HomeMy WebLinkAbout0634 Ordinancea ORDINANCE N0, 634 A REVENUE AND REGULATING ORDINANCE GOVERNING PEDDLERS, SOLICITORS } AND ITINERANT MERCHANTS, ESTABLISHING FEES FOR SAME AND PENALTIES FOR THE VIOLATION OF THIS ORDINANCE. REPEALING ORDINANCE NO. 609 (THE GREEN RIVER ORDINANCE) AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. The City Council of the City of Pasco do ordain as follows: SECTION ONE: No person or persons, firms or corporations, shall peddle, solicit or canvas from house to house, or sell their wares, merchandise or any article upon any street or public place within the City of Pasco, without having first obtained a license or per- mit from the City Clerk. News boys excepted. SECTION TWO: A peddler is hereby defined to be a small retail dealer who carries his merchandise with him, traveling from town to town, house to house, and offering the same for sale and selling his wares. A peddler's fee of $5.00 per day shall be charged except for those who are residents of the Tri -City Area or are property owners in this area, and do most of their business in this vicinity. For those under this classification a fee of $25.00 per year shall be charged. SECTION THREE: A solicitor is hereby defined to be a person who trav- els from house to house soliciting residents to order, buy, or agree to buy or subscribe for any article, fund or donation. The fee for those under section three shall be $25.00 per year or $5.00 per month or fraction thereof. Those soliciting for churches, charities or public good excepted}'also agents of local business firms who have paid a business license in the City of Pasco. SECTION FOUR: An Itinerant merchant is hereby defined as a person who conducts a mercantile business from an established place and travels from house to house over a fixed rot}te and makes one or more calls monthly to regular customers. The fee under section four shall be $25.00 per year, except those who have an established business within the City and pay a business tax. SECTION FIVE:. All licenses shall expire on December 31. No fee shall be pro -rated. All applicants for license or permit shall furnish the City Clerk in writing, a statement as to the kind of merchan- dise he or she is selling, name of the firm represented, and address of applicant and firm. The number of days or months he or she will be selling in Pasco. The last place or town in which he or she peddled or solicited and place or town of next stop for peddling or soliciting. SECTION SIX: If the City Clerk is not satisfied with applicants application or has reason to believe that peddler or solicitor will be a detriment to the public due to previous complaints, or other reasons, the City Clerk may reject application or may refer appli- cation and applicant to Police Committee for further investigation. Their decision shall be final. The Police Department upon warrant- ed complaints from customers of peddlers or solicitors, or for violation of other city ordinances, shall have power to revoke any license or permit and the City Clerk shall be so notified of any such action or decision of Police Department. In case of revoca- tion of any permit the unearned portion of the fee paid shall be forfeited to the City of Pasco. SECTION SEVEN: Any person violating any of the provisions of this ordinance shall, upon conviction, be punished by imprisonment not to exceed 30 days, or by a fine not to exceed $100.00 or by both such fine and imprisonment. SECTION EIGHT: It shall be lawful within the City of Pasco for any farmer, gardener, or other person, without license from City of Pas- co, to sell, deliver, or peddle any farm produce or edibles raised caught, produced or manufactured by such person in any place in this state. However, all vendors under this section shall apply for a permit from the City Clerk. No fee shall be charged. SECTION NINE: Any honorably discharged soldier, sailor or marine of the Military or Naval Service of the United States who is a resident of this State shall have the right to peddle, solicit, or sell with - tom£ out license upon due proof of his service with the armed forces of the United States. However a permit to peddle, solicit or sell is required, and a registration fee of $10.00 is required. Such fee is for one year or fraction thereof. SECTION TEN: Ordinance No. 609, known as the Green River Ordinance, and any part of other ordinances in conflict with this ordinance is hereby repealed. SECTION ELEVEN: This ordinance shall be in full force and effect five days after its passage and publication. Passed by the Council this day of 1948. Approved by the Mayor thi it — day of 1948.
