HomeMy WebLinkAbout0650 OrdinanceORDINANCE NO. AN ORDINANCE PROVIDING FOR PAYMENT BY PETITIONER OF COSTS AND INSPECTION FEES INCURRED 'WMN STREET OR ALLEY IS VACATED. The City Council of the 1'ity of Pasco do ordain as f oll ovvs : Section One: From and after the effective date shall be deposited with the City Clerk each petition requesting that a street of Pasco be vacated. Said sum shall be itioner or petitioners requesting such vacated. Section Two: of this ordinance there the sum of $75.00 with or alley in the City deposited by the pet - street or alley to be No application or petition for vacation of streets or alleys will be entertained or heard by the Council unless this sum is paid on or before the date the petition is presented to the City Council for' action. Section Three: This sum shall remain deposited with -the City Clerk until action by the City Council upon the petition is completed and the street or alley is, or is not, declared vacant by ordinance. Following action by the Council, and adoption of an ordinance vacating such street or alley; the sum so deposited with the Clerk shall be used by that officer to pay all reasonable and necessary costs incident to the petition for vacation, and including, all costs for publication of notices or ordinances, posting of notices, and including an inspection fee of $15.00 to reimburse the city for expenses incurred by reason of the necessity for determining the location of utility lines, poles,. and the need or necessity for the street or alley in question. After all of such expenses, including the inspection fee above mentioned, have been paid, the balance of such deposit shall be refunded to the petitioner having posted the same. Section Four: The charges and expenses herein mentioned shall be paid by the petitioner whether or not the action requested by him in his petition is taken by the Council, and the intent and purpose of this act is to hold the city harmless and free from any and all expense of whatsoever nature incident to the pro- ceedings now required for the vacating of any street or alley. Section Five: The inspection referred to in Section Three shall be made by any person authorized for that purpose by the City Council, who shall be a member of the City Council, and who shall draw or receive no compensation for such service of inspection, but who shall inspect the location and premises o; the street or alley concerning which a petition has been presented, and shall make his findings known to the Council before f inak'action thereon by the Council may be taken. Section Six: A11 ordinances and parts of ordinances in conflict here*ith are hereby repealed, but the procedure now in effect is to be in nowise considered modified or changed, other than herein stated, Section Seven: This ordinance shall take effect and be in force five (5) days from and after its passage and approval. 16� Passed by the City Council this 1,4day o 1949.
