HIRE, AND PROVIDING FOR TAXICAB OPERATORS LICENSE AND REGULATING THE 011FITERSHIP OF TAXICABS AND TAXICAB, COM.PANIES IN THE CITY OF PASCO : I�idD LII- ITIi�Tnr AND 4 011-1OLLING THE N`UlffM OF TAXICAB LICE'IvSES AS PUBLIC =TVENIENCE AND rECES3ITY..REQTTIRE. The City ' Council of the City of Pasco, do •;Ordain."as follows: SECTION OIM— That Section 2 of Ordinance lTo. 578 of the City of Pasco is.hereby.amended'to read as.follows: SECTION TWO: The number of taxicab -licenses which may be issued and outstanding, at any one time shall be not more than one.license for' every 1000 of population .of the City of Pasco as such population may be determined from time to tine by resolution of the City Council; provided that the City Council may by resulution change the ratio of licenses to'population as public convenience and necessity require; and provided that the number of licenses may not,be decreased so a8. to work a forfeiture of outstanding licenses or,prevent the renewal thereof. Applications for renewal of licenses shall be given pre- ference over applications for licenses by persons not already holding licenses if the holder of a license or his successor in business makes application for the renewal thereof prior to the expiration date' there- of. :each license secured as herein provided shall be granted upon the, express condition that the person, firm or corporation securing the license shall provide service to the public, upon a 24 hour basis, and a telephone shall be procured and u.sed so that the public may be able to call for such service at any time. Failure to provide and 'maintain the services herein required shall work a forfeiture of the license or licenses of any violator hereof. ` SECTION TWO A. It shall be'unlawful to place -'additional passen- gers in a taxicab car without securing the consent of the party by whom it was first engaged. S`,_;CTION TIDO B. It shall be unlawful for any Jri ver of a taxicab to leave the same un -attended or to make repairs or crash ii -s -vehicle while on the street;.alleys or public thoroughfares of the City of Pasco, SECTIONS 71.40 C It shall be unlawful for any driver of a taxicab to leave the same unattended at hotels, depots, or elsewhere for the purpose of soliciting patronage, but such driver must stand at the side of his vehicle -or remain inside the same, except nothing herein contain- ed shall prohibit the extension of ordinary courtesi.es to patrons after having si-nifi_ed their intention of becoming his passenger. SECTION T,JO D: All licenses issued shall be subject to revod.ation by the City Council if the holder thereof or any person employed by him in the operation of any such vehicle shall fail or neglect to comply with or shall violate any of the terms and provisions of this Ordinance, or who shall violate any of the'terms or provisions of any of the Ordinances of the City of Pasco relative to the operation or use of vehicles upon the public highways, or'to the use of such highways, or relatin`: to traffic upon the same, or who shall directly, or indirect- ly, either himself or. by or through his agent, driver or servant, sell, give away, or in any manner dispose of narcotic drugs or intoxicating liquor in connection with the use of any such vehicle in the transac- tion of the business for :ihich such licenses has been issued, or use or permit the use of any such vehi_c'le'tc,carry or transport such drugs or liquor, qr*cause or permit to be kept therein any such drur's or liquor, or use or permit the sarc.e to be used -for the transporting or f r -_harboring any bootlegger or person who,nay be in ?possession of any ,s'nch drugs or liquors, or use or perMit such vehicle. to be used for the purpose of carrying or transporting any person or persons who, may be contributing)( -to _or attempting to or having the design of contributingxto the delinquency of any minor or who shall violate , any of the Ordinances of said City in or by the use or operation of any such vehicle. Upon complaint being made to the City Council of any.of the acts ar omissons herein set forth, notice shall be given to the holder of such license thereof, and that at a time and -place to be fixed ther-in the City Council will 'conduct a hearing upon the question of whether or not tlie license shall be revoked,at which time and place, or'the tine and place to which said hearing nay be.adjourn-' ed, the licensee shall have the right to be heard and produced evidence in his behalf. If upon such hearing the City Uouncil shall be satisfied that ,the licensee, or the driver of any vehicle .covered by.such license,t. is or has been guilty of the:act or omission complained of -and,that.by reason thereof the license should be revoked -Ft may thereupon revoke such license. The notice provided .for herein shall be personally serv- ed upon the licensee not less than three (3)'da7s,before the date of such hearing. The said 'license may also be revolved upon like notice being given'if it'shall appear to t.te City Council that.a license or bond of insurance issued to any licensee under the laves of.the State of, i.lashington has been cancelled or revoked. SECTION TWO E: Each operator of a taxicab"' busiriess in the City of. Pasco shall, on or before the lst day of April, 1948, 'file a schedule of its fares with the City Clerk. Amendments to said schedules .may be filed by opei?ators -thereafter, but it shall be unlawful for said.operator tocharge any greater fare than shown in said filed schedules or amendments. The City Council shall have poorer to, regulate said fares by resolution at any regular :meeting ifor the purpose, after ten'days written notice to the operator or operators concerted, and after all parties concerned shall have had ample opportunity to be heard. , SECTION TWO F:. There shall be conspicuously displayed -in each taxigab, at the places and,of the size and style approved by the Chief of .:Police, a schedule of fares charged for carriage within the City of Pasco. SECTION TWO: Except as -Herein amended said Ordinance 578 shall remain_ in full .force and effect. SECTION -THREE: This Ordinance shall take effect.and be in force five days from and: after its ,passage and .approval.
