AN ORDINANCE AP,ZENDING ORDINANCE NO. 566 , BEING AN-011DINANCE RELATING
TO THE CONVEYANCE OF PASSA-TIGERS AND BAGGAGE FOR HIRE, AND PROVIDING
FOR TAXICAB OPERATORS LICENSE "AND REGULATING THE WMEHSHIP OF TAXI-
CABS AND TAXICAB CO PANYS IN THE CITY OF PASCO.
The City Council of the City of Pasco do ordain as follows:
A
SECTION 1:
No automobile or motor vehicle shall be used in the city of
Pasco as a taxicab in carrying passengers for hire or offered there-
in to the public for hire in the carrying of passengers except upon
payment of a license fee at the rate of $15.00 per year for each
such vehicle and the granting by the City Council of the City of Pasco

of a license therefor as herein provided.
SECTION 2:
;each license secured as herein provided shall be granted
upon the express condition that the person, firm, or corporation
securing the license shall provide service to the public on a 24
hour basis, and a telepnon:e shall be procured and used so that the
public may be ,able to call for such service at any time. Failure to
maintain such service shall be cause for the revocation of the license.
SECTION 3:
The City Clerk, upon granting of a license by the City
Council and upon presentation of the City Treasurers receipt show-
ing payment of the license fee prescribed shall issue to the appli-
cant a license for such automobile or motor vehicle, which said,.
license shall bear a serial number, shall set forth a brief description
of the vehicle licensed,:the name and address of the owner, and the
State License or Certificate nuihber thereof. Such license shall expire
.on the 31st day of December of the year in which it 1:tissued and no
fractional license shall be granted and no license shall be trans-

ferred from one person to en.other person, but may be transferred from
one vehicle to another vehicle upon application being made therefor.
Every applicatiin for such transfer shall be accompanied by a receApt

.,from the City Treasurer showing. payment of the sum of Two Doll es% (��2.00)..,
which sum is hereby Aermined to be the fee for the making of such
transfer.

Each vehicle.operated as a taxicab -within the City_of Pasco
shall have a regular place or stand from which to operate and where
such stand or place is on a'city street a permit shall first be ob-
tained therefore and a fee of .75.00 per year paid. Upon the issuing
of said permit -the city shall cause -a space of not less than -twenty
feet in length on the curb at the place designated in such permit,
to be properly painted and proper signs erected designating such
space as • reserved 'for taxicab use only, and it shall be unlawful for;
any Vehicle, other than vehicles used by the person or persons to

any vehicle used as a taxicab by the person or persons to whom such
person so using such space for parking,

