AN ORDINANCE ordering the improvement of'Brown Street
from the east line of Chase Avenue to the'east line of
Illinois Avenue and from the west line of Oneonta Avenue
to the west line of Lucas Avenue and certain other streets
and avenues in the City of Pasco by the construction and
installation of asphaltic concrete pavement, crushed rock
base course,.concrete gutter and concrete curb Where
necessary, storm sewer facilities including catch basins,
manholes, provisions for temporary disposal of storm water,
with all necessary appurtenances and all necessary con-
tingent items, in accordance with Resolution.No. 412 of
the City Counci,l of the City of Pa'sco,`Washington;_estab
lishing Local'.Improvement District No. 64; providing the
method of assessment in said District.; providing that pay-
ment for said, improvement be made impart by -special
assessments upon properties in said*District,'payable by
the mode of "payment by bonds"; and providing for the
issuance and sale of local improvement district warrants
redeemable in cash and local improvement district bonds.
WHEREAS, by Resolution No. 412, adopted April 15, 1958, the City
Council of the City of Pasco declared its intention to order the improvement
of certain streets within the City.and fixed the 14th day of May, 1958, at
8:00 o'clock p.m. in the City Hall in the 'City of Pasco, Washington, as the
time and place for*hearing.all matters relating -to said proposed improvement
and all objections thereto and for determining the method of payment for said
improvement; and
WHEREAS, George Fisher, the City Engineer, and Cornell, Howland,
Hayes & Merryville, Consulting Engineers for the City, have caused an estimate
to be made of the costs and expense of the proposed improvement and have
certified said estimate to the City.Council, together with all papers and inform-
ation in their possession touching.the.proposed improvement, a description of
the boundaries of the District, a statement of what portion of the cost and
expense of the improvement should be borne by the property within the proposed
District, a statement in detail of the local improvement assessments outstand-
ing or unpaid against the property in the proposed District and a statement of
the aggregate actual valuation of the -real estate, including 25% of the -actual
valuation of the improvements in the proposed District, according to the valua-
tion last placed upon it for the purpose of general taxation; and

WHEREAS, said estimate is accompanied by a detailed copy of the
preliminary assessment.roll showing thereon•the lots, tracts,'parcels of
land, and other property, together with the plans and assessment maps of the
proposed improvement; and
WHEREAS, due.notice of the hearing upon said Resolution No. 412 was
given in the manner provided by law and said hearing was held by the City
Council on May 14, 1958, and.all written protests filed with the City Council
on or before said date were duly considered and all persons appearing at said
hearing were, heard;° and
WHEREAS, the City Council, after giving due consideration to the
protests as filed and the statements of persons appearing.at said hearing, has
determined it to be, -in the best interests of the City that the improvement of
certain streets.which are -not necessarily connected or continuous with the
over-all improvement be eliminated, and that said improvement as revised and
as hereinafter described be carried out and.that'a local improvement district
be created in connection therewith, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY'OF PASCO, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. The following City streets shall be improved by construc-
tion and installation.of asphaltic concrete pavement, crushed rock base course,
concrete gutter and concrete.curb where necessary, -storm sewer.facil.ities
including catch basins, manholes,.provisions for temporary disposal of storm
water, with all necessary appurtenances and all necessary contingent items, to
wit:
(a) A: 42 -foot wide street on Brown Street from the east line
of Chase Avenue to the east line of Illinois Avenue and from the
west line of Oneonta Avenue to the west line of Lucas Avenue; on
Marie Street from -the east line of Chase Avenue to the west line
of Lucas Avenue; on Octave Street from the east line of Chase
Avenue to the east line of Mead Avenue; on Henry Street from the
west line of Meridian Avenue to the east line of Illinois Avenue;
on Margaret Street from the east line of Meridian Avenue to the
east line of Illinois Avenue; on Meridian Avenue from Marie Street
to the south line of Court Street; on Illinois Avenue from the
north line of Sylvester Street to a line midway between Brown
Street and Cartmell Street; on Mead Avenue from Octave Street to
Marie Street; on Oneonta Avenue from Marie Street to Brown Street.

