ORDINANCE NO. 9 58
An ordinance granting to Northern Pacific Railway Company, its successor's
and assigns, a franchise to construct, maintain and operate a railroad spur
track across West Ainsworth Street in the City of Pasco, Franklin County, Wash-
ington.
The City Council of the City of Pasco do( ordain as follows:
Section 1. That a franchise is hereby granted to Northern Pacific Rail-
way Company, a Wisconsin corporation, its successors and assigns, to construct,
maintain and operate a railroad spur track upon_, over and across tidest Ainsworth
Street in the City of Pasco, Franklin County, Washington, the center line of
said track being described as follows:
Beginning at a point in the southerly line of VIest Ainsworth Street
distant approximately 560 feet westerly, measured along said southerly
line, from its intersection with the westerly line of Ship Avenae;
thence northeasterly along a curve to the right to a point in the
northerly line of said West Ainsworth Street distant approximately
155 feet westerly, measured along said northerly line, from its inter-
section with the westerly line of said Ship Avenue.
Section 2. That said spur track shall be constructed and maintained on
a level ;rith the grade of said street as now established or as said grade may
hereafter be changed and that the grantee shall maintain the traveled portion
of said street with suitable paving material between the rails and for one
foot on each side thereof.
Section 3. That the Northern Pacific Railway Company, for itself, its
successors and assigns, shall by the acceptance of the franchise hereby granted
hold the City of Pasco harmless from every liability and damage from the con-
struction, maintenance or operation of said track upon, over and across said
street.
Section 4. That this ordinance shall take effect thirty days from and
after the date of its passage provided the Northern Pacific Railway Company
makes acceptance hereof in writing within thirty days from and after said date.

Dear `Sir:
The Northern Pacific Railway Company hereby
formally petitions the City of Pasco for a franchise to construct,
maintain and operate a spur track across W. Ainsworth Street as
shown on the attached map. As you can see the proposed track is to
serve certain property between W. Ainsworth Street and our right of
way presently in the process of being rezoned for J. A. Terteling
& Sons, Inc.
Three copies of a proposed form of ordinance are
attached for your use.
