HomeMy WebLinkAbout0688 OrdinanceORDINANCE N0. 688 AN ORDINANCE REGULATING AND PRESCRIBING THE WIDTH OF STREETS TO BE ESTABLISHED WITHIN THE CITY OF PASCO, AND AN ORDINANCE REG- ULATIIVG STREET AND ALLEY DIPROVEMENTS TO BE CONSTRUCTED BY ABUT- TING PROPERTY OWNERS WITHIN THE CITY OF PASCO, AND REPEALING ORS DINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCO AS FOLLOWS: Section 1. That from and after the effective date of this ordinance, there shall be no street dedicated for public use nor improved, -or otherwise prepared for use by the public and used by the public as a street or public way, unless the same shall have an unobstructed distance between curbs of at least 42 feet; provid- ing further that such minimum unobstructed distance between these curbs shall be a distance of at least 62 feet for all streets that may be designated as an arterial street within the Ci�,,y of P :scq. Section 2. No. plat providing less . t.hAn the minimum un- obstructed distance between curbing as set but". in.Section 1, above,. shall be approved, and the City Council, together with the Planning Commission of the City of Pasco, may require that on any proposed plat, certain streets be provided with sufficient land dedicated for street purposes that would enable such streets to be arterial.. Section 3. Any abutting property owner or owners are hereby granted the right to construct sidewalks, crosswalks, curbs, or gutters in front of their property when constructed in conform- ity with this ordinance, and such rules and regulations as may be prescribed from time to time by the City Council and the City Street Superintendent. Section 4., All construction of sidewalks, crosswalks, curbs, and gutters by private contract shall be of concrete as hereinafter specified and shall be constructed under the immediate supervision of an inspector appointed by the City Street Suger- intendent, or Building Inspector. Section 5. Before any person, firm, or corporation commences to improve any of the public streets or alleys within the corporate limits of the City of Pasco by the erection or construction of side- walks, crosswalks, curbs, or gutters, or to do any work in or upon said streets and alleys whatsoever, must first obtain a permit' I from the City Building Inspector. Nopermit will be issued for any such work upon any street or alley within the corporate limits of the City of Pasco when the grade has not been properly established or while a proposition to alter or amend the grade thereof is pend- ing before the City Council or of ter the City Council has granted a petition or adopted a resolution to improve the street or al;ey in question by the formation of a Local Improvement District, and no permit shall be issued if, in the judgment of the City Building Inspector and the City Street Superintendent, the improvement pro- posed to be made is not a suiable one or will not be uniform with Y and confirm to existing,or proposed improvements of streets or alleys in the immediate vicinity of said proposed improvement. Section 6. It shall be the duty of the City Building Inspector to keep a record of all permits issued **construction under the provisions of this ordinanceA, which records shall show the date of issue thereof, to whom issued,, -.a description of the property in front of which the improvement is to be made, the nature of the improvement, and an estimate of the quantity of work and the cost thereof, fees collected, and when accepted by the City Building Inspector, and the date of such acceptance..., 11 Section %• Upon the granting of a permit by the City Building Inspector, it shall be the duty of his office, in con- junction junction with the City Street Superintendent, to cause said pro- posed improvement to be staked out, giving lines and grades there- of, and shall furnish data and specifications; to which the improve- ment must conform. The person or persons performing the work shall take proper precaution to protect the stakes set by the Building Inspector or Street Superintendent and any and all stakes lost or destroyed shall be replaced only by the City Building Inspector or - 2 . Street Superintendent at the expense of the person obtaining the permit. The person making such improvement, or his contractor or agent, shall notify' the City Building. Inspector, in writing, at least twenty-four hours in ad�r`ance of the time when the grad- ing will be completed and the forms set ready for placing concrete. The City Building Inspector or City Street Superin-tendent shall check Up the forms as to line and grade and place an inspector in charge of the work until the same is completed, and it shall be unlawful for any contractor to commence construction -work until the forms have been.checked and the inspector placed upon the location of the job at the time such improvement is actually in- stalled. Section 8. No improvement will be accepted until the City Building Inspector is satisfied.that the work hasabeen per- . , .. formed according to the plans-., profiles and specifications fur- nished by him and to the lines and gradest established., Section 9. The.City Building Inspector. is:hereby author- ized to charge for making surveys and for inspection.of_street and alley -improvements in the amount and,in the manner following: Running lines and grades, $3.00 for each 50 feet lot,: and $1,„00 for each additional 50 foot lot in -the same block and on the same street. For. inspection., $3.50 for the first 500 s *quare'f eet or less of cement walk, and one-half cent for each additional square foot. Charges for making surveys and furnishing inspections for other improvements shall be fixed at a reasonable amount by the City Building Inspector.,_ All fees shall'be paid in advance at the time the permit is obtained, and the City Building Inspector shall turn over to the City Treasurer all fees collected and obtain a receipt therefor at the,end of each month. - 3 - Section 10. The contractor or person having in charge the construction of any such improvement shall see that good and sufficient fences or barriers shall be kept around such work at all times and a sufficient number of red lights shall be placed at proper intervals upon such work, during the night time, as a warning to,all persons traveling upoh such streets or alleys. Section 11. All sidewalks in the City of Pasco that may be constructed after the effective date of this Ordinance shall have the curb integrated with the walk, although the curb should be clearly defined with an appropriate marking in the cement; further, such sidewalks in a residential area shall be 5 feet in width, in- cluding the width of the curb, with expansion joints provided at least every 20 feet; and that in business zones, such sidewalks shall extend from the building line to the curb, with expansion joints-. at least every 20 feet. Be it further provided that should the regulation prescribed in this Section be impracticable or thought to be against the best interest of the City of Pasco, the City Council shall be authorized to give special permits for the construction of such walks after examination of the premises and determining that the interest of the City will be best served by permitting sidewalk construction at variance with this section. Section 12; Whenever a permit is to be granted for new G residential construction within the City of Pasco, the person seek- ing to build.such new residential construction shall at the time a building permit therefor is applied for, also obtain a permit as provided for under this Ordinance for the construction of side- walks, and as a portion of such construction, there shall be built sidewalks and curbs on all sides of such property -that may adjoin a street, in conformance herewith, and such sidewalks and curbs - 4 -. shall extend the full distance that such property is sought to be occupied as a building site for residential construction, and may adjoin property dedicated as a publi�� treet. Section 13. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and if convicted thereof, be fined not less than $10.00 nor more than $100.00 Section 14. It is.the purpose of this Ordinance to require uniform -development and construction of streets, curbs and sidewahX-s within the City of Pasco, but shall not alter or effect those streets, curbs and sidewalks presently in existence. In the event, however, any of such presently constructed streets, curbs and sidewalks kre to be altered, modified9 improved or changes, then such alteration, modification, improvement, or change shall be,'in accordance with the provisions herein outlined. Section 15. This Ordinances to be in full force and effect five`days after its passage -and publication.