(b) A 47 -foot wide street on Meridian Avenue from Henry
Street to Marie Street.
Section 2. There is hereby created and established a local improve-
ment district to be called "Local Improvement District No. 64," the boundaries
of such local improvement district being described..as-follows:'
Beginning at a point on the centerline of Sylvester Street
more particularly described as.the intersection of the center-
line of Sylvester Street, and the -southerly extension of a line.
lying midway between the west line of Illinois Avenue and the
east line of Meridian Avenue, thence northerly along said line
midway between the west line of Illinois Avenue and the east
line of Meridian'Avenue to the centerline of the alley in Block
7, Stadium Park Addition, thence westerly along the centerline
of said alley in Block 7 and the extension thereof to the
centerline of Meridian Avenue; thence northerly along the
centerline of Meridian Avenue".to the centerline of Henry Street;
thence westerly along the centerline of Henry Street to a'point
midway between the_west line -.of Meridian Avenue and the eastline
of Chase Avenue; thence northerly along a line midway between
the west line of'Meridian Avenue and the east line of Chase
Avenue to the easement centerline of Block 2, Carter's Addition;*
thence westerly along said easement centerline in said Block 2
to the westerly boundary of Section 30, T 9 N, R 30 E, W. M.,
otherwise known as the center line -of Chase Avenue; thence
northerly along the said westerly boundary of Section 30 to a
point midway between the north line of Brown Street and the
.south line.of:Cartmell Street; thence easterly along a line mid-
way between the north line.of Brown Street and the south line of
Cartmell Street to.a point midway between.the west line of
Meridian Avenue and the east line of Chase Avenue; thence
northerly along a line midway between the west line of Meridian
Avenue and the east line of Chase Avenue to the northerly bound-
ary of Section 30, T 9 N, R 30 E., W..M., otherwise known as the
centerline of Court Street; thence easterly*along.the northerly
boundary of Section 30 to a point midway between the east line of
Meridian Avenue and the west line of Illinois Avenue; thence
southerly along a line midway between the east line of Meridian
Avenue and the west line of Illinois Avenue to the centerline of
the easement in Block 2, -Stadium Park Addition; thence easterly
along the centerline of the easement through Block 2 -and Block 15,
Stadium Park Addition to a point midway between the east line of
Illinois Avenue and the west line of Mead Avenue; thence southerly
along.a line midway between the east line of Illinois Avenue and
the west line`of Mead Avenue to a point on the centerline of the
easement in Block 14, Stadium Park Addition; thence easterly
along the centerline of the easement in said Block 14 and the
extension thereof to the centerline of Mead Avenue; thence
northerly along the centerline of Mead Avenue to a point opposite
the north line of Lot 16, Block 18, Pasco Improvement Co.'s 1st
Addition; thence easterly along the nortn line of Lot 16, Block
18, Pasco Improvement Co."s 1st Addition, extended, to the center
line of the alley in said Block 18; thence northerly along the
center line of the alley in -said Block 18 to the centerline of
Brown Street; thence easterly along the centerline of Brown
Street to the centerline of Oneonta Avenue; thence nortnerly along
the centerline of Oneonta Avenue. to a point midway between the.
north line of Brown Street and the south line of Court Street;
thence easterly along a line midway between the north,line of
Brown Street and the south line of Court Street to the
easterly boundaryof the NW 4, Section 30, T 9 N, R 30 E,.
W. M., otherwise known as the centerline of Lucas Avenue;
thence southerly along the said easterly boundary of the
NW Li,Section*30,'to a point opposite the south line of
'Lot 17; Block l6, Pasco Improvement Co.'s 1st Addition;
thence westerly along.the south 'line of Lots 17 and .18,
Block 16, extended, and the south line of Lot 17, Block 15,
extended, all in Pasco Improvement Co.'s-lst Addition to the
centerline of the alley in said Block 15; thence southerly
.along the centerline of the alley in said Block 15 to a point
opposite the south line of Octave Street; thence.westerly
along the south line of Octave Street, extended, to the
centerline of Mead Avenue; thence southerly along the center-
line of Mead Avenue to a point.midway between the south line
of Octave Street and the north line of'Sylvester Street;
thence westerly along a line midway between the south line of
Octave Street and .the -north line of. Sylvester Street to a
point midway between .the east line. -of Illinois Avenue and the
west line of Mead Avenue; thence southerly along a line midway
between the east line of Illinois Avenue and the west line of
Mead, Avenue to the centerline of Sylvester Street; thence
westerly along said centerline of Sylvester Street to the
point of beginning.
