HomeMy WebLinkAbout0886 OrdinanceORDINANCE NO. 886 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 672, AND PASCO CITY CODE 5"5.04, 5-5.08, 5-5.12 AND 5-5. 16 AS THEY NOW EXIST; AND BEING -AN ORDINANCE PERTAINING TO USES PERMITTED.. HEIGHT LIMITA- TIONS, .AND YARD REQUIREMENTS IN A C=1, COMMERCIAL DISTRICT; AND REPEALING ALL ORDINANCES OR PARTS -OF ORDINANCES IN CONFLICT HER:EWI;TH. THE CITY COUNCIL OF THE CITY OF PASCO, DO ORDAIN AS FOLLOWS:, Section 1. That Section 1 of Ordinance No. 672 and Pasco City Code 5-5.04, 5-5.08, 5-5.12 and 5-5. 16, shall be amended to -read as follows:. Section 1(a)' (Pasco City Code, 5-5. 04) Perirnitted Uses., In the C-1, Commercial District, no` building or premises shall be used and no building shall be hereafter erected or structurally altered, unless otherwise provided except for one or more of the following uses-.. 1. Any use permitted in Class R-1," ..and R-:2,Residential Districts. 2. Retail stores and shops limited, to. us'e.s needed to serve a residential district, such as grocery store, meat shop, retail' bakery, drug store, confectionery store, personal service stores „or parlors, moving picture, theatres and uses similar to the above. ' 3. Public garages, service stations, and recreational enterprises are ,allowed, and all whole.sale and retail mercantile establishments; and manufacturing establishments employing :not more than ten' persons shall be permitted. 4. Auto wrecking yards. or yards used for the ,storage of used, cars shall not'be permitted`except upon permit obtained from the Commission, which such permits shall not be issued for periods exceeding three years, but may be renewed upon new application. 5. .Laundries and cleaning establishments in operation at the time of effect of this chapter shall be permitted. 6. Lumber yards, coal and fuel yards, shall not be permitted. 7. The storage'of.gasoline and oils for resale at wholesale is pro- hibited, but their storage in quantities sufficient_ only for sale.at re- tail in connection with any service station or garage. is permitted. 8. Machine shops and warehouses shall not be permitted except upon permit obtained from the' Commission, which may be issued after a hearing upon.,application therefor, and an examination of the premise.s by'the Commission and its determination that such machine shop or warehouse will not be unduly detrimefrital to adjoining enterprises by the emission of dust, noise or vibration. 9. The Commission may permit. the location. in Commercial District C-1 of any enterprise commonly carried on in the business sections of towns of similar size where'the Commission determines that such enterprise in such Commercial Section would not be for any reason detrimental to the best in- terests of the City of Pasco and the inhabitants thereof. Section l(b) (+Pasco City Code 5-5. 08) Gas Stations & Garages - Limitations. No building shall be erected or structurally altered to provide for service stations or public garages .on Lewis Street between the center line of r ` Third Street and the center• line of Fifth Street; nor. on Fourth. Avenue between the center line of Shoshone Street and the, center line of .Columbia Street. Pro- vided that the City Council may vary .this r'eq'uirement to allow minor structural alterations -upon a showing of proof that structural alteration is necessary to insure the public safety. a showing of economic .advantage to the owner, Lessee or operator,.shall not.be sufficient reason for such a variance. And provided further that all service stations and garages located in a commercial district, C-1, must be, equipped with sanitary lavatory and toilet facilities for both men and worrien, separate and apart from :each other, and such facilities shall be an integral part of the main building and not separate or detached therefrom. Section 1(c) (Pasco City Code 5-5.12) Height Limitations. Whenever any C-1, Commercial District, is. located within. oris adjacent to, on two or more 'sides, any R-1, Residential District', the buildings.in such G-1, Commercial District, shall be. limited to one story in height, provided, however, that the Commission may allow a building to be. erected. to such additional height as will not exceed five. additional stories, by.special permit -and after examination of the location, on due proof to the satisfaction of the .Commis.sion that such additional height will not be unduly detrimental to adjacent and surrounding property. Section 1(d) (Pasco City Code 5-5. 16)',Front, Side and Rear Yards. Front and rear yards shall be substantially in conformance with the district within Arhose4boundaries the C-1, Commercial District, is located. No side yard is required except for corner lots whose.side line adjoins a residential district, in -which case the side yards indicated for the surrounding, residential districts shall be required; except that the Commission may by special permit, and after examination of the -location, on due, proof to the satisfaction of the Commission that such lack of side,- front or rear yard willnot be unduly detrimental to the adjacent and surrounding property, such 'side, front or rear yard may be limited or ex- panded :as in the judgment of the,Commission the circumstances warrant. Section 2. , Effective Date.. This Ordinance shall .be in full force and effect five days after its passage and publication as required by law. PASSED by. the City Council this. day of 1956.
