HomeMy WebLinkAbout1005 OrdinanceORDINANCE NO. % O a �6' AN ORDINANCE RELATING TO CRIMES; DEFINING SHOPLIFTING AS A MISDEMEANOR; PROVIDING FOR ARREST THEREON WITHOUT WARRANT; AND PROVIDING PENALTIES. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: SECTION 1. A person who willfully takes possession of any goods, wares or merchandise of the value of less than seventy-five dollars offered for sale by any wholesale or retail store or other mercantile establishment without the consent of the seller, with the intention of converting such goods, wares or merchandise to his own use without having paid the purchase price thereof, is guilty of the misdemeanor of shoplifting, and of a violation of this ordinance. SECTION 2. A peace officer may, upon a charge being made and without a warrant, arrest any person whom he has reasonable cause to believe has committed or attempted to commit the crime of shoplifting. SECTION 3. Reasonable cause shall be a defense to civil or criminal action brought .for false arrest, false imprisonment, or wrongful detention against a peace officer, by a person suspected of shoplifting. SECTION 4. For the purposes of this act "peace officer" means a duly appointed city, county or state law enforcement officer. SECTION 5. Any_, person found guilty of violating any provision of this ordinance shall be deemed guilty of misdemeanor and shall be fined not more than three hundred dollars ($300. 00) or imprisoned not more than. ninety (90) days, or may be punished by both such fine and imprisonment. SECTION 6. This ordinance shall become effective. after its passage, and publication as provided by law.
