AN ORDINANCE ORDERING THE CONSTRUCTION OF A SEWER SYSTEM OVER
AND ALONG THE STREETS AND ALLEYS IN THE CITY OF PASCO, WASH-
INGTON, AND CONSISTING OF PIPES, DRAINS, TANKS, DITCHES, PUMPS,
AND OTHER EQUIPMENT NECESSARY TO SUCH SEWER SYSTEM FOR THE
AFFECTED PROPERTY; AND ESTABLISHING WITHIN THE CITY OF PASCO A
LOCAL IMPROVEMENT ISTRICT TO BE KNOWN AS LOCAL IMPROVEMENT
DISTRICT # ; AND PROVIDING FOR THE ISSUANCE OF WARRANTS
AND FOR THE PAYMENT THEREOF FOR COSTS INCURRED IN CONNECTION
WITH THE CONSTRUCTION OF SAID SEVIER SYSTEMAND APPURTENANCES AND
DEFINING THE TERRITORY EXTENT OF SUCH LOCAL IMPROVEMENT DISTRICT.
The City Council of the City of Pasco, Washington, do
ordain as follows:
SECTION I. That pursuant to a resolution duly adopted by the
City Council of the City of Pasco on thel5th day of August, 1950,
declaring its intention to construct a sewer system over and
along the streets and alleys of the City of Pasco. The City
Council caused notice of said Resolution to be given to the
property owners and be published in the official newspaper in
the City of Pasco, as reuired by law, and a hearing was set on
said Resolution for the 10th day of October., 1950, as shown by
the minutes of the City Clerk and the Affidavit of Publication
and Affidavit of Mailing now on file with the. City Clerk. A
hearing was had on such Resolution of Intention on the 10th day
of October, 19_9� , and the Council having heard and considered
all objections made thereof and having decided to exercise its
authority to make proper and equitable adjustment of the assess-
ments to be made on said property at the time -of the hearing
on. the assessment roll, and the Council having agreed to construct
said sewer system and orders the same to be done by this ordinance.
SECTION 2. It is hereby Ordered and Directed that the following
sewage lines consisting of mains and laterals -within the City of
Pasco be constructed, the same being more specifically descr,,bed
as follows, to -wit:
1. A trunk sewer line consisting of a 12 inch sewer
pipe to commence at the intersection of the alley line in Block
3 of Meridian Addition with the easterly line of Chase Street,
thence southerly along the easterly line of Chase Street and
upon the right-of-way of Chase Street to the intersection of the
east and west alley in Block 10 of Columbia Addition with the
easterly line of Chase Street; thence easterly through the alley
in: Blocks 9 and 10 of Columbia Addition to the intersection of
such alley in Block 9 extended eastward to the center line of
Illinois Street; thence southerly along and upon the right-of-
way platted and dedicated as Illinois Street to a point on such
right-of-way where it is intersected by the alley line of Block
4 of Helm's Second Addition; thence easterly along and through
the alley of Blocks 2, 3, and 4 of Helm's Second Addition and
Blocks 1 and 2 of Helm's Addition to the intersection of such
alley line with the westerly line of Lucas Street in Block 10
of Helm's Addition to the City of Pasco.
2. A sewer main pump lift station to be located at the
intersectioncf the east and west alley through Block 1 of Helm's
Addition with the westernmost line of Lucas Street sufficient to
pump and lift the sewage from that location through a 12 inch
sewer pipe commencing at such point and running to the exist-
ing sewer trunk line on Indiana Street between 12th and 13th
Avenues.
3. A sewer lateral of 8 inch sewer pipe running east
and west through the alley in Block 3 of Meridian Addition.
4. A sewer lateral of 8 inch sewer pipe running east
and west through the alley in Block 2 of Meridian Addition.
5. A sewer lateral of 8 inch sewer pipe running east
and west through the alley in Block 1 of Meridian Addition.
6. A sewer lateral of 8 inch sewer pipe running east
and west through the alley of Blocks 1 and 2 of Columbia Addition,

and Block 24 and 25 of Helm's Second Addition.

