ORDINANCE NO, 868 r: GAS ORDINANCE AN ORDINANCE PROVIDING FOR THE LICENSING OF GAS FITTERS INSTALLING OR REPAIRING GAS PIPING.OR GAS APPLIANCES; THE_' 'ISSUANCE r OF PERMITS FOR THE INSTALLATION OR REPAIR OF GAS PIPING OR GAS APPLIANCES AND FOR THE INSTALLATION, CONSTRUCTION, OPERATION, AND MAINTENANCE OF A GAS TRANSMISSION AND/OR DISTRIBUTION SYSTEM WITHIN THE CITY, AND . PROVIDING FOR THE INSPECTION OF SAME AND THE COLLECTION OF INSPECTION FEES THEREFOR; PRESCRIBING RULES, REGULATIONS, AND STAN- DARDS RELATING TO THE SALE, INSTALLATION, MAINTENANCES AND REPAIR OF GAS PIPING AND GAS APPLIANCES CONVEYING NATURAL OR ANY TYPE OF GAS ONTO CONSUMERS' PROPERTY EX- TENDING FROM THE POINT OF DELIVERY TO THE POINT OF CONSUMPTION, AND RELATING TO INS STA LLATIONs CONSTRUCTION, OPERATION, AND MAINTENANCE OF A GAS TRANSMISSION AND/OR DISTRIBUTION SYSTEM WITHIN THE CITY; PROS VIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE, AND REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLIC^i THEREWITH. THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: SECTION 1, PURPOSE. The purpose of thus Ordinalce is to provide minimum standards, provisions' and requirements for safe instal* lation of gas pipes and gas appliances on consumerst property, and to regulate the sale, maintenance, and repair of such ap- pliances, and to provide minimum standamds;. requirements, and rules and'regulations governing the installation, construction, operations -maintenance, and safety for existing and newly con- structed gas transmission and/or distribution systems within the city. I SECTION 2, SCOPE, All gas appliances or gas pipes hereafter sold, installed maintained, or repaired within the corporate limits of the city and all gas transmibsion and/or distribution systems hereafter constructed, installed, operated, and main- twined within the city shall conform to the requirements of this ordinance. All gas appliances or gas pipes heretofore sold or installed or existing gas transmission and/or distribution sys- tems shall conform to the requirements of this ordinance. SECTION 3. DEFINITIONS. The following ,definitions are pro- vided for the sole purpose of proper.interpretation and ad- ministration of this ordinance: (1) Approved shall mean accepted by reason of the satisfactory results of thorough investigations and tests conducted by the.Inspector, or by the reason of accepted principles, or tests by recognized authorities, technical or scientific organizations. (2) Certificate of Approval shall mean a document issued and attached to the material, piping, or appliance in" spected, completely filled out, together with date, address of the premises or consumer, and signed by the Inspector, (3), City Engineer shall mean the city engineer or his duly authorized representative. J (4). Consumer .shall mean any person, persons, customer, firm, association, municipal corporation, and/or corpora - ..tion -that -uses uses gas,- including residential, commercial, and industrial users`. (5) Construction or Construct shall mean constructing, laying, maintaining,.testing,.operating,.extending,-re" newing., .removing, replacings.repairing, and using a gas distribution system. (6)� Distribution System, System;,and/or Lines used either. In, thesingular .or.- plural .,sha11 mean and include the gas . pipes, pipe, .linesy�mains, laterals, conduits, feeders,.regu- lators';_ meters, fixtures, connections$ and all attachments, appurtenances,•and.appliances necessary and incidental there- to or in any way'appertaining to the distribution and use of gas. (7) :Gas shall mean natural, artificial, and/or mixed gas. (8) Gas Applian ce shall mean any appliance or device used for burning gas. (9) Gas Comps :shall - mean En y person, firm, or corpor ation o d nig and exercising a franchise or permit to ,distribute gas within the corporate limits of the city. (10) Gas Company Service Lin© shall mean the -gas piping leading from the gaa'main to the.property line,'or to,the point of delivery. (11) Gas.Fitter shall mean any person who does any gas fitting work.. Calls, repairs, or -remodels any piping or appliance which would .be subject to supervision and inspection under the ,provisions of this ordinanceo (12) Inspector shall mean'the administrative authority so designatedby this ordinalee or his duly authorized rep- resentative. (13.) Maintenance, Maintaining,. and/or Maintained shall meat and incl ude therelaying, repairing,, replacing,. ex- amining, testing, inspecting, removing; digging,:excavat- ing, and r-estoring-operations incidental thereto,'- (14Y hereto'-(14) Person shall mean any.person, firm, association, or corporation. (15) Point of Delivery shall mean the junction of the. utility's.meter with the consumer's piping. (16) Premises shall mean the property,•including struc- tures, of the.consumer:.. (17) Pu-)lic Properties shall mean and include streets, alleys, sidewalks, curbs,- roads, highways, avenues, thorough- fares, parkways, bridges, viaducts, public grounds, pub- lic improvements, and other public places within the present And/or future corporate limits of the city„ (18) Roadway' --shall mean the paved, improved, or proper. -driving portion of a public rightwof-way designed, or ordin- arily use3, for vehicular travel. (11;9) Transmission System