ORDINANCE NO.
AN ORDINANCE VACATING THAT PORTION OF
THE NORTH, AND SOUTH ALLEY, LYING SOUTH
OF AN EXTENSION OF THE SOUTHERLY LINE
OF THE EAST AND WEST ALLEY IN BLOCK 4,
NORTHERN PACIFIC FIRST ADDITION TO PASCO,
ACCORDING TO THE PLAT THEREOF RECORDED
IN VOLUME "B", OF PLATS, PAGE 60, RECORDS
OF FRANKLIN COUNTY, WASHINGTON, SUBJECT
TO AN EASEMENT FOR THE CONSTRUCTION,
REPAIR, AND MAINTENANCE OF PUBLIC UTILITIES
AND SERVICES.
WHEREAS there has heretofore been filed with the City Council of the City
of Pasco by the abutting property owners, a valid petition requesting the
vacation of that portion of the north and south alley, lying south of an extension
of the southerly line of the east and west alley in block 4, Northern Pacific
First Addition to Pasco, according to the plat thereof recorded in Volume "B"
of Plats, page 60, records of Franklin County, Washington, subject to an
easement for the construction, repair and maintenance of public utilities and
services, and
WHEREAS a public hearing was held in the Council Chambers of the City
of Pasco before the City Council on March 17, 1959, and there being no objections
to the vacation of said alley, and it being deemed to the best interests of the City
of Pasco to vacate said alley subject to said easement, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS:
Section 1. That from and after the effective date of this ordinance that portion
of the north and south alley lying south of an extension of the southerly line of the
east and west alley in Block 4, Northern Pacific First Addition to Pasco,
according to the plat thereof recorded in Volume "B" of Plats, page 60, records
of Franklin County, Washington; shall be, and the same hereby is, declared to
be vacated of any further public use whatsoever, subject to an easement for the
construction, repair and maintenance of public utilities and services.
Section 2. That this ordinance shall be in full force and effect after its
passage and publication as required by law..
