HomeMy WebLinkAbout0613 OrdinanceOREJNANCE NO. 613 AN ORDINANCE DEFINING CERTAIN OFFENSES AGAINST PEACE AND GOOD .ORDER, FIXING YHE PENALTY THEREFORE., AND REPEALING ALL OF ORD- INANCE NO.267, AND ALL OTHER ORDINANCES 'OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. The- City Council.of the city of Pasco do ordain as -follows: Section 1. Every person who shall be found in any street, alley or on any sidewalk, or any public krounds, parks, or in any other public place, in a drunken or intoxicated condidiion, or who by reason of drunkeness, �aial 1 be incapable of taking care of himself or herself, or whoshall act in a'disorderly manner;.. or create.a disturbance, shall be.guilty of a misd6x-meanor, and may be arrested, with -or without warrant, and held in custody. until he or she becomes sober, and on conviction shall be fined in any sum -not greater than $100.00 or be committed to .the city jail for not more than thirty (30) days, or may be both fined and committed as above set forth. Section -2. Every person who asks or receives any compensation, gratuity or reward for practicing fortune,.,telling,.palmistry or clairvoyance, or phrenology; or -who: keeps,`a .place where lost or t stolen property is concealed; every person practicing or solicit irig prostitution 6,r -who keeps a' house of prostitution; every per-. son who solicits alms, or begs' upon the streets or in any build ., ing in the city; every person who wanders about.the streets at, late" or unusual -hours a.t. night; ',every person vvho lodges or sleeps in ani- barn,.gara'e', shed, out house, car or boat or in any other place or on any other property without the: consent of the .owner or person entitled to possession thereof; any person who is an habitual user of opium, morphine, cocaine, alpha or Bata ouca.ine or derivation, .mixture or preparation of any of them; any per- son naving no visable means of support, who does not.seek employment, not work when employment is offered,to him or her; any person who distributes or,circulates any book,- pamphlet or paper, or posts any bills, wherein or whereon it is advocated or advised that any of the laws of the City or -.the State of Wash- ington, or of the United States, be violated; resisted -or. ignored, ` Page 2 1 Ord. 613 or that private pr public.proper.ty beinjured or destroyed; every person who in any public place or who by distributing of or posting of any.written or printed matter, holds the govern- ment or flat; of the United States.up to ridicule, or abuse, or speaks ina disreispectful manner of either such government or flag, or who distributes ..o,r circulates'matter of a' seditious nature, calculated or intended to hinder or embarass the govern- ment of the.Un.ited States in the prosecution of any war against any foreign country, or'gives aid or encouragement to any enemy of the United ;States; every person who patronizes, loiters about. or is found in any .place where gambling .is being conducted or carried on or where intoxicating liquor is being unlawfully sold, or wherenrostit�tion is being practiced, shall be guilty of .a misde/neanor, and`upon conviction thereof, shall be fined not to exceed $300.00 or committed to the city jail for a period not exceeding ninety (90) .days; or by both such fine and imprison- inent . Section 3. Ordinance No. 287 and all other ordinances or parts of ordinances in conflict herewith are hereby rePealed. Section 4. This ordinance shall,be in full force and effect five days after its passage and publication. Passed by the Council this 3rd day of February 1948. Approved -by the Mayor this 3rd day of ,February 1948.
