ORDINANCE :� NO.
AN ORDINANCE,.AMENDING ORDINANCE N0. 615 and ORDINANCE 578,
BEING ORDINANCES RELATING.TO THE CONVEYING OF PASSENGERS
AND BAGGAGE FOR HIRE, ANTD PROVIDING FOR TAXICAB OPERATORS
LICENSE AND REGULATING THE OWNERSHIP OF A TAXICAB AND
TAXICAB COMPANIES IN THE CITY OF PASCO: AND LIMITING ANIS
CONTROLLING THE NUMBER OF TAXICAB LICENSES AS PUBLIC CONS
VENIENCE AND NECESSITY REQUIRE.
The .Cty,.Council of the City of Pasco do ordain as follows:
Section One:
That Ordinance No. 615 of the City of Pasco is hereby
amended to read as follows:
Section Two::
The number of taxicab licenses which may be issued
and outstanding at any one time shall be not more than one
license for every 1000 of population of the City of Pasco
as such population may be determined from time to time by
resolution of the City Council; provided that the City
Council may by resolution change the ratio of licenses for
pppulation as public convenience and necessity require; -
and provided that the number of licenses may not be decreased
so as to work a forfeiture of outstanding licenses or prevent
the renewal thereof. Applications for renewal of licenses
shall be given preference over applications for licenses
by persons not already holding licenses if the holder of
a license or his successor in business makes application
for the renewal thereof prior to the expiration date thereof.
Each license secured as herein provided shall be granted
upon the express condition that the person, firm or corp
oration securing the license shall provide service to the
public upon a 24 hour basis, and a telephone shall be pro-
cured and used so that the public may be able to call for
such service at any time. Failure to provide and maintain
the services herein required shall work a forfeiture of
the license or licenses of any violation hereof; PROVIDED
FURTHER that to effectuate the purposes herein declared
each operator of a taxicab:. service or taxicab company
shall be required to have not less than two taxicabs, each
properly licensed, and to,be used by such operator in the
conduct and operation of his taxicab business.
Section Two A:

It shall be unla-�ful for any driver of a taxicab
to leave the same unattended at hotels, depots, or else-
where for the purpose of soliciting patronage, but such
driver must stand at the side of his vehicle or remain
inside the same, except nothing herein contained shall
prohibit the extension of ordinary courtesies to patron
after they have signified their intention of becoming his
passenger.
Section Two D:
All licenses issued shall be subject to revocation
by the City Council if the holder thereof or any person
employed by him in the operation of any such vehicle shall
fail or neglect to comply with or shall violate any of
the terms and provisions of this ordinance or who shall
violate any of the terms or provisions of any of the ord-
inances of the City of Pasco relative to the operation
or use of vehicles upon the public highways, or to the
use of such highways, or relating to traffic upon the
same, or who shall directly, or indirectly, either himself
or by or through his agent, driver or servant, sell, give
away, or in.any manner dispose of narcotic drugs or in-
toxicating liquor in connection with the use of any such
vehicle in the transaction of the business 'for -which such
licenses have been issued, or use or permit the use of any,
such vehicle to carry or transport such drugs or liquor,
or cause or permit to be kept therein any such drugs or
liquor, or use or permit the same to be used for the trans-
porting or harboring any bootlegger or person who may be
in possession of any such drugs or liquors, or use or
permit the same to be used for the purpose of carrying
or transporting any person or persons who may be contri-
buting to the delinquency of any minor or who shall vio-
late any of the ordinances of said City in or by the use
or operation of any such vehicle. Upon complaint being
made to the City -Council of any of the acts or omissions
herein set forth, notice shall be given to the holder of
such license thereof, and that at a time and place to
be fixed therein the City Council will conduct a hearing
upon the question of.whether or.not the license shall be
revoked, at which time and place, or the time and place
to which said hearing may be adjourned, the licensee shall
have the right to be heard and produce evidence in his
behalf. If upon such hearing the City Council shall be
satisfied that the licensee,'or the driver of any vehicle
covered by such license, is or has been guilty of the act
or omission complained of and that by reason thereof the
license should be revoked it may thereupon revoke such
license. Me notice provided for herein shall be person-
ally served upon the licensee not less than three (3)'
days before -'the date of such hearing. The said license
may also be revoked upon like notice being given if it
shall appear to the City,Council that a license or bond
of insurance issued to any licensee under the laws of the
State of Washington has been cancelled or revoked.,
Section Two E:
Each operator of a taxicab business in the City
of Pasco shall, on or before the 1st day of 4m _ 919+9
file a schedule of its fares with the City Clerk. Amend-
ments to said schedules may be filed by operators there-
after, but it shall be unlawful for said operator to
charge any greater fare than shown in said filed schedules
or amendments. The City Council shall have power to regulate
said fares by resolution at any regular meeting after ten
days written notice to the operator or operators concerned
and after all parties concerned shall have had ample
opportunity to be heard.