shall mean a pipe line installed for the purpose of transmitting gas from a source or sources of supply to one'or more distribution centers or to one or more large volume customers. /I (20) Unit shall Mean the construction of not over one Mile of disetriMon or transmission system or as determined by, thee City Engineer by excavation of public proPertles3. (21) Used Gas ARRliance shall. mean a gas appliance which has been previously sold$ installed# and used,. (22) Vent shall wean a pipe, flues or chimney designod and/or instai'leto carry the products of combustion from ern appliance to the outside atmosphere, SECTION 4, BOARD OF EXAMINUS. A Board of Examiners is hereby created for the purpose R examen ng applicants for a Gas Fitter's license and shall consist of the Building Inspector, who shall be -the Clerk# Chief of the Fire Ddpartments and three (3) members to be appointed by the. Mayor and confirmed by the City Council* One of the appointees shall be a representative of the distributing gas company and two (2 ) competent persons* These three appointed members shall serve for three years, except for the first terra# when one -shall be . appointed for three years, one for two years and one for one year, SECTION ba BOARD OF APPF,ALS. In order to determine the suitability of alternate materials and types of construction# and provide for reason- able interpretation of the provisions of this Ordinanco and to'hear appeals from an order of the Inspectors there shall bei and Is hereby created# a :Board of Appeals which shall consist of the members of the Board of EXamineerse The Building Inspector shall be an ex -officio members but not a voting member, and shall act as Secretary of the Board. The Board shall adopt reasonable reales and regulations for conducting its investigations and sbal;l render all decisions and find- ings in writing to the Building Inspectors with a duplicate copy to the appellant; and may recommend to the City Council such legislation as is consistent theerowitbo The Board of Appeals shall meet upon the call of the Inspectors SECTION B© LICENSE REQUIRID - OAS INSTALLATION LICENSE. No person shall engage In or work at the bualnNas o nstall ng# extending# alter- ing or repairing any gas appliance or pipings vent or flue connection pertaining to or in connection with gas installation within the City of Pasco# either as employer or individual, unless such person has received a "(bass Installation!' license therefor in accordance with the provisions of this Ordinance* LIMITATIONS OF GAS FITTER'S LICENSE.- Persons under they terms of this Ordinance Who are required to have a "Gas Fitter's" license are also required to have a "Gam Installation" licenses unless they are employees of an employer who Eas as 1137as nstalleation" license as provided in this Ordinance. SECTION 8a LICENSE APPLICATION. Applicants for license required in this Ordinance shall make application to the Clerk of the Board of Examiners* SECTION 9m la CENSE FEFS. The annual fee for the "(has Ins3tallatios"" license shall be Fifty for the first year, sand Twelve Dollars and Fifty ($12.50) Cents per year thoreeagter. The license shall be reneged on or before January 1st of each year. The annual fee for a "Gas Fitter's" license shall be Five ($5.00) Dollars for* -the first year,and Two ($8.00) Dollars per year thereafter, provided license shall be re- newed on or before January lst of each year. finless revoked or suspended, licenses shall continue in Force from January 1st of one year to January 1st of the succeeding year, and shall not be traansferab.le o (1) License -not Required, The requirements contained herein ihall not be construed to limit the right of the gas utility and its authorized employees to render necessary service in event of an emergency. SECTION 10m rXAf.91XA.T10N1 S, FE AND--LIGMSES. The Board of .Examiners shall meet -and orgsn.ize by electing a chairman and shall designate the time and place for examination of all applicants provided for herein. A majority of the members of the Board shall constitute a quorum and shall be competent to transact any business. The Clerk of the 'Board shall keep minutes* The Board shall examine said applicants as to their practical and theoretical knowledge of gas fittings appliance installation and adjustments shall submit the applicant to some satis- factory form of practical gest and if satisfied of the competency of the applicant., shall so certify to the City Council which shall authorize the City Clerk to issue a license to such applicant® author - Ing him to work at the business of installing gas appliances or gas pipings or gas fitting* as they case may be * at which time he shall also cause the applicant to register in the office of the Building Inspector* bice names place of business* residences license numbers date of examination and to what capacity licensed. In the cane of a firm or corporation applying fora "Gas Installation" licenses the examination of one member of the firms or an executives of the cor- poration shall fulfill the requirements of this section. The fee for examination shall be Fives ($5.00) doll,ars4. SECTION Ile (SAS IMSTALLER e S . BOND. Before any permit is issued to a Gas Installer there shall be _Med with the City Clerk a bond to be effective during the period for which the license is issued, plus one year from the date of they expiration of the licenses in the sum of Five Thousand ($5*000.00) Dollars* executed by the applicant and a surety company authorized to do business in the State of Washington as suratys running to the City of Pasco* conditioned that the Aran Installer and his agents and servants shall fully comply with all provisions of law and'City Ordinances relating to gas installa?