HomeMy WebLinkAbout0940 OrdinanceCITY OF PASCO, WASHINGTON ORDINANCE NO. 940 AN ORDINANCE of the City of Pasco, Washington, pro- viding for the construction and installation of certain trunk storm sewers within the City; declaring the esti- mated cost thereof as near as may be; providing for the borrowing of not to exceed $650,000.00 and issuing and selling negotiable general obligation bonds in such amount to pay a part of the cost thereof, said bonds to be payable by annual tax levies to be made without limitation as to rate or amount; declaring an emergency; and providing for the submission of the proposition of the incurring said indebtedness and issuing said bonds to the qualified electors of the City at a special election to be held in conjunction with the State general election to be held therein on November 4, 1958, WHEREAS, the City of Pasco is in urgent need of certain trunk storm sewer facilities to serve certain areas within the City and the City does not have available any funds to meet the estimated cost of construction and installation thereof; and WHEREAS, the assessed valuation of the taxable property in the City as ascertained by the last preceding assessment for City purposes is $12,873,269.00 and the existing indebtedness of the City at the date of the passage of this Ordinance, which indebtedness includes the amount for which the bonds herein authorized are to be issued, is the sum of $908,000.00, $68,000.00 of which is represented by outstanding general obligation.bonds authorized to be issued by the qualified electors of the City at an election heretofore held therein as a part of the indebtedness permitted by the Constitution and the laws of the State of Washington to be incurred for general municipal purposes, within the limit of lk% to 5% of the assessed valuation of the taxable property in the City, NOW, THEREFORE, FOLLOWS: THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS Section 1. The City of Pasco, Washington, for strictly municipal capital purposes, shall construct and install the following trunk storm sewers to serve certain areas within the City, to wit: (1) Trunk No. 1 -- A 72" diameter pipe with the outfall located at the Columbia River along the southerly extension of Railroad Ave., thence northerly along Railroad Ave. to the north line of Washington Street, thence westerly along Washington St. to the west line of the Northern Pacific Railway Co. Right -of -Way, thence northerly along the said Right -of -Way to the intersection of West "B" Street and South Third Ave., thence north along South Third Ave. to West "A" Street; a 54" diameter pipe from South Third Ave. and "A" Street east along "A" Street to South First Ave., thence north along South First Ave. to the alley south of Columbia Street; a 42" diameter pipe in South First Ave. from the alley south of Columbia Street northerly along South First Ave. and North First Ave. to the alley north of Lewis Street; a v 27" diameter pipe along North First Ave. from the alley north of Lewis Street to Yakima Street; a 24" diameter pipe from North First Ave. and Yakima Street to North First Ave. and Margaret Street, a 15" diameter pipe from North First Ave. and Margaret Street to North First Avenue and Court Street together with manholes and appurtenances. (2) Trunk No. 2 -- A 60" diameter pipe from South Third Ave. and West "A" Street to South 5th Ave. and West "A" Street, thence northerly along South 5th Ave. to Columbia Street; a 48" diameter pipe from South 5th Ave. and Columbia Street to North 5th Ave. and Yakima St.; a 42" diameter pipe from North 5th Ave. and Yakima Street to North 5th Ave. and Nixon Street, thence west along Nixon Street to Arthur Street; a 36" diameter pipe from Arthur Street and Nixon Street to Nixon Street and Norbart Street thence north along Norbart Street to Marie Street; a 33" diameter pipe from Norbart Street and Marie Street to Brown Street and Norbart Street; a 30" diameter pipe from Brown Street and Norbart Street to Court Street and Norbart thence north along Poplar to Ruby Street; a 24" diameter pipe from Poplar Street and Ruby Street to Poplar Street and Agate Street; a 18" diameter pipe from Poplar Street and Agate to Poplar Street and Pearl Street; a 15" diameter pipe from Poplar Street and Pearl Street to Poplar Street and Leola Street; a 10" diameter pipe from Poplar Street and Leola Street to Poplar Street and Jan Street together with manholes and appurtenances. (3) Trunk No. 3 -- A 72" diameter pipe from South 13th Ave. and River Street to South 11th Ave. and River Street, thence northerly along South 11th Ave. to Ainsworth Street; a 42" diameter pipe from South 11th Ave. and