Section Two F:
There shall be conspicuously displayed in each
taxicab, at the places and of the size and style approved
by the Chief of Police, a schedule of fares charged for
carriage within the City of Pasco.
Section Two:
. Section One of Ordinance 578 shall be amended to read
as follows:
'fiTo automobile or motor vehicle shall be used
in the city of Pasco as a taxicab in carrying passengers
for hire or offered therein to the public for hire in the
carrying of passengers except upon payment of a license
fee at the rate of $25.00 per year.for each such vehicle
an ranting by the City Couneil.of the City of Pasco of
a license -therefore .as herein provided. The City shall
issue to such taxicabs as may be authorized for operation
a license plate which shall be exhibited byhthe taxicab
and its operator in a prominent place on such vehicle, and
a record of such licenses, by number, and operator shall
be retained by the City Clerk of the City of -Pasco.
Section Three:
Section Five of Ordinance 578 shall be amended to read
as follows:
"The City Council in the granting of any license
provided for in this ordinance to a vehicle for hire for
transporting persons for compensation shall require the
owner or operator thereof to procure liability and property
damage insurance covering passengers as well as ether per-
sons, from a company licensed to write bodily injury
liability and property damage liability insurance in the
State of Washington, on each mo&.or propelled vehicle used
or to be used in transporting persons for compensation
in an amount not less than One Thousand dollars ($1000.00)
for damage to property of any person other than the assured
and Five Thousand dollars 05000.00) bodily injury for each
person carried and maintain such liability and property
damage insurance in force on each motor vehicle while so
used under such license. Each policy for -liability or
property damage insurance required herein, shall b e filed
with the City Clerk, and kept in full force and effect,
and failure so to do shall be cause for the revocation of
the license, and further it is required that an affidavit
from such insurance company, or authorized agent of such
insurance company, be filed with the City Clerk along and
together with such policy, which affidavit shall state the
fact of such insurance as is carried by such operator and
further causing such insurance company to notify the City
Clerk if any policy issued hereunder be cancelled.
Section Four:
Section Sig of Ordinance 578 shall be amended to read
as follows:
"Before anyone shall operate a taxicab in the

City of Pasco, he shall first obtain from said city a
taxicab operator's license -hereafter referred to as a
city operator's license, said application shall be approved
by the Chief of Police of the City of Pasco and a fee of
$5.00 for each year or each part of year shall accompany
such application. Said license when granted shall expire
at the end of the calendar year in which the same is granted
and may be renewed on approval by the Chief of Police.
Before the original city operator's license shall be issued,
the applicant shall in addition to paying said fee, submit
to being fingerprinted, photographed and interviewed under
the direction of the Chief of Police. Also to accompany
such application shall be a statement from, a recognized
physician stating that he has examined the -applicant, finds
him to be free of any communicable disease, and that he
has no physical defects of any kind that would render him
unsafe to operate a motor vehicle carrying passengers for
hire.
The Chief of Police shall cause to be issued a card
bearing the name, description, and photograph of such
driver', and it shall be -displayed in the taxicab at all
times, visible to the occupants therein, while such oper—
ator is operating such taxicab. The Chief of .Police fur—
ther may require the applicant to submit to a testas to
the applicant's ability as a driver. The Chief of Police,
upon reasonable grounds therefore, may suspend or revoke.
such license and refuse to approve it for renewal at the
annual expiration period. The City Council, if it°should
see fit, may review all such decisions of the Chief of
Police and countermand orders of the Chief of Police in
refusing, suspending or revoking said city operator's
license. It shall be unlawful and a violation of this
act to operate or attempt to operate any taxicab in the
City of Pasco without the operator first providing himself
with a City Operator's license then -in good standing.
Section Five:
Ordinance 615 and Sections 1, 5, and 6 of Ordinance
578 are hereby repealed.
Section Six:
This ordinance shall take effect and be in force
five (5) days from and after its passage and splmyrzky
publication. %3
