LINES AND THE SIZE OF YARDS AND OTHER OPEN SPACES AND FOR THESE PURPOSE'S TO DIVIDE THE CITY INTO DISTRICTS, "BY ADDING A NEW 'SECTION THERETO TO BE KNOWN AS CHAPTER 5 -14.. - THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: 5-14.04 PURPOSE,. The purpose of this ordinancze is to set forth requirements for off-street automob. °le .parking facilit e,'s,.. 5-14.08 DEFINI'TI"ONS. For the purposes of this ordinance,, (1) "off-street"automobile parking facilities" are de- fined ,as accommodations off the street or highway provided by pri- vate groups or individuals for restricted use in connection with particular businesses or other private enter -prises or other uses, or as adjuncts to housing developments or private residences. Reasonable charges may or may not 'b,e made. Such facilities may or may not be c+oop-e:ratively established and operated. The accommo- dations may consist of lots; garage,s,s or other structures. and ac- cessori.e.s,; they may be surface facilities or facilities above or under the ground; and (2) "multiple family dwellings" are defined -as housing facilities for more than two families such as apartment houses, efficiency apartments, group houses, row houses, and similar dwel- lings; and (3) "a parking space" 1:§ defined as an area of appro- priate dimensions, of not less than- 180 ,square feet, net, exclu- sive of access :or maneuvering area,, or ramps, columns, etc, to be u's:ed exclusively as a temporary storage space for private motor vehicles; truck loading and unloa:d=ing space shall not be included in such area; when the application of a unit of measurement for parking spaces to a particular us,e or structure results in a frac- tional space, any fraction under one-half shall be disregarded and fractions of one-half or over "shall be counted as one parking space. 5-14.12 AUTHORITY TO REQUIRE PARKING FACILITIES. For a new building or structure, or for the enlargement or increase in the i•.ze of an existing.building or structure, or for an alteration in the use of an exIsting building or structure., there shall be established ;and maintained permanent off-street automobile park- ing facilit,ie;s to the extent required by 5-14.16; and no appli- cation for a building permit for 'a new or altered structure or,' improvement or use shall be'appfbVed unless there is included with the off-street automobile parking facilities in. accordance with 5-14.16 h ere.of. No occupancy or use permit shall be issued unless the required parking facilities shall have been provided in accordance with those designated on the approved pian, 5-14:16 SCHEDULE`OF REQUIREMENTS. Off-street automobile parking facilities shall be provided as follows: (1) For one and two, -family dwellings, one parking space per family dwelling unit. ( 2) For multiple -family dwe11Ings, one parking space per family dwelling unit. (3) For tourist homes�or rooming houses, one parking space for each guest or sleeping room or suite plus two additional spaces for the manager and/or service ?personnel. �.r 5-14.20 LOCATION OF PARKING FACILITIES. Off-street parking facilities required by this ordinance for. multiple family dwel, lings shall be located within 200 feet of the building 'they are intended to s°,erve.. Off-street parking facilitie'.s required by this ordinance for other than multiple family dwe'l l ings shall be located, on the same lot or plot of ground as the building they are intended to serve, and must be located and constructed in com- pliance with all zoning and building regulations of the City of Pasco. 5-14.24 COOPERATIVE PARKING FACILITIES. Noting of this ordin- ance shall be construed to prevent cooperative provisions: of off- street parking facilities for two or more 'buildings ori uses, pro- vided that the total of such off-street automobile parking spaces supplied cooperatively shall not be, less than the sum of the requiremen.tsfor the various uses computed separately. 5-14.28 MIXEDUSES., In the event shops,, restaurants or any other commercial establishments are operated; in connection with any of the uses set forth in 5-14.16, one additional parking space shall be provided for each 200 feet of gross floor space. 5+14.32 LOADING SPAC£ REQUIREMENTS. An off' street 1.oadIng space, having access to a public thoroughfare, shall be required adjacent to each multiple family dwelling hereafter erected or enlarged if the use of such unit entails del iverias to it or shipments from it, and such loadin=g. space shall be of adequate size to a°c,commo'date the maximum number and si,z�e o'f vehicles simultaneously loaded or un- loaded, in connection with the activity conducted in such building. 5-14-36 MAINTENANCE AND OPERATION. Parking space shall be main- tained in a d:ust-free condition and must be so designed and main- tained .as not to constitute a nuisance at any time and must not be used in such a manner as to constitute a hazard or unreasonable impediment to traffic. In the event any of the parking facilities are closer than five feet to the side or rear property line and abut or adjoin on property in a Residential R-1 or Residential R-2 zone, a fence or hedge shall be provided on the property line. Hard -surfaced park=ing facilities shall be maintained when five or more parking spaces are required. 5-14.38 NON -CONFORMING USES. The p-rovi.s-ions of this ordinance shall apply only to new or altered uses or to enlargements o'f existing buildings and shall not affect existing or nonconforming uses. Nothing in this ordinance shall prevent the restoration, repairing, or rebuilding of any non -conforming building or struc- ture damaged to -the extent of 60% or less of its assessed value, exclusive of the foundation, at the time the damage occurred by fire or other cause. The lawful use of land and buildings exist- ing xisti g at the time of the passing of this ordinance, although such use does not conform to the provisions of this ordiaanc:e, may be continued; but if, such non -conforming use is .discontinued fo,r a period of one year or more, any further use of those lands and bu.ild- ings steal 1 be in conformity with the provi.sions of this ordinance. 5-14.40 ADMINISTRATTON, ENFORCEMENT, AND APPEALS. The adminis- tration, enforc=ement and appeal provisions of Ordinance No. 435 and Pasco City Code Chapter 5-8 as such provisions now exist and as such provisions may hereafter be amended are made a part of this ordinance. 5-14.44 VALIDITY. Should any se.ct.io`n, clause or provision of this ordinance be declared by the courts to be invalid, the, same shall,' not affect the v'al id i ty of th,e ordinance as a whole or any part thereof other than, the part so d.ecla,red to be invAlid. 5-14.x.8 PENALTY PROVISIONS. The provision of parking facilities as required by this ordinance shall be a continuing obligation of the owner or sponsor of a given uee or structure so long as the use or structure is in existence and so Long as parking facili- ties are required he-reun,de�r in connection therewith, and it .shall be unlawful to discontinue, change, or dispense with such par.k:ing facilities without es,tablishin.g alternate pa,rki:ng facilities that meet the requirements of this section. Penalty provis:ion,s set forth in Ordinance No. 435 and Pasco C'ity Code -8.84 as such pro- visions now exist and as such provisions may hereafter be amended are made a part of this ordinance. In addi tion, at such time as the parking facilities required hereunder shall fail to con•tin,ue to be available for the purpose, the building permit for the struc- tures to which the parking fac i l i ti e.s are adjunct and the use or occupancy permits issued for the premises, shall be canceled and become null and void. 5-14.52 EFFECTIVE DATE: This ordinance shall be in full force and effect five days after its passage and publication as required by law.
