CITY OF PASCO, WASHINGTON
ORDINANCE NO. 959
AN ORDINANCE approving and confirming the assess-
ments and assessment roll of Local Improvement
District No. 64, which has.been created and established
for the purpose of improving Brown Street from the east
line of Chase Avenue to the east line of Illinois
Avenue and from the west line of Oneonta'Avenue to'the
west line of Lucas Avenue and certain other'streets and
avenues in the City of Pasco by the construction and
installation of asphaltic concrete pavement, crushed
rock base course, concrete gutter and concrete curb
where necessary, storm sewer facilities including catch
basins, manholes, provisions for temporary disposal of
storm water, with all necessary appurtenances and all
necessary contingent items, as provided by Ordinance No.
928, and levying and assessing the amount thereof
against -the several lots, tracts, parcels of land and
other property shown on said rolls
WHEREAS, the assessment roll levying the special assessments against
properties located in Local Improvement District No. 64 in the City of Pasco,
Washington, created under Ordinance No. 928, has been filed with the City
Clerk of the City of Pasco, as provided by law; and
WHEREAS, notice of the time and place of hearing thereof and of mak-
ing objections and protests to said roll was duly published at and for the
time and in the manner provided by law, fixing the time and place of hearing
thereon for the 17th day of March, 1959, at the hour of 8:00 otclock p.m., in
the Council Chambers in the City Hall at Pasco, Washington, and further notice
thereof was duly mailed by the City Clerk to each property owner shown on said
roll; and
WHEREAS, at the time and place fixed and designated in said notices
the hearing was duly held and all protests made in writing were read and sub -
witted to the City Council, and after giving due consideration to said pro-
tests, all of said protests were by the Council overruled, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN, as
follows:

Section 1. That the assessments and assessment roll of Local
Improvement District No. 64, which has been created and established for the
purpose of improving Brown Street from the east line of Chase Avenue to the
east line of Illinois Avenue and from the west line of Oneonta Avenue to the
west line of Lucas Avenue and certain other streets and avenues in the City
of Pasco by the construction and installation of asphaltic concrete pavement,
crushed,rock base course, concrete gutter and concrete curb where necessary,
storm sewer facilities including catch basins., manholes, provisions for tem-
porary disposal of storm water, with all necessary appurtenances and all
necessary contingent items, as provided in Ordinance No. 928, as the same now
stands, be and the same is hereby in all things and respects approved and .
confirmed.
Section 2. .That each of the lots, tracts, parcels of land and other
property shown upon the said roll is hereby -determined and declared to be
specially benefited by said improvements in at least the amount charged
against the same and the assessment appearing against the same is in propor-
tion to the several assessments appearing upon said roll. There is hereby
levied and assessed against each lot, tract, parcel of land and other property
appearing upon said roll the.amount finally charged against the same thereon.
Section 3. That the assessment roll, as approved and.confirmed,
shall be filed with the City Treasurer of the City of Pasco, Washington, for
collection and that said City Treasurer is hereby authorized and directed to
publish notice as required by law stating that said.roll is in her hands for
collection and that payment of any assessment thereon or any portion of said
assessment can be made at any time within thirty days from the date of the
first publication of said notice without penalty, interest or cost, and that
thereafter the sum remaining unpaid may be paid in 2Gr. equal annual install-
ments with interest thereon hereby fixed at the rate of _A_% per annum. The
first installment of assessments on said assessment roll shall become due and
payable during the thirty -day period succeeding the date one year after the

date of first publication by the City Treasurer of notice that the assessment
roll is in her hands for collection and annually thereafter each succeeding
installment shall become due and payable in,.like manner. If the whole or any
portion of the assessments remains unpaid after the first thirty -day period,
interest upon the whole unpaid sum shall be charged at the rate of _% per
annum and each year thereafter one 61 said installments, together with interest
due on the whole of the unpaid balance, shall be collected. Any installment
not paid prior to the expiration of the said thirty -day period during which
such installment is due and payable shall thereupon become delinquent, All
delinquent installments shall be subject to a charge for interest at __LX per
annum and for an additional charge of 6% penalty levied upon both principal
and interest due upon such installment or installments. The collection of
such delinquent installments will be enforced in the manner provided by law.
PASSED by the City Council of the City of Pasco, Washington, at a
regular meeting thereof and APPROVED by the Mayor of the City this _.7th day of

installment shall become due and payable in,.like manner. If the whole or any
portion of the assessments remains unpaid after the first thirty -day period,
interest upon the whole unpaid sum shall be charged at the rate of _% per
