AN ORDINANCE specifying and adopting a system. or plan for making additions to and betterments and -- extensions of the waterworks utility of the City of Pasco, including the sanitary sewerage system and the system of -storm or surface water sewers as a part thereof; declaring the estimated cost there- of as nearly as may be; providing•for the issuance and sale of not to' exceed $1,150,000.00 par ..value of water and sewer revenue.bonds in one or more series to obtain the funds with which to pay the cost of such system or plan; creating a special. fund to provide for the payment of such bonds; and authorizing and directing the City officials to proceed with the improvement. WHEREAS, the City of Pasco, Washington by Ordinance No. 531, passed March 7, 1944, provided that the system of sewerage of the City, including all additions, extensions and betterments thereto, should be operated as'a part of and as belonging to the waterworks utility. of the City pursuant to the provisions of Chapter 193 of -the 1941 Session Laws of the state of Washington .(R.C.W. 35.67.320 et seq.) and the words "waterworks utility of the Cityv shall hereinafter mean the combined sanitary.sewerage system and water system of the City and the storm or surface water sewers -herein authorized to be con- structed.and installed as a part of such combined systems, together with all additions thereto and betterments and extensions thereof hereafter made; and WHEREAS, the existing sewer lines and facilities of the City carry, treat and dispose of both sanitary sewage and storm or surface waters in the same lines or plant, and it is necessary for the proper and efficient operation of the system of sanitary sewage disposal and treatment that separate storm or surface water sewers be acquired, constructed and installed to intercept and divert and to remove a sub- stantial portion of the storm or surface waters from the combined system of sanitary sewerage and•storm'or surface -water disposal and treatment, and the public health and -welfare require and it is in the best interests of the inhabitants, of 'the -City of Pasco that certain sewer improvements be. made to the sanitary sewage disposal system of the City as hereinafter set forth, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN as follows: Section 1. The City of Pasco hereby specifies and adopts a system or plan for making additions to.and betterments and extensions of the waterworks utility of the City which shall consist of the acquisition, construction and. installation of' storm :or 'surface water sewers, all to be combined with -and -.hereby made apart of the water- works utility of. the City, and a'.sanitary interceptor sewer system which shall consist of the following: A. STORM SEWER LINES There shall be constructed and installed the following storm sewer lines in the.City of Pasco,, Washington, to -wit: 1. A 48" sewer pipe iri 4th Ave. from the'Columbia River to Washington Ave., thence in Washington Ave. to Railroad Ave., thence in Railroad Ave. to Ainsworth Ave., thence in Ainsworth Ave. to 4th Ave., thence northeasterly on 4th Ave. to "C" St., thence in 4th Ave. to South St. 2. A.4241 sewer pipe in 4th Ave. from•South St. to Columbia St., thence in Columbia St. to 3rd Ave., thence in 3rd Ave. to Clark St. 3. A 36" sewer pipe in 3rd Ave. from Clark St. to Bonne- ville St. ,4. A 30" sewer pipe in 3rd Ave. from Bonneville St. to Yakima St. 5., A 24" sewer pipe in Yakima St. from 3rd Ave. to 5th Ave. 6. An 18" sewer pipe in Lucas•Ave. from Court St.'to' Pearl St. 23., A 21" sewer pipe in Sacajawea Dr. from Court St. to Astor Way. B. SANITARY INTERCEPTOR SEWER 1. There shall be constructed and installed a 36 -inch and 30 -inch diameter reinforced•,concrete interceptor sewer, complete with manholes, lateral connections, railroad and road crossings, pavement replacements, connections to,a proposed pump station, connections to -3- other interceptors, and all other appurtenant items, beginning at a proposed,pump station on -the northeast corner of Ninth Avenue and Wash- ington Avenue in the,City of Pasco and'running thence northwesterly along Washington Avenue and the approximate extension thereof to West "A" Street, thence westerly along West "A" Street to the vicinity of. Road 28, and thence northwesterly parallel to the existing dike adjacent to the Columbia River to the west side of the existing highway bridge abutment on"public right-of-way and on easements granted by the Northern Pacific Railway, the United States GoverMent, Washington State Depart- ment of Highways and private owners, all within the City of Pasco, Washington. 2. There shall be constructed and installed'a 12 -inch dia- meter reinforced coricrete interceptor sewer, 'comple.te.wit.h manholes, -lateral connections, connection -to the diversion manhole at the existing pump station,:connection to the proposed main interceptor -sewer, railroad crossings, road crossings, and all,•other.'necessary appurten ances, from the existing pump station and diversion manhole in the alley between West "A" Street and West Lewis Street at -approximately Lucas Avenue in a southerly direction to a connection with the proposed main interceptor on the approximate.extension'of Washington Avenue on public right-of-way and easements granted to the City by the Northern Pacific Railway in the City of Pasco, Washington. 