`tionreand that any person injured by failure of the principal -to comply with such laws :and ordinances_ or with any -of the provisions thereof shall have a right of action against the principal and surety* in his own name; provided that any person wishing to avail himself of they benefits of the band commence action thereon within one year after the date of completion of the work alleged to have been improperly done. The bond shall be further conditioned to protect the city specifically against any loss* damages or expense it may sustain by reason of any m rk. ..4 ' SECTION 12. In the event the inspector shall suspend or revoke said License, he shall cavae to be served upon tbo licensee a formal order of suspension or revocation of said. license which order shall recite the reasons therefor. An appeal from any order of the Inspector -suspending or revoking, a licen6es granted hereunder -may be taken to the City Council of the City of Pasco, witbi'n five days after service upon the licensee of the order of suspensions or revocation. The suspension or r evocaar tion ofa license shall give the licensees no right to .a ref=d From any unearned portion of the fee paid. Any order providad for in this ordinance shall be served either (1) by delivering a copy personally.upon they licensees or (2) by leaving 4 copy with some person of suitable ageand discretion at the place of business of t'he 'liceanseep or if no person may be found at the place of businesses of the licensee# by leaving suchorder in a conspicuous place on the promises and mailing a copy of the order to -the licensees at his place of business as set forth in hie application for a license* SECTION 150 RESPoNSIDILITY OF LICEMEE. This Ordinance shall not be construed as realiesving such persons owning,, opeorating# installing, or ,inspecting any gas pipings, aapplia3nceso or other gas apparatus from liability to anyone Injured by any defect thesrein. Nor shall the city or any agent thereof be considered to have . aa►aasumdd ani. such liability by reason of the inspection authorized ber. ounder.. or by reason of the issuance of a certificate of inspection by the Inspector. SECTION 16, Eff ORCEMENT AND FNM POn INSPECTION.. When a permit is issued to connect an appliance to an existing sub or outlet, no -additional fee will be charged for piping inspection. Where new piping is required to'.3upply the appliance, the above fees for house piping inspection will be collected. SECTION aB. RECORDS. The 'Inspector shall keep a record of all gas installations inspected. He shall also keep 'a record of all licenses and permits issued under. this ordinance. SECTION :;1,9a PIPING DIAGRAM, Jobs requiring in excess of 60 feet of pipe shall be accompanied by sketch or plan drawn up under the following specifications* (1) Vertical piping should be shown parallel to the short side of the sheet. (2) Piping through the length of.the building should be shown parallel to the long side of the sheet. - (3) Piping across the width'of the building should be shown diagonally on the sheet., (4) The length and' size of each section of piping should be shown, .(A'seetion designates the length of piping existing between outlets, fittings and points of change in piping sizes.) (5) On horizontal piping, the length under the lines-, and the size over the lines,,should be marked. (6) On vertical piping, including drops, the length to the right. of the line, and the size to the left of the line, should be marked. (7) Each outlet X should be marked, and in the,case of a plugged outlet, its size should be indicated. SECTION 20. PIPING DIMENSIONS. (1) All gas outlets shall extend through the floor or base board not less than two and one-half (2 1/2.) inches. �2) All outlets shall not be less than one-half (1/2) inch pipe. (3) Greatest length allowed for house piping shall be as follows: 121° 20 feet 3/4" 60 feet 1P4 - 80 feet 1-1/4" - 100 feet- 1-1�2� 150 feet 2" «» 200 feet (4) The size of house piping not otherwise provided for in this section shall.be approved by the Inspector, (5) Where gas meters are installed above ground at the house, each consumer's service line'shall be provided by the gas company with a suitable stop cock located in an ac- cessible place and .at the inlet of the meter, (6) Where an underground meter is used, each consumer's house line shall be provided with a suitable stop cock (sill cock) at a point above ground where the gas line enters the building. No gas meter sball be hereafter installed under a stopp$ stairways, show windows or parols or in any univentilated or . confined space* and shall be a safe distance from a furnaces, boilers or other heating appliance* No . meter shall be placed in any Location where it will be inaccessible or exposed to injury, such as drive+wayes nor where it wS.11 be subjected to excessive corrosion, 3ECTIOV 22PIPING INSPECTIO .