Section 3. The estimated cost and expense of said improvement is
hereby declared to be $141,160.00, and the entire cost and expense of said
improvement,including the cost and expense of all engineering, legi,inspection,
advertising, publication of notices, and other -expenses incidental thereto,
except for an amount equal to 20% -of the improvement cost up to a maximum sum
of $20,000.00, which shall be contributed by the City, shall be levied and
assessed against all the property legally and properly assessable therefor as
provided by the laws of the State of Washington and the ordinances of the City
of,Pasco.
Section 4. The nature of the improvement provided for herein is such
that the special benefits conferred upon the property in the Local Improvement
District herein created are not fairly. reflectedby the use of the zone and
termini method of assessment therefor,_ and it is hereby provided and ordered that
the assessments shall be made -,against the property of the District in accordance
with- the special benefits it will derive from the improvement without regard to
the zone and termini method provided by statute.
Section 5. Local improvement district.warrants,shall be issued in pay-
ment'of the cost and expense of the improvement herein ..ordered, such warrants

to be payable out of the "Local Improvement Fund, District No. 64," hereafter
created, to bear interest from the date thereof at a rate to be hereafter fixed
by ordinance not to exceed 6% per annum and to be redeemed in cash, and/or by
local improvement dis trict,bonds herein authorized to be issued. Such bonds
shall bear interest at a rate to be hereafter fixed by ordinance not exceeding
6% per annum, shall be.payable on or before twenty-two years from the -date of
issuance, .the life of the improvement ordered being not less than twenty-two
year -s, and.shall be issued in exchange for and in redemption of any and.all
warrants issued hereunder and not redeemed in cash within a period not -to exceed
-60 days after the first -publication by the City Treasurer of notice that the
assessment roll for "Local Improvement District No. 64" is in his hands for
collection. The bonds shall be redeemed by the collection of special assessments
to be levied and assessed upon the property within said District, payable iR.`.twenty'
equal annual installments, with interest at a rate to -be hereafter fixed by ordi-
nance -not exceeding 6% per annum, under the mode of "payment by bonds" as defined
by law and the ordinances of the City of Pasco. In the case of default in the
payment of any assessment when the same shall become -du -e, there shall be added
interest at.a rate to be hereafter fixed by ordinance not to exceed 6% per annum
and a penalty of 6% which shall also be collected. The exact amount, form, date,
interest rate, and denominations of said warrants and bonds shall be hereafter
fixed by ordinance of the City Council. Said warrants and bonds shall be sold
in such manner as the City Council shall hereafter determine.
Section 6. All the work necessary to be done in connection with the
making of said improvement shall be done by and made by contract upon competi-
tive.bids and the City shall have and reserves the right .to reject any and all
bids.' The call for bids for work authorized.pursuant to this Ordinance shall
include a statement that payment for said work will be made in cash warrants
drawn upon the "Construction Fund" of Local Improvement District No. 64 of the
City of Pasco, Washington.
Section 7. There are hereby created and established in the office of
the City Treasurer of the City of Pasco, for Local Improvement District No. 64,
the following funds, to wit:

(a) "Local Improvement Fund, District No. 64," into which
fund shall be deposited all payments made upon assessments in
said, District -for the redemption of the warrants and bonds
herein authorized; and
(b) . "Construction Fund," into which fund shall be deposited
the principal amount plus.accrued interest received_ from the
sale of local improvement district warrants of the District
herein authorized,.and against which fund warrants shall be
issued to the contractor or contractors in payment of the work
to be done by them in connection with said improvement and
against which fund warrants shall be issued in payment of all
other items of .expense in connection with said improvement.
PASSED by the -City Council and APPROVED by-the-Mayor.of thefCity of
Pasco, Washington,at a regular.meeting thereof, this 3rd day of June, 1958.
