HomeMy WebLinkAbout0584 OrdinanceORDINANCE NO. 584 An Ordinance of the City of Pasco.. Washington, granting to Fred E. Miller, and/or Pasco Transit Lines, Inc., a License and Franchise for a period of 10 years to operate on the public streets of the City of Pasco, buses and conveyances for the carriage of individual persons for hire, subject to the terms and conditions of this Ordinance. The City Council of the City of Pasco do ordain as follows: Section 1. The City of Pasco, Washington, a municipal corporation, hereinafter called the City, does hereby grant to Fred E. Miller, and/or Pasco Transit Lines, Inc., hereinafter called the Grantee, a License and Franchise for a period of 10 years from and after the effective date of this Ordinance to operate on the public streets of the City of Pasco, Washington, buses for the carriage of individual persons for hire, subject to the teras and conditions hereinafter specified. Section 2. At the expiration of the term of this Franchise, as hereinabove provided, the parties operating said buses on said gtreets shall be entitled and privileged to continue said operations until said right is terminated by Ordinance duly passed by the City Council of the City of Pasco, Washington, provided, however, that the grantee shall at all times comply with the terms of this License and Franchise and make the payments provided for herein to the City of Pasco, Washington. Section 3. As compensation to the City for the right and franchise hereby granted, the grantee shall pay to the City, the sum of Twenty Five Dollars ($25.00) a year, for a business license. Section 4. The route of the bus line proposed to be established under this License and Franchise, shall extend over streets in the City of Pasco, and shall extend over the following streets: Upper River Road, Sylvester Street, North Tenth Avenue, Ainsworth Avenue, Fourth Street, Lewis Street, Elm Street, Wehe Street and "Alt Street. There shall be filed by the Grantee with the City Clerk, a map showing the exact route of said bus lines and said route shall hot be changed and shall be the established route, provided, however, that said route may be changed by Resolution of the City Council, permitting such change, and if such change is so allowed by said resolution, then and in that event the Grantee shall immediately file with the said City Clerk, a new map showing the new route. Section 5. There shall be no change of ownership of said bus system, with@ut the consent of the City Council, Section b. Grantee shall maintain one-half hour schedules from Fourth and Lewis Streets in Pasco, Washington, and shall stop at every second block and Grantee shall operate buses from 5:30 A. M. to 12:30 A. M. each day except Sunday, and shall operate on Sundays during what. ever hours Grantee desires; the maximum fare to be charged for each passenger shall be ten cents within the City limits of Pasco, and the minimum number of buses to be operated shall be two and the minimum size of said buses shall be twenty (20) or more passenger buses, provided, however, that any of the provisions contained in this paragraph may be changed at the request of the Grantee by Resolution of the City Council, granting said request at any regular meting, which Resolution shall be entered on the minutes of the City Council. Section 7. Grantee shall maintain and carry adequate public liability and property damage insurance to protect the public and the passengers and the Grantee shall protect and save harmless the City, its officers, employees and agents from any and all damage claims, loss, liability, cost or expense, occasioned by any negligent act or omission of the grantee in connection with the operation of buses under this franchise. The City shall have the right to inspect the buses operated - 2 - C.: under this Franchise at any reasonable time, and Grantee agrees to keep said buses in a safe condition for operation. The City reserves the _ L _ right to refuse Grantee the right to operate any bus on said streets under this Franchise, if after an inspection by a,competent safety engineer or state inspector, it is found that said bus or equipment'is unsafe to be allowed on the streets and no bus shall be operated on said streets under this franchise unless insurance as above provided is in force, and in the event of cancellation of any such insurance as to any busi this -franchise shall be inoperative as to said bus or buses. Section 8. In the event the Grantee shall breach any of the provisions of this Franchise, the City shall have the right -to declare all rights of the Grantee hereunder forfeited upon giving the Grantee a notice at least ten days prior to a regular meting of the City Council and after a public hearing held at said City Council meeting pursuant to said notice, with right of law appeal. Section 9. This.Ordinance shall be in full force and effect from and after five days after the date of its final passage by- the City Council,, its approval by the Mayor of the City, and its publication as hereinafter provided, but shall become null and void unless within sixty days thereafter the Grantee shall file with the City Clerk a written acceptance of the terms, conditions and obligations of this Ordinance, and within six months thereafter shall commence operation of said public transportation system. Section 10. This ordinance, following the date of its approvalp shall be published once in the official newspaper of the City of Pasco.