* (1) ns a or to e.Not fied for Ins action- When any work don® i un ear a perrmlE TMO by Me tripe ctor is completed and ready for Inspection# the person to whom the permit has been issued shall, within twenty-four hours after completion of said works notify the Inspector in writing that the same has been com- plated and is ready for inspection$ and the Inspector shall cause said work to be inspected within a reasonable time thereafter. (2) Tast or Pi.nal Pi in Ins ection. Teat or final piping in- tpect on shall be made by the Inspeotor after all piping suthoriged by the permit has been installed and before any por- tions thereof which are to be concealed by plastering or other - wises have been so concealed, and before any fixtures or gas ,appliances have . be,en attached thereto. This inspection shall include a pressure tests at which time the piping shall stand an air pressure equal to not less than the pressure of a column .of mercury slat (6) inches in height, and the piping shall hold this air pressure for a period of at least ton (10) minutes without any perceptible drop in pressure® A D -Gauge types mercury column shall be used for the test. (3) Toolas A aratus and Labor for Test. A new permit for a one 1.0© Dollar fee and a newIn- spection Certificate shall be required for a consumer's promises wbieh already have been piped for gaass but in which no gas has been used for a period of twelve '(12 ) consecutive months or more. SECTION 23® CERTIFICATE OF APP�a�. The Inspector shall issue a Certificate of Approval at the completion of the stork for which a specific permit has been issuod, ifs after Inspection, it is found that such work has complied with the provisions of this ordinance and all other requirements of lair or ordinance applicable thereto. A duplicate of each Certificate of Approval shall be delivered to the gas company and used as its authority ..7.. to grant gas service. SECTION 24. DEFECTIVE WORK OR kATERIALS.'-If the inspection shall show that defective inaterials have been used or'•defective, work- manship has-been performed inthe installation, alteration, repair, or extension of any' gas..pipe, fixture, or appliance.in,.or on, any consumerfs'premises., such defective materials or work shall be replaced by the permit hold©r within t}3ree days, and the inspec- tion repeated, SECTION 25. DANGEROUS•OR DEFECTIVE 'PIPING OR APPLIANCE, DIS-, CONNECTION OF TY ORDER OF INSPECTOR. (1) The Inspector may 'cause ,t'o '.be di s conn cted any gas piping, fixture, or appliance, whichhas been connec.ted.; b©-' fore. a Certificate: of Approval has been issued, or which, -upon 'inspection' shall be found' defective for -in `such con-,- dition as to endanger life -or property, In all cases in which such a disconnection is .made, a- notice shall be af- fixed thereto and shall" state that -the esame. has been disc connected by the Inspector, together'with the reason or - reasons therefor,, and it shall -.,b® unlawful for any person to remove'said notice or to reconnect said,gas.piping.. fixture, or appliance until authorized"by'the Inspector to do* so. (2) The Inspector shall have the duty, responsibility, and right of access to inspect all gas appliances in public., buildings, commercial buildings, and industrial plants in connection with.the enforcement of fire regulations SECTION 26, DISCONTINUANCE OR REFUSAL OF SERVICE. (1)• The gas company may discontinue or refuse to supply gas for any gas piping, fixture, or gas appliance wh ich it may find to be defective or leaking, or in such condition as to -endanger life or property; Provided, however, That the gas company shall.imniediately give written notice of discontinuance or -refusal of serv.ice'to the Inspector and the occupant 'of the consumer's building or premises•where such gas supply is discontinued•or refused. The.Inspector shall immediately make an investigation of the conditions reported by the gas company, and. it shall be unlawful for any person to reconnect any.gas piping .fixture, or appliance, -until authorized -by -the Inspector. (2) In all cases in which the supplying Of - gas has been dis:cont.inued•for safety reasons, the supplying of gas shall not be resumed until authorized by the . Inspe ctor Provided, however, That -if the gas Pias been turned off by a Gas Fitter' or an employee of. the gas company. while doing -Work on the premises, such Gas Fitter or employee is entitled to turn. on the ga.s •again when he has finished the work.,, without authorization from the Inspectors SECT IONS27, REQUIREMENTS OF NEW OR USED GAS APPLIANCES AND ACCESSORIES. (1) All gas appliances and accessories installed for domes- tic or commercial use shall comply with, and be of a design and construction.of, applicable American Standard Approval, Listing, and -Installation Requirements for gas appliances and accessories covering safe operation, substantial and dur- able construction9 acceptable performance., and installa tion of the American Gas Association, Inca, and adopted. by the American :Stan dards Association, Inc., and as hereafter amended; Provided, however, That industrial an.d other special- ized'appliances and equipment not included in the above re- auirements of the American Gas Association, Inc., and adopted.by