3• There shall be constructed and installed a 15 -inch dia- meter reinforced concrete interceptor sewer, complete with manholes, lateral connections, road crossings, pavement replacement, connection. to the main interceptor on West "A" St,reet,•and all other necessary appurtenances, from the north side of State Highway No..'410 at Road 28, thence south on said Road 28 to West ",A"*Street on public right-of-way in the City of Pasco,' Washington.. �+. There ' shall be .constructed and . installed' a reinforced concrete pump station, complete with piping, pumps,. pipe connections, to the interceptor sewer and force main, controls, electric power system, standby power, chlorination facilities, air and chemical odor control facilities, heating, lighting, housing, parking, access drives, land- scaping, provisions for future expension, and all other necessary appur- tenances, on property of the City of Pasco on the northeast corner of Ninth Avenue and Washington Avenue in the City of Pasco, Washington. 5. There shall be constructed and installed a 20 -inch dia- meter cast iron and steel pipe force main, complete with valves, connec- tions to the existing main, connection to the proposed pump station, controls, air valves, pavement removal and replacement, fittings, con- trols, and all other necessary appurtenances, from the proposed pump station at the northeast corner of Ninth Avenue and Washington Street, southeasterly along Ainsworth Avenue to Fifth Avenue, thence north- easterly on Fifth Avenue to Ainsworth Avenue, and thence northeasterly along Ainsworth Avenue to a connection with the existing force main in the vicinity of South 4th Avenue and Ainsworth Avenues, on public right-of-way in the City of Pasco, Washington, There shall be included in the foregoing all the necessary manholes, surface settings, couplings, connections, equipment and appurtenances and the acquisition of all property, both real and personal, or any interest therein and all easements, franchises, right-of-way, licenses and permits to carry out the above described plan of improve- ments, and there shall be included the performance of such work as may be incidental and necessary to the foregoing construction and installation. The foregoing t;tof7m:--sewer lines shall be constructed in accordance with the plans and specifications and maps therefor prepared by Gray & Osborne, consulting engineers of Yakima and Seattle, Washington, and the foregoing sanitary interceptor sewer in accordance with the plans and specifications and maps prepared by Cornell, Howland, Hayes & Merryfield, consulting engineers of Seattle, Washington, and Corvallis, Oregon, to be filed in the office of the City Clerk. -5- The City Council may modify the details of the foregoing system or plan and make such changes therein as in its judgment it appears advisable either prior to or during the actual course of construction, provided such modifications do not substantially alter the purposes herein set forth. Section 2. The gross revenues and benefits to be derived F from the operation and maintenance of the waterworks utility of the City at the rates to be charged for water and for sanitary sewage disposal service on the entire utility will intthe ,judgment of the City Council be more than sufficient to meet all expenses of operation and maintenance thereof and to permit the setting aside into a special fund out of the gross revenues of the waterworks utility of the City of sufficient amounts to pay the interest,, on the bonds herein author- ized to be issued and on the outstanding "Special Fund eater -Sewage Revenue Bonds, 1944-19+6, Series B" dated January 1, 1946, "Mater Revenue Bonds, 1948" dated March 1, 1948, "eater and Sewer Revenue Bonds, 1954" dated January 1, 1954 and "Nater and Sewer Revenue Re- funding Bonds, 1963" dated January 1, 1963, as such interest becomes due and payable, and to pay and redeem all of said bonds at maturity. Section 3. The life of the foregoing additions to and better- ments and extensions of,the waterworks utility of the City is hereby declared to be at least thirty years. Section 4+. The estimated cost, as near as may be, of the acquisition, construction and installation of the above described additions to and betterments and extensions of the waterworks utility of the City is hereby declared to be $1,150,000.00. Section 5. The cost of acquiring, constructing and making the foregoing additions to and betterments and extensions of the waterworks utility of the City shall be paid from the proceeds received from the issuance and sale of water and sewer revenue bonds in the amount of not to exceed $1,150,000.00. It is the intention of the City to acquire and construct and complete such portions of the foregoing system or plan of additions to and betterments and extensions of the waterworks utility of the City as from time to