AN ORDINANCE AMENDING SECTION 14 OF
ORDINANCE NO. 43 5` AND PASCO CITY CODE
5-8.32, SETTING FORTH THE PROCEDURE TO
AMEND, . SUPPLEMENT, OR MODIFY THE ZONING
ORDINANCES,OFTHE CITY OF PASCO; AND
AMENDING. ORDINANCE. NO..435 BY, ADDING A -
NEW SECTION TO PROVIDE FOR THE ZONING
OF ANNEXED PROPERTY,
THE CITY COUNCIL OF THE CITY, OF PASCO DO ORDAIN AS FOLLOWS;
Section 1. Section 14 of Ordinance No. 435 and Pasco City Code 5-8. 32
are hereby amended to read as follows:
AMENDMENTS.
Section 14.1 (Pasco City Code 5-8. 32)
The City -.Council may,upon proper petition, at.the public hearing and
after receiving' the recommendation of the Planning Commission, change by
ordinance the district boundary lines or zone classifications as shown on the
district maps and may amend, supplement, or modify by ordinance the regulations
herein established.
Section 14. 2 (Pasco City Code 5-8. 32)
The. City Council may, upon its own motion or upon the motion of the
Planning. Commission, .after public hearing and after receiving the recommendation
of the Planning Commis -sign,, change by ordinance the district boundary lines or
zone classifications as shown on the. district maps and may amend, supplement,
or change by ordinance the regulations herein established.
Section 14. 3 (Pasco City Code 5-,8.36)
A petition for change of zone classification or district boundary lines
shall carry the consent of, the owners of not less than 51 per cent (by area) of all
property within a distance of two hundred (200) feet, streets and alleys excluded,
of the proposed district, and having frontage upon any street passing through or
adjoinbd by the proposed district. In calculating such areas the portion of any
property lying at a distance of more than 150 feet froma street upon which its
frontage, for the purpose of this section, is based; shall be excluded and not
considered in -the petition. Any property lying within a district of, equal or less
restrictive character than that petitioned for, shall not be included in calculating
areas on such petition.

Section.2. Section 21 shall be added to Ordinance No. 435 to read
as, follows:
ANNEXATIONS
Section' 21. 1
Whenever a petition for annexation shall be filed with the city or the
city shall receive the certification. from the County Commissioners of an election
favoring annexation, the petition and/or the certificateof election shall be forthwith
turned over to the City Planning Commission who shall thereafter assoon as
practicable hold a public :hearing to determine what zoning classifications should
be imposed upon the property sought to be .annexed. The recommendations of the
Planning Commission and the petition. or certificate of election shall be forthwith
thereafter submitted to the. City Council to the end that said property if annexed
by the City Council may immediately thereafter be zoned in its proper classification.
Section 21. 2
If a petition for annexation is conditioned upon having said property, if
annexed, zoned in the zoning classification. or classifications which it would hold
in the county most closely analogous to the zoning classification of the city, said
petition shall be forthwith turned over to the City Planning Commission who shall,
after a public hearing, determine the city zoning classifications most similar or analog
ous to the county zones under which the said property is then classified. The
City Planning Commission shall forthwith return said petition to the Council
with their written interpretation of the zoning classification or classifications
which should beaffixed to the property as being most closely analogous to the
county zoning then existing and shall at the same time recommend whether said
property should be so zoned.
Section 21. 3
The City Council shall wherever practicable zone all property annexed
to the city concurrently with its annexation.
Section 3. This ordinance shall be effective afters its passage
and publication as required by law.