the American Standards Association' Inc.., may be .L i. sold and installed upon approval by the Inspector. Each appliance approved by the American Gas Association, Inc;$ shall be -so marked or labeled with a distinctive trade" mark or name asa means of identification and shall bear information..showing the rated heat input in Btu. per hour. Eaeh new gas appliance approved by the American Gas.Asso ciation, Inc.,•shall be considered an approved appliance -and shall.also*be so marked and labeled, All new hot water heaters and heating appliances shall also be equipped with an American .Gas Association approved complete -shutoff type automatic pilot.. (2) All used gas appliances hereafter sold,or offered for sale to be installed, or installed, in the City of� Pasco., on a gas system, shall have a certificate filed with the Building Inspector -by a bonded.installer showing that appli- ante is suitable,; safe -and -efficient, (3) No furnaees boiler or 'other appliance' originally de- -signed for the • burning of a fuel other than gas shall be converted to gas urile ss' a certificate- has first been filed by a bonded installer with the Building. SECTION '29.. DEVICES FOR REDUCING GAS CONSUMPTION, REGULATION OF. No person shall, without the approval of the Inspector, display', sell barter, replaces offer for sale, lease,.deal.in,.supply, rent, donate, connect, install, or use within the corporate limits of the city any device purporting to reduce gas consumption when such device is inten ded'as an adjunct, or addition to, a gas ap- pliance, or to be suspended'ab.ove, or vuh olly or partially to en- closes any burner of a gas appliance in such manner as to reduce the effectiveness of-ignioion of the gas issuing from the burner or impair combusion.of said burner. SECT2ON `3pb CONDITION OF VENTS, PIPING,'AND APPLIANCES, (l.) All domestic appliances must,be vented to the extent required by this ordinances No person shall install or use any gas fired hot water or room heater without a vent, ex- cept for laboratory apparatus.. (Ref. 5.1.19d and 5.1.2,d NBFU'No. 54 ) (2) All gas piping, vents, vent connections, and appliances shall be maintained.in'good condition; Provided, however, That no gas piping, vent, vent connections fixture, or appliance not conforming to the requirements of this ordin- ance shall be used or.maintained, except in case they were -installed prior -to-the effective date 'of this °ordinance and shall have been approved'by the Inspector.; (3 ) No gas fired : equipment shall .be installe d:t in a basement, bathroom, or under buildings, or within any other enclosed space unless adequate provision -has been made to admit to the. space sufficient frea'h air -.to support combustion. The minimum cross sectional area of ventilation required.'shall be ' f.ifty. square inches- -.of free area or equal to' one (1) square inch for every thousand Btu. of the total input of all-appliance.s installed or operating within the room or enclosure, whichever is greater. (4). No Fitter or individual shall install or cause to be . installed 'in the same''room with a vented appliance, a ven- tilating fan in a.'residence., apartment, hotel, or commercial .-cooking e-stablishment until the following provisions are complied with: There shall be a permanently opened ventila- tor or operning ors'eries of openings at least equal in area to.the total square inches in the exhaust opening of the fang .or, fans. (5) No unlined chimney shall be used as a gas vent, All brick, concrete, or masonry chimneys - shall be -provided with an approved corrosion*resistant liner# (6) No existing flue shall be used to vent gas appliances unless it will• deliver .the products .of gas combustion t.o the outer atmosphere in a`ceordan•ce 'with ,this ordinance. (7) No person shall instal'l'any black flue pipe for the purpose of venting - prodmets• :of . combustion. from -a gas fired appliance. (8 ) The installation. of 'an • approved vent cap or top vuh ich will prevent_' recipit,at o'n . from entering the vent, may be installed. An approved vent cap or top shall be so conte strutted that it will prevent birds from entering the vent and so bonstructed that it cannot slip down and block the vent opening.. Such an approved vent cap.or top should be positioned so that: (1) for roof slopes less than 12/12 pitch (450), a -twelve inch clearance is maintained between the roof or other obstructions and the lower portion of the vent -cap or top, and (2) for roof slopes greater than a 12/12 pitch, a four foot horizontal clearance is mainN tained between the roof or other obs.truction.an d the lower portion of the.vent cap or top* A vent cap or top installed on the vent atits terminus shall have 0free open area equal to the cross sectional area of the vent pipe on vh ich it is installed.. SECTION `3}1� UNLAWFUL RESTORATION OF GAS AND BYPASSING OF METER. It shall be unlawful for any person, by any means., to restore the flow of gas through pipes which have been shut off either by the gas company or the Inspector, or to cause gas supplied by the gas company to bypass the meter by which the amount of gas sup-- plied•by the gas .company is measured, and such acts shall be pro- secuted according to.the terms contained'in this ordinance,, -10- SECTION 3?.' GAS DISTRIBUTION SYSTEM. 