AN ORDINANCE PROVIDING FOR A DOG WAR—
DEN, SETTING FORTH HIS DUTIES AND THE
PAYMENT FOR HIS SERVICES.
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby designates John Dietrich
as Dog Warden for the City of Pasco.
SECTION 2.. The Dog Warden shall perform all duties and
functions as provided for the Dog'Warden in the Ordinances of
the City of Pasco.
SECTION 3. The Dog Warden shall furnish, maintain and
operate the Do -g Warden service and the Public Pound, and pro—
vide all necessary personnel for the proper operation thereof.
The Dog Warden shall be responsible for all expenses of every
kind and nature incident to the performance of his duties. Any
complaints made to any City Official concerning the duties of
the Dog Warden shall be forwarded to the Dog Warden who shall
take whatever steps are necessary to correct any justified com—
plaint.
SECTION 4. The City shall pay to the Dog Warden the sum
of $625.00 per month on the last day of each and every month
commencing as of January 31, 1960, in payment for his services.
SECTION 5. All monies due or payable for any function car—
ried on by the Dog Warden shall be paid to the City Treasurer
of the City of Pasco. No money shall be paid to the Dog Warden
under any circumstances for any services performed by him as
Dog Warden.
SECTION 6. In the performance of his duties, the Dog War—
den shall not be an employee of the City of Pasco but an inde—
pendent contractor. The Dog Warden shall indemnify and hold
harmless the City of Pasco from any and all liability whatsoever
from injury to or death of persons, or loss of or damage to
property, caused by or arising out of activities or nonfeasance
in connection with the performa*e 'of his duties whether such
activities be those of the Dog Warden or any of his contrac—
tors or the officers, employees, or agents of the Dog Warden
or of any of their contractors. The Dog Warden will also ap—
pear and defend any action or suit instituted against the City
of Pasco arising in any manner out of his duties as Dog Warden.
The Dog Warden shall maintain insurance in at least the follow—
ing amounts:
Public Liability and Bodily Injury $100,000/$300,000;
Public Liability for Property Damage $50,000;
Automobile Public Liability for Bodily Injury $100,000/$300,000;
Automobile Public Liability for Property Damage $50,000;
for the purposes of providing protection as set forth above.
Any liability insurance carried by the Dog Warden shall be ex—
cess insurance over that carried by the City of Pasco, it being
expressly understood that any liability insurance of the City of
Pasco shall not be construed to be concurrent or contributing
with any other insurance furnished by the Dog Warden. Certifi—
cates of such insurance shall be filed with the City of Pasco
and the City of Pasco shall be given ten days advance notice by
mail of changes in or cancellation of any such insurance.
SECTION 7. There should be no assignment, by operation of
law or otherwise, of the rights, duties and obligations con—
tained herein.
SECTION 8. This Ordinance shall be in full force and effect
five days after its passage and publication as required by law.
PASSED by the City Council and APPROVED by the Mayor this
4th day of October, 1960.
