CITY.OF PASCO, WASHINGTON ORDINANCE NO.. 1014 AN ORDINANCE approving and confirming the assessments and assessment roll of Local.Improvement District No. 65, which has been created and established for the purpose of improving N. Mead Avenue to the south line of W. Court Street, and W. Brown. Street from the east line of.N. Illinois Avenue'to the west line of N. Oneonta Avenue, by the construction and installation of asphaltic concrete pave- ment 42 feet wide curb to curb, -including crushed rock base, concrete gutter and concrete curb where necessary and.storm sewer facilities,, including catch basins, manholes and all necessary appurtenances, and doing all other work as may be neces- sary in connection therewith, as provided by Ordinance No. 998, and levying and assessing the amount thereof against the several lots, tracts, parcels of land and other property shown on said roll. WHEREAS, the assessment roll levying the special assessments against properties located in Local Improvement Dis-. trict No. 65 in the City of Paseo, Washington, created under Ordinance No. 998, has been filed with the.City Clerk of the City of Pasco, as provided by law; and WHEREAS, notice of the.time and place of hearing thereof and of making objections and protests to said roll was duly published at and for the:time and in the manner provided by law, fixing the time and place of hearing thereon for the 6th day of December, 1960, at.the hour of 8:00 o'clock p.m.., in the Council Chambers in the City Hall at Pasco, Washington, and further notice thereof was duly mailed.by..the City Clerk to each property owner shown on said roll; and WHEREAS, at the time and place fixed and designated in said notices, the hearing.was duly held and no protests in writing were submitted to the City Concil; NOW, THEREFORE, J THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN, as follows: Section 1. That the assessments and assessment roll of Local Improvement District No. 65, which has been created and established for the purpose of improving N. Mead Avenue to the south line of W. Court Street, and W. Brown Street from the east line of N. Illinois Avenue to the west line of N. Oneonta Avenue, by the construction and installation of asphaltic concrete pave- ment 42 feet wide curb to curb, including crushed rock base, concrete gutter and concrete curb where necessary and storm sewer facilities, including catch basins, manholes and all neces- sary appurtenances, and doing all other work as may be necessary in connection therewith, as provided in Ordinance No. 998, as the same now stands, be and the same is hereby in all things and respects approved and confirmed. Section 2. That each of the lots, tracts, parcels of land and other property shown upon the said roll is hereby determined and declared to be specially benefited by said improvements in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments appearing upon said roll. There is hereby levied and assessed against each lot, tract, parcel of land and other property appearing upon said roll the amount finally charged against the same thereon. .Section 3. That the, assessment roll,, as approved and confirmed, shall be filed with'the City Treasurer of the City of Pasco, Washington, for collection and that said City Treasurer is hereby authorized and directed to publish notice as required by law stating that said roll is in her hands for collection and that payment of any assessment thereon or any portion of said assessment can be made at any time within thirty (30) days from - 2 - i the date of the first publication of.said notice without penalty, interest or cost, and that thereafter the sum remaining unpaid may be paid in ten.equal annual installmenta with interest thereon hereby fixed at the rate of 51 o per annum. The first installment of assessments on said assessment roll shall become due -and payable during the 30 -day period succeeding the date one year after the date of first publication by the City Treasurer of notice that the assessment roll is in her hands for collection and annually thereafter each succeeding install- ment shall become due and payable in like manner. If the whole or any portion of•the.assessments remains unpaid after the first 30 -day period, interest upon the whole unpaid sum shall be charged at the-rate.of 5 o per annum and each year thereafter one of said installments, together with interest due on the whole'of the•unpaid balance, shall be collected. Any installment not paid prior to the expiration of the said 30 -day period during which such installment is due andrayable shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest at per annum and for an additional charge of 6%.penalty levied upon both principal and interest due upon.such installment or installments. The collection of such delinquent installments will be enforc'ed.in the manner provided by law.