32.01 5f,01 Permit required for Gas Transmission and/or Distribution Systema It shall be unlawful for. any person,to dig up, break., excavate, tunnel,'.undermine,..cut."r in any way.obstruct or dis- turb any public propertiers in the city or to fill in; place, .leave, or.deposit in,.or upon,'any public properties any earths refuse, gravel, rock, or other material or thing tending to ob- struct, disturb, or .interfere with the free use of. the same for the installation :and%or maintenance of a gas 'aistribution or' transmission system or. for •the purpose of making a utility conte vection with any pr.emisesa without first having obtained a per- mit, or without complying. va th.th:e:pr'ovisions of this, ordinance, -.other.applicable ordinances, and rules and regulations of the City Engineer, nor shall any person conduct such work in' a .man- ner at variance with.the terms of any such permit; Provided, ..'however, That in 'case of. an emergency arising out of `office hours, .when an immediate.e'xcavation may be necessary. for the pr otec= tion of public or private property, the same shall „be 'weported to the police departments and the necessary excavation'may be made upon the expre's°s conditSon that an application be made, in the manner herein provided,; on .or before noon of the next following business. day;.and Provided, further, That a separate permit shall be required for eacunit . 3ig,02 Applications, The gas,company shall -file in quintuplet, on forms. supplied by. the City Engineer (one copy of _permit, form with a`ppro val .endorsed thereon. is to be returned to the gas comb pany), with. ,the city detailed 'planss plat or. plats, detailed :peri-- ficatio.ns (other. than those set forth. in. the rule's: `and regula- .tions of the -'Public Service Commission), and profiles of such size and at' such: scale as' prescribed by -the city;, of. Each application for a permit shall state the -length of time it is estimated will elapse from the commencement --of the work until the restoration of_the surface of the ground, or until the re- fill is made ready for the pavement to be put on by the gas com- pany. If, after examining such application and -map, plans, spegfications, and plat or plats, the City Engineer approves the same and the bond and a Workmen's Compensation In- surance Certificate, provided for hereinafter, are filed, he may issue a permit for work on a gas transmission and/or distri- bution systema Such permit shall specify the name and location of the public properties in..front of, through, under, or near which such acts are to be performed or done, together with a description of the proposed work or acts to be done under such permit and the length of time, allowed for the completion thereof. The permit shall require the repairing and restoring to'as good or better condition and in compliance with the conditions and specifications of this ordinance,,whatever portion of the public properties,and/or private properties which may b�e-obstructed, disturbed, or affected in any way within a specified time.. The acts and work authorized. and/or required under such permit shall at all times be under the supervision and control of the City Engineer o.r persons acting under his direction, but at the ex- pense of the person procuring.such permit. The City Engineer may, in his discretion, defer the granting of the permit .bereindbove.,provided-for, until such time as he deems proper in all cases in which the.public properties where the work desired to be done is occupied or about to be occupied in any work by the city.,,or by some other person having a right to use the.same'in such manner as to render it seriously in..- convenient n-convenient to the public to permit any further obstruction thereof at such time. He may,:in granting such permit, so,regulate the manner of doing such work as shall cause least inconvenience to the public in the use of -such public.properties, and in all cases any work of the city or its contractors or employees shall have precedence over all work of every kind.. 32.04 Permit and Inspection Fees for Work on Gas Transmission and/or Distribution System. The fee for such a permit shall be Five (q , 55,00 ) Dollars for ex- cavations which do not exceed one hundred 100 lineal feet in length or tunnels not exceeding one hundred (100) feet in length; and One ( 1.00 ) Dollars for each additional one hundred 100 lineal feet in length. The City Engineer shall make inspections to make certain that the pro? - visions of this ordinance are complied with and the expenses of the same shall be paid by the gas company upon a bill therefor being submitted'by the City Engineer before the gas company is released from its bond. ?.05 Bond and Insurance. Before a permit as herein provided shall be issued, the applicant shall execute and deliver to the city and file with the City Engineer a bond in -the sum of Six Thousand ($6,000) Dollars, or such additional amount as the City Engineer deems to be necessary for each bond, for each com- plete working unit ("spread") under construction, in a form to be approved by the City Attorney, and with a surety (or sureties) approved, conditioned that the gas. company will comply with all of the provisions of this ordinance, and that the applicant will keep and save