CO J / r AN ORDINANCE AMENDING ORDINANCE NO.456 ENTITLED" AN ORDINANCE TO REGULATE AND RESTRICT.,THE,,LOCATION'AND USE OF BUILDINGS AND THE USE OF LANDS' WITHIN WITHIN THE CITY OF PASCO WASHINGTON;TO PRESCRIBE BUILDING LINES AND THE SIZE OF YARDS*AND OTHER OPEN SPACES AND FOR THESE PURPOSES TO TO DIVIDE THE CITY INTO DISTRICTS" BY RPOVIDING UNDER CERTAIN RULES AND RESTRICTIONS FOR THE ERECTION OF APARTMENT HOUSES AND MULTIPLE DWELLINGS IN THE CITY AND REPEALING ALL ORDINA- NCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.. The City Comncil of the City of Pasco do ordain as follows: Section 1, That section four of ordinance No. 456 be and the same is hereby amended to read as follows,to-wit: "Section Four: No such permit shall be issued on such application,however,unless it suf- ficiently appears from said application,plans and specifications that such building,when erected or structurally altered,will be provided with the same depth of front,rear and side yards,height limit and lot area as is required in said Ordinance No.435 as amend- ed for buildings erected in the particular location,provided that where it is desired to erect an apartment house or multiple dwelling upon either side of Third or Fourth Avenues between Shoshone street and the city limits the height limitation may be waived by the com- mission upon proper application,subject to review by the city council; provided,further,however, that one or two story apartment buildings shall not be more than fifty (50) feet in width and seventy-five (75) feet in length in residence district R-1 and that the erection of court apartments in said district shall be prohibited,excepting, court apartments may be erected in the City of Pasco, complying with the building code as to floor area and height,on ap- proval of plans by the planning commission subject to review by th e City Council; provided further,however,that where it is proposed to alter or remodel or repair a building already in existence,the permit therefore may be issued with the consent of the commission;, notwithstanding the fact that the front side and rear yards,and lot areas so provided shall be less, in depth and such building shall'be,: greater in height than those provided for in such district.i°�' Section 2, All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 3, This ordinance shall take effect and be in full force five day after its passage and publication.