7. A sewer lateral of 8 inch sewer pipe running east
and west through the alley of Blocks 3 and 4 of Columbia
Addition and Blocks 22 and 23 of Helm's Second Addition.
8. A sewer lateral of 8 inch pipe running east and west
.through the alley of Blocks 5 and 6 of Columbia Addition and
continuing through the alley in Blocks 18 and 19 of Helm's Second
Addition.
9. A sewer lateral of 8 inch sewer pipe running east
and west through the alley of Blocks 7 and 8 of Columbia Addition
and continuing easterly through Block 17 of Helm's Second Addition.
10. A sewer lateral of 8 inch sewer pipe running east
and west through the alley in Block 12 of Helm's Second Addition.
11. A sewer lateral of 8 inch sewer pipe running east
and west through the alley of Blocks 11, 10 and 9 of Helm's Second
Addition.
12. A sewer lateral of 8 inch sewer pipe running east
and west through the alley of Blocks 5 and 6 of Helm's Second*
Addition and continuing easterly through the alley of Block 7
and 8 of Helm's Addition.
SECTION 3. A local improvement district to be known as Local
Improvement District #_ is hereby created which
shall include the following described real property: All of
Meridian's Addition to the City of Pasco, Washington; all of
Columbia Addition to the City of Pasco, Washington; (excepting
therefrom Lots 11 through 16 inclusive of Block 9 in such,
Columbia Addition); Helm's Addition to,the City of Pasco, Wash-
1 in;;ton; and Helm's Second Addition to the City of Pasco, Washing-
ton; (excepting Blocks 13, 14116, 20, 21 and 26 of Helm's Second
Addition).
SECTION 4. The entire cost and expense of the improvement
herein ordered shall be paid for by a special assessment levied
upon the property specifically benefited by,said improvement and
included in the district hereby created; such costs shall
include all labor, material, equipment, rental of equipment,
cost of engineering, surveying, advertising, mailing, clerical
and legal work, and the making of the assessment roll.
SECTION 5. The payment of the entire cost and expense of the
improvement herein ordered shall be made as follows:
By issuing Local Improvement District warrants on Local
Improvement District No. which is hereby created
and delivering the same in proper amounts to any and all persons
rendering services or furnishing material of any kind in connection
with the improvement, or improvements hereby ordered, which said
warrants shall draw interest at the rate of 6% per annum, payable
at the time when said warrant is called for payment.
The cost and expenses represented by the assessments
to be made upon the real property shall be paid in ten (10) annual
installments, the first installment to be due and payable as soon
as the cost of the improvement can be ascertained, the assessment
roll confirmed, and within thirty (30) days after demand is made
therefor by the City Treasurer, and the succeeding payments shall
be due and payable annually on the date as shall be provided in
the Ordinance confirming the assessment roll, together with
interest at the rate of 6% per annum, and in case of default of
the payment of any assessment when the same shall become due,
there shall be added a penalty of 5%, which shall also be collected,
and if a certificate of delinquency shall be issued, the same
shall draw interest at the rate of 6% per annum.
SECTION 6. Failure to pay any payments of any of the assess-
ments hereinafter to be levied, or interest thereon shall mature
all unpaid installments and collection of the entire unpaid balance
of the principal, interest and penalty for such.default, shall
forthwith be made.
:SECTION 7. The entire cost and expense of the improvement
herein ordered and the assessments hereinafter to be made., shall
be a lien upon the real property in the Local Improvement District
hereby created, and known as Local Improvement District No.

;SECTION 8. The call for bids for work contemplated pursuant
to the order of this ordinance shall include a statement that
pa=yment for the work will be made in warrants drawn upon'Local
Improvement District No. _ of the City of Pasco.
SECTION 9. The estimated and entire cost of the improvement
herein ordered is estimated at $ %O 7
SECTION 10. The'preliminary plans, specifications, maps and
estimates provided by the City Clerk and the City Engineer of
the City.of Pasco are hereby adopted and approved.
SECTIO//N 11. A fund to be known as Local Improvement District
Noe- (o./` is hereby created in the City Treasury, into
which all fund of the Local Improvement District shall be paid,
and from which fund all payments for work and expenses, for the
improvement herein ordered, for and in behalf of such district
shall be paid.
SECTION 1.2. It is coritemplated, and the City Council reserves
the right that Local Improvement District bonds will be issued to
pay and retire any outstanding warrants issued pursuant to the
authority granted in this ordinance.