harmless the city from any and all claims, liabilities, judgments, costs, casualty, accident, or damages, and expenses arising from any negligence of such gas company on account of any act which he may do or -suffer to be done or omission of said gas company -in the performance of said work under said permit, or which may be done by any of his agents, servants, or employees, or vh ich may arise from any negligence of himself, his agents, servants, contractors, or employees, or any of them, in obstruct- ing or in any way disturbing any private or public properties, or by reason of the violation of any of the provisions of this ordinance. The City Engineer shall determine the number of units ("spreads") and number of bonds needed at any one time. The gas company shall also indemnify and save harmless the city from all suits and actions of every description brought against the city for, or, on account of, any injuries or damages received or sustained by any person by reason of failure to erect aid maintain the required guards, barricades, or signals. Provided, That in case the act or acts permitted under such permit neces sitate for any purpose the cutting into, or under, any public properties in the city, said bond shall be conditioned that t1me person, firm, or corporation applying for, and acting under, said permit.shall replace the portion thereof affected thereby, and shall restore the same at its expense to as good or better condition within the time specified by the City Engineer; and further conditioned that the gas company will maintain such public properties so restored for a period of one year from, and after, such restorationp Settlement within the one year period mentioned in this section shall be considered conclusive evidence of -defective backfilling by the gas companyo Acceptance of the work, and the release of the same, shall not prevent the city from making claim against the gas company for any uncom- pleted or defective work if the same is discovered within two (2) years from the date of such release. The fact.that an inspector was present during the progress of any construction shall not relieve the gas company from responsibility for defects discovered after the completion of the work. ,J'306 Location of Pipes. All pipes shall be laid in alleys or easements wherever possible or at locations by direction of the City Engineer. Gas pipes shall have a lateral clearance of two (2) feet from other utilities, except that in case of sewer pipes, gas pipes shall have a minimum lateral clearance of three (3) feet from them, and all pipes except service pipes shall be laid five (5) feet from the, curb line; Provided, That, under excip* tional circumstances, the City Engineer, with the written consent of the utility .irivolved, may authorize.less clearance. Pipes shall have a vertical clearance of twelve (12) inches when cros- sing another pipe. Pipes shall be laid with a cover of not less than thirty (30) inches and thirty (30) inches -below all irriga- tion and drainage ditches or flumes, except that, under exceptional circumstances, the City Engineer may authorize less coverage. Where a trench is in rock, the depth may be twenty-four (24) inches if the pipe is properly cushioned by refilling the trench with sand or noncorrosive soil. In the event interference with other -subsurface structures makes it impractical to maintain the above depths and clearances, the City Engineer, with the written consent of the utility involved, may permit gas pipe lines and mains to be constructed so as to avoid such subsurface structures. 207 Restoration of Surface by City, If the gas company shall have failed to restore the surface of the public properties to their original and proper condition upon the expiration of the time fixed by such permit or upon the completion of the work al` lowed to be done under such permit, the City Engineer shall, if he deems it advisable, have the right to do all -work and things necessary to do so. The gas company .shall be liable for the ex- pense thereof upon the bond filed at the time of granting the permit, and the city shall have a cause of action -for all fees, expenses, and amounts paid out upon such work: Provided, That In any case, it shall be the duty of the gas company to guarantee and maintain the area disturbed for one (1) year after returning it to its original condition. Provided, further, That, if, in the judgment of the City Engineer, it is not expedient to re- lay the pavement over any cut or excagation made in any public properties upon the completion of the work allowe,.d under such permit, by reason of the looseness of the earth or weather con- ditions, be may direct the gas company to lay a temporary pave- ment of wood or other suitable material designated by him over such cut or excavation, to remain until such time as the repair of the original pavement may be properly made, and in case of the failure of the gas company to commence in good faith the relaying of such temporary pavement within five (5). days after the date of such notice, the City Engineer may lay such tempos- ary pavement himself and collect the cost thereof from the ;party having such p©rmit in the manner hereinbefore provided. 