui:ving the park site on Oregon Street.which you referenced in
your .letter of October 28th. This park site will be used to com-
memorate -the first air mail flight which occurred at Pasco in 1926.,'.
In yojur letter of October 28th, you suggested that the ?asco Women's
Club would like to participate in the beautification of this park
and erect certain facilities in the park for use of the public. On
.beh'dl.:E of the Council, I would like to take this opportunityto
,thank you for your concern and cooperation and advise you that I
am certain that when negotiations with the State have been completed,
your Club will certainly be invited.to participate as suggested.
I.would like .to apologize for the delay in answering your letter but
negotiations .with the State Highway Commission for this property did.

The City Council at its meeting of November 17th approved the change
out of all incandescent fixtures in the City Street Lighting System to
the mercury vapor unit as discussed previously with you.. The change,
as proposed, includes changing 427, 4,000 lumen incandescent fixtures
to 7„000 lumen mercury vapor fixtures; also change out of 26, 6,000
lumen incandescentunits to'11,500 lumen mercury vapor units; the
chaage out of 70, 10,000 incandescent units to 21,000 mercury vapor
units. -•�
According to our calculations, the total additional charge-once.in-
stall.ation has been completed, will amount to $61..90 per month. The
Council has approved this change and you are hereby authorized to
proceed with'this project.
In addition, I,would like to request, at your convenience, a presen-
tation of the proposed lighting, of arterial streets and also the pro-
posed relighting' of the Lewis Street Underpass.
Another .topic that was discussed at the November 17th meeting., by 'the
Council coneerned,'thd--location of your pole line on Lucas Street. The
Council will meet on November 24th for a. workshop meeting to discuss
again the location of poles, street signs, fire hydrants and sidewalks
on the street right of way along the arterial streets. Sometime at your
convenience; before that meeting, I would appreciate it if you would
contact me so that we might discuss this subject again.

With respect to Local Improvement District No. 67, I suspect
that you have now received from Wayne Campbell the revised pages for the
ordinance providing for the issuance of an installment note. I forwarded
these pages to Wayne on November 10, together with a similar ordinance
for Local Improvement District No. 68 for Council consideration tomorrow,
November 17.
After you have published the ordinance for Local Improvement
District No. 67, with the revised pages inserted, I should appreicate
your sending me one certified copy of the ordinance, together with certified
excerpts from the minutes of the November 2 Council meeting showing the
passage of the ordinance and the Affidavit of Publication. In my letter
to Wayne of November 10, I also listed other transcript material which I
need.
The law assumes that an ordinance will be published within
a reasonable time after its passage. There is no maximum limitation on
such time. The effectiveness of the ordinance is just postponed until
after such publication.
With respect to the "Water and Sewer Revenue Bonds, 1964,"
the Notice of Bond Sale was published in the Daily Journal of Commerce in
Seattle on Thursday, November 12 and was published in the Daily Bond Buyer
on November 13. A complimentary insertion will be made in the Weekly
Bond Buyer on November 23. I have requested the Bond Buyer to send you
their bill and Affidavit of Publication and to send two copies of the Affidavit
to my office.