Ainsworth to South 11th Ave. and West "A" Street, thence east along West "A" Street to South 10th Ave.; a 48" diameter pipe from South 10th Ave. and West "A" Street to South 9th Ave. and West "A" Street; a 42" diameter pipe from South 9th Ave. and West "A" Street to South 9th Ave. and West Columbia Street; a 54" diameter pipe from South 9th Ave. and Columbia Street northerly along South 9th Ave. and North 9th Ave. to West Bonneville Street; thence easterly along West Bonneville Street to North 8th Ave.; thence northerly along North 8th Ave. to Sylvester Street; thence east along Sylvester Street to Francis Street; thence north along Francis to Nixon Street; thence West along Nixon Street to Aurelia Street; a 48" diameter pipe from - 2 - n Nixon and Aurelia_Street to Court -Street and Aurelia Street; a 36" diameter pipe from Court Street and Aurelia Street to Court Street and.Sacajawea Drive;.a 33" diameter pipe from Court Street and Sacajawea-Drive to Court Street and.Foster Street; a 36" diameter pine from Court Street and Foster Street to Court Street and Cole Street; a 27" diameter pipe from Court Street and Cole Street to Court Streei,and.Oneonta Street; a�24" diameter pipe from Court Street and. (6) Trunk No. 6 A 54" diameter pipe from.Road 24'and the Columbia River to Road 24 and Sylvester; a 4811•diameter pipe from Road-24.and Sylvester to Road.24 and Henry Street; a 54" diameter pipe from Road 24 and Henry Street 'to Road 24 and .Court.Street; a •36" diameter. pipe from Road 24 and Court Street to k;*ad.24 and Pearl Street; .a 18" diameter pipe from Road_ 24 and Pearl Street to Road.24 and Empire Way together with manholes and appurtenances. Section 2'. Theestimated cost of constructing and installing the above described trunk storm sewers, including the cost of the issuance of the general obligation bonds herein authorized, is hereby. declared to be,.as near as may be, the sumof$1,170,157.00: The City shall borrow not to exceed $650,000.00 -3 - on' the ' credit of the City and issue and., sell. JU negotiAble general obligation bonds therefor.for,strictly municipal capital.purposes, other than the replace- ment of equipment,;to.-wit, for the -purpose of providing a part of the funds'vith which to pay, the cost of constructing and installing said trunk storm severs. Said indebtedness to be -incurred shall be within the additional.5% of indebtedness permitted by,`the Constitution and the laws of the State -of Washington.for supplying the City with sewers, which sewers will be.owned and controlled by the City.. The balance of -the cost of said construction and installation shall be paid from monies which..the-City may.otherwise have available, for such :purposes and -from assessment's'to be levied against properties specially benefited thereby and included in'one, or more Local improvement District to . be ,hereafter. created. Section -3, -The bonds shall be-. serial in form, shall bear 'interest at a .rare., or rates not to exceed 6% per annum, payable semiannually, and .shall mature in from two to not more than twenty years from date of :issue (the life of the trunk storm sewers to be constructed and installed by said issue of bonds being.at•least-twenty years) in such amounts, as near as practicable, as will, together with interest on the outstanding bonds, be met by equal annual tax levies made without limitation as to rate or amount sufficient in amount to. pay the interest on And. principal of said bonds when- due', and the bonds shall so provide. The designation, date, interest rate•or rates, maturities,_.option.of redemption, form and covenants of said bonds shall be hereafter fixed'`by ordinance, of the City Council of the.City.• The City shall proceed with said improvement in whole or in such parts and at such times and shall issue and sell ' -said bonds -in such series.or amounts as the City,Council shall hereafter determine,', Section 4. The City.Cquncil finds that the .lack.of an adequate trunk storm sewer system in the City has created an emergency, and an emergency 'is hereby declared to exist,, ind..the Franklin County Auditor, as. -ex -officio Supervisor of Elections for all special elections held on the same date as the'. State general election, -is hereby .requested to -concur in• finding the existence of,an emergency and to call Nand conduct 'a special election t,o be held in the City of Pasco on November.+., 1958, in conjunction with the State general election to N,_` to be held'in the City on the same date, for the purpose of submitting to.' the 'qualified electors of tt e, City ' fair. -their ratification or re; jection : the questian..of whether'or note the.. Section 5.