3.2.08 Inspection and Fee Therefor. If, in the judgment of the City Engineer, the nature of the work be such as to require in- spection on behalf of the city, either during the progress of the same or after the area affected has been restored to Its original conditions or at both said times, he may inspect the same, and the expense therefor shall be paid by the.gas company. 32'.09 Interference with Utilities and Improvements. The gas company shall not interfere with any.existing utility without the consent of the City Engineer. If it becomes necessary to move an existing utility, this shall be done by the utility charged with the operation of the same at the expense of the gas company. Whenever the gas company's existing utility, occupying space in the street, interferes with the actual con- struction of any public improvement, such utility shall be moved by the gas company: Provided9 however, That no utility, either publicly or privately owned; shall be moved to accommo- date the gas company unless the cost of such work be borne by the gas company. 3,z'.10 Preservation of Monuments. The gas company shall not disturb any survey monuments or hubs found on the line of the improvements until ordered to do so by the City Engineer. A penalty of Fifty ($50.00) Dollars shall be imposed for every monu- ment or hub disturbed without such orders. 3:2'.11 Testing of Piping; on New Construction - Fees. Before any newly constructed distribution and transmission system is fin- ally accepted for permanent service, it shall be carefully tested in conformity with the state rules and regulations adopted by this ordinance to assure that it is gas tighto The Inspector shall coordinate his tests of the distribution and transmis- sion system with that of the gas company so as to avoid dupli- cate tests. The Inspector shall bill the gas company for all expenses incurred in connection with tests or inspection. 321.12 Testing of Prior Constructed Distribution or Transmission System. Any distribution or transmission system constructed prior to the effective date of this ordinance shall be given a test for leaks in the manner prescribed in the ASA Code B 31.1- 1955 and state rules and regulations of the Washington Public Service Commission applicable to gas transmission and/or dis- tribution utilities relating to the up -rating and increasing of pressure in existing mains: Wherever such ASA Code and rules and regulations relate to up -rating and increasing pressure in exist- ing mains, it shall also apply equally where natural gas is Introduced into existing mains which have previously carried artificial gas.. 32,,.13 Allowable Pressures for Prior Constructed System. -No prior constructed gistribution or transmission system shall be operated In excess of the pressure used therein on the effective date of this ordinance without the written permission of the _Inspe ctor, who shall require compliance with the ASA,Code Section S, B. 31,1 - 1955, 32;,,14 Cathodic Treated Pike, If the gas company, desires to in- stall gas p,pe w , cathocic protections it must comply withi the, foMwIng requirements Before the City Engineer may issue a permit therefor (1) Furnish the City Engineer with a description.of the method and of the place or places where the cathodic proms vection is to be installed, (2) Furnish an executed contract between all.of the under" ground utility systems which indicates all of such utility systems,;*that the parties thereto agree that cathodic pro- tection should be installed and agree upon the plan therefor; that said parties agree upon the method or methods and the .type of equipment to be used, upon the type of tests re- quired'to be,made by each .party to determine .the effect of protective installation upon'its property, upon prot4 tective facilities, and when they ar6 to be installed; upon the division of costa; and who shall build,•ownp oper44 ate, end maintain the proposed common installation. 3Z.15 Compressor stations. Compressor Stations shall be con,-: structed to meet the fQ- lowing performance standards: Noise and vibration shall be eliminated by proper construction of structures and with sufficient screening and dampening to con- trol nuisance of noise and vibration., The Compressor ano Pump Stations shall not be located closer than twelve'hundred (1200) feet to a residential district and.sh all be so -located as to have front yard of two hundred ( 200 ) feet, and side -End rear yards of one hundred (100) feet, and shall have a twenty (20) foot wide green belt around a sight obscuring fence six (6) feet high. Compressor I Stations shall not be over thirty (30) feet in height and shall be of soundproofed masonry material. Any person, firm, or corporation that shall fail to comply with, or violate, any of the provisions of this ordinance shall be deemed guilty of a.misdemeanor., and, upon conviction thereof; shall be fined in an,amount not exceed - Ing three hundred (6300.00) Dollars, or by imprisonment in the city jail not exceeding ninety. (90), days or -by both such fine or imprisonment; SECTION 36. CONFLICT. All ordinances or parts of ordinances In conflict with this ordinance are hereby repealed. SECTION 37. VALIDITY. If any section, subsection, paragraph, sentence,, clause or phrase of this ordinance is declare un constitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance.
