HomeMy WebLinkAbout0933 Ordinanceri ORDINANCE NO. 933 AN ORDINANCE AMENDING. SECTION 5 OF ORDINANCE NO. 5.73 (PASCO CITY CODE 4'.1. 20, 4-1.24 and 4-1.28), SECTIONS 1, 3 (PASCO CITY CODE 4-1.36), 4. (PASCO CITY CODE 4-1.68), 5 (PASCO CITY CODE 4-1.53), AND 7 (PASCO CITY CODE 4-1.12 AND 4..:.1.64) AND REPEALING 'SECTION 1 OF ORDINANCE' NO. 573, BEING AN ORDINANCE. TO CHANGE EXISTING ORDINANCES TO PROVIDE FOR ENDOWMENT CARE RATHER THAN PERPETUAL CARE OF GRAVES IN CITY VIEW CEMETERY. THE CITY. COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: SECTION 1. 'Section 5 of Ordinance No. 573 arciPasco City Code 4-1. 20, 4-1. 24 and 4.-1. 28 are hereby amended. to read as follows: Cemetery Superintendent - Appointment - Salary - Powers and Duties. The mayor shall, from time to time, appoint a cemetery superintendent who shall hold office during the pleasure of the Mayor and until his successor shall have been appointed and qualified. Such superintendent shall have full supervision, charge and control of the City View Cemetery, and particularly all matters pertaining to the maintaining thereof and to the opening and closing of all graves and setting and placing of all monuments and markers, and to the care of the graves and plots in said cemetery contained, and to the seeding to grass in -all parts of said cemetery entitled to endowment care; and he shall do such other things. in reference to. said cemetery as he shall from time. to time be directed to do by the Mayor or City Council. He may, in his discretion, keep the cemetery closed to vehicular traffic at such times as in his judgment -it- may be -deemed best from the standpoint of the upkeep of the roads and, driveways- therein. The Superintendent. shall have. free use of the. buildings, on said cemetery grounds, and he shall .receive such monthly salary as. shall be fixed by the City Council from time -to time. Neither the superintendent or the City shall be in any way responsible for vases, flowers, or containersleft in the said cemetery by any person whatsoever. SECTION 2. Section 1 of Ordinance No. 6.68 is hereby amended to read as follows: All lands included in and comprising City View Cemetery be and -the same are hereby declared eligible to endowment care. by the City of Pasco. SECTION 3. Section 3 of Ordinance No. 668" Pasco City Code. 4.-1. 36are hereby amended to read as follows: Endowment care required on unsold lots. All unsold lots, blocks or parts thereof in City View Cemetery be and they. are hereby withdrawn from general sale and the same are hereby reserved for sale exclusively to purchasers buying same with provision for the endowment care thereof by the City of Pasco. -1- SECTION 4. Section 4 of Ordinance No. 668 and Pasco City Code 4-1.68 are hereby amended to read as follows: Cemetery Trust Fund Established. There is hereby established a fund to be known as the Cemetery Trust Fund to which funds shall be credited all fioney received from owners for endowment care, all moneys therein to be held forever in trust by the City of Pasco. SECTION 5. Section 5 of Ordinance No. 668 and Pasco City Code 4-1.53 are hereby amended to read as follows: , Endowment care - Charges - Use of Proceeds. The objects, uses, and source of revenue of such funds are: (a) The charge for endowment care shall be $15.00 for each grave placed under endowment care. (b) Any and all such sums shall be paid directly to the City Treasurer by the owner, and upon such payment shall be ac- cepted by the City of cPasco, and held in trust forever for the uses and purposes of said fund; (c) The City of Pasco hereby obligates and binds itself to safely keep the moneys paid to said fund; to in- vest the same so as to bring in the largest amount of income that can safely be realized thereon; and to use the income to realized in caring for, maintaining and beautifying the said lots and graves there- on, in the manner hereinafter specified. SECTION 6. Section 7 of Ordinance No. 668 and Pasco City Code 4-1.12 and 4-1.64 are hereby amended to read as follows: Endowment Care - Record of Lots. The obligation to be assumed by the City of Pasco under the provisions of this ordinance within the funds available are declared to be the following, viz: to irrigate the lots, to seed the lots and keep the graves thereon green and neatly mown; to trim and prune the flowers and shrubbery permitted to grow on said lots under the terms of this ordinance and to fill in and keep the general level of such graves as may sink or cave in; but the City of Pasco shall not be obligated, out of the revenue derived from such fund, or otherwise, to dig any graves or erect any head or foot stones or monuments; nor replace any flowers or shrubbery which shall die or become killed through no fault of such trustee. The City Treasurer shall keep a book which shall be well bound and properly indexed, in which he shall, upon the payment into said Cemetery Trust Fund as hereinabove provided, record the description of such lots, blocks or fractions thereof as are en- titled to endowment care under the provisions of this ordinance. SECTION 7. Section 1 of Ordinance No. 573 is hereby repealed. -2- SECTION 8. This ordinance shall be in full force and effect five days after its passage and publication as required by law.