other than as herein authorized, shall be liable to.a fine for im-
proper parking as set forth in the parking ordinarices•
SECTION 5:
The City Councilinthe granting of any license provided
for in this ordinance.to'a vehicle for hire for transportingpersons
for compensation shall require the owner or operator thereof to pro-
cure liability and property damage. insurance covering passengers as
well as -other persons, from a company licensed to write bodily injury...
liability and property damage liability insurance in the State of
Washington, on each motor propelled vehicle used or to be used,in
transporting persons for compensation in an anount not less than One
Thousand $1,000.00 dollars for damage to property of any person other
than the assured and $5,000.00 bodily injury for each person carried
and maintain such liability and property damage insurance in force on
each motor propelled vehicle'while so used under such license. Each
policy for liability or property damage insurance required hhrein,
shall be filed with the City Clerk, and kept in }full force and effect,
and failure', so to do shall be cause for the revocation of the license..
SECTION .6
Before anyone shall operate a taxicab in the City of Pasco,
he shall first obtain from said city a taxicab operators license
hereafter referred to as a city operator's license,.said application
shall be approved by the Chief of Police of the City of Pasco and a
fee of X2.50 shall be paid when application is made. Said license
when granted shall expire at the end of the calendar year in which the
same is granted and may be renewed on approval by the Chief of Police.
Before the original city operator's license shall be issued, theapp-
licant shall in addition to paying said fee, submit to being finger-
printed, photographed and interviewed under the direction of the Chief
of Police. In addition thereto, the Chief of Police may require the
applicant to submit to a test as to the applicant's ability as a driver,
Chief of Police may suspend or revoke such license and refuse to approve
it for renewal at the annual expiration period. The City Council, if
it should see fit, may review all such decisions of the Chief of Police
and countermand orders of the Chief of Police in refusing, suspending
or revoking said city operato-r's license. It shall be unlawful and
a violation of this act to operate or attempt to operate any taxicab
in the City of Pasco without the operator first providing himself with
a City Operator's License than in good standing.
SECTION 7:
It shall be a violation of this act if anyone shall own or
acquire any interest or control or ownership in whole or in part in
any taxicab or taxicabs operating in the City of Pasco without dis-
closing said interest to the Chief of Police of the City of Pasco, and
said person shall then be finerprinted, photographed and interviewed
by or unddr the direction of the said Chief of Police. No fee shall
br required from said person but said person shall disclose said interest
and extent thereof in a,letter addressed to the Chief of Policep
and shall appear personally before thesaid Chief of Police to answer
such further inquiries as the Chief of Police may desire to make.
SECTION 8:
The term "person" wherever used in this ordinance shall be
held and construed to mean and include natural persons of either seX,
firms, co-partnershipsli associations, and corporations, whether acting
by themselves, by servant, agent or employee. The singular number shall
include the plural and the -masculine pronoun shall include the feminine
and the neuter. The term "taxicabs" wherever used in this ordinance
a shall -be held and construed to mean and include every motor vehicle
used for the transportation of passengers for hire, and not operated
exclusively over a fixed and defined route.
SECTION: 9:11
It,shall be unlawful .for any person to engage in the business
of operating a taxicab or taxicabs without first securing a permit so
to do in compliance with this ordinance. Permit shall be issued
authorizing interchange of Taxicab, or Taxicabs, Qut'replacements may
T be ordered where evidence is produced to the satisfaction of the Chief
of Police that such vehicles are actually obsolete, unsafe, or unfit
for further use. (all permits, shall expire on December 31st of the'
year in which issued.) ,
SECTION 10:
Every person owning or,,engaged in the business of operating
any taxicabs or for -hire cars. shall.keep a record'of all trips made,
together with the information required upon the passengerts receipt,
provided for in this ordinance, which record shall be open for in-
spection at all reasonable times 'by the Chief of Police or.City
Attorney and shall also cause to be constantly carried in such vehicles
the permits issued by the Department of Licenses of the State of -
Washington showing such vehicles to be,properly bonded for the pro-
tection of,the'public, and also the licenses and permits issued pur-
suant to city ordinances.
SECTION 11;
All vehicles operating under authority of this Ordinance
shall be inspected from time to time by the Chief of 'Police for the
purpose of determining whether the same -are clean, properly•e'qu.ipped,
of good appearance, and in a safe condition for the transportation of
passengers; and said Chief shall, at the time of -such inspection,
determine for the guidance.of the public the capacity of the vehicle
inspected; and it shall be unlawful for any person to drive or operate,

or engage in the business of operating, any"taxicab unless and until
the same has been,inspected and approved by the Chief of.Police, and
a certificate signed by the Chief of Police showing the maximum number
of passengers to be carried at any one time shall be at all times
prominately displayed within such vehicle.
SECTION 12:;
It shall be unlawful for any person awning, controlling or
engaged in the business of operating taxicabs to employ as a driver
of any such vehicle, or permit any such vehicle to be driven by a
driver who does not possess a valid and subsisting City Driver's License
in accordance with this ordinance.
SECTION '13:
It shall be unlawful for anyy person engaged in the business
of operating a taxicab to knowlingly permit any,person to.,drive the
same who has been convicted of driving while intoxicated within one
year -prior thereto.
SECTION 14:
If any driver of a taxicab shall be convicted of driving
such vehicle while drunk or under the confluence of narcotics, the
City Driver's license of such driver shall be revoked, and he shall
not begranted a City