time the City Council shall deem advisable. The bonds shall be issued in one or more series at such times as the City Council shall deem advisable. The bonds shall be entitled "Water and Sewer Revenue Bonds, 1964," with series desig- nation following, if issued in series. The bonds shall bear interest at a rate or rates not to exceed 6% per annum, payable semiannually, and shall be numbered from "one" upward, consecutively, within each series as issued. The bonds shall be issued in such series; shall be in such de- nominations and form; shall bear such date or dates and interest rate. or rates; shall be payable at such place or places;'shall mature serially in accordance with such schedule, beginning not earlier than one year after date of issuance and ending not later than thirty years thereafter or shall be term bonds; shall have such option of payment prior to maturity; shall guarantee such coverage and collection of rates; shall provide for such additional funds and accounts; and shall con- tain and be subject to such provisions or covenants as shall be here- after provided by ordinance. Section 6. The bonds shall be payable solely out of the special fund herein created and shall be a valid claim of the holder thereof only as against such special fund, and the amount of the revenues of the waterworks utility of the City pledged to such special fund, and shall not be a general -obligation of the City of Pasco, Washington. Section 7. There shall be and hereby is created and estab- lished in the office of the Treasurer of the City of Pasco a special fund to be known as "mater and Sewer Revenue Bond Fund, 1964," which fund is to be drawn upon for the sole purpose of paying the principal of and interest on the bonds. From and after the date thereof and so long thereafter as bonds are outstanding against such fund, the -7- City Treasurer shall set aside and pay into said fund out of the gross revenues of the waterworks utility of the City a fixed amount without regard to any fixed proportion, namely, an amount sufficient to pay the principal of and interest on the bonds as they respectively become due and to create such surplus and reserve, if any, that may hereafter be prescribed by ordinance. The gross revenues from ;the waterworks utility�of the City, are hereby pledged to such payment and the bonds herein authorized shall constitute a lien and charge upon such re- venues prior and superior to any other charges whatsoever, excluding charges for maintenance and operation, except that the lien and charge upon said gross revenues shall be subordinate and inferior to the prior lien and charge .against the same for the outstanding "Special Fund Water -Sewage Revenue Bonds, 1944-19+6, Series B" dated January 1, 1946, and the outstanding "Water Revenue Bonds, 1948" dated march -1,1948, provided, however, that if the conditions required to be met as set forth in Section 13 of Ordinance No. 768, as amended by ordinance No. 774,shall be met at the time of the issuance of the bonds herein authorized the lien and charge upon such gross revenues for the bonds herein author- ized shall be/oona parity of lien with the lien and charge upon such gross revenues for the outstanding "Water and Sewer Revenue Bonds, 195411 dated January 1, 1954, "Water and Sewer Revenue Refunding Bonds, 1963" dated January 11 1963, and for any additional water and revenue sewer bonds that may be hereafter issued pursuant to the provisions of Section 13 of Ordi- nance No. 768, as amended by Ordinance No. 774. Otherwise, the lien and charge upon such gross revenues for the bonds herein authorized shall be subordinate and inferior to the prior lien and charge upon such gross revenues for all of said bonds above described. Section 8. The City Council and corporate authorities of the City of Pasco hereby declare that in creating the said special fund and in fixing the amounts to be paid into it as set forth herein they have exercised due regard to the cost of operation and maintenance of the waterworks utility of the City and the debt service requirements of the above described outstanding bonds, and the City of Pasco has not bound and obligated itself and will not bind and obligate itself to set aside and pay into such special fund a greater amount or propor- tion of the revenues of the waterworks utility than in the judgment Me of the City Council will be available over and above such costs of maintenance and operation and debt service requirements of the above described outstanding bonds. Section 9. The proceeds of the sale of the foregoing bonds shall be used for the sole purpose of making the additions to and betterments and extensions of the waterworks utility of the City, as herein authorized,and of paying the cost and expenses connected there- with, and the City of Pasco, through its proper officers and agents, shall proceed with the making of said improvements and the calling of bids therefor in the manner provided by law. PASSED by the City Council of the City of Pasco, Washington, and approved by its Mayor at a regular meeting thereof held on the 21st day of July, 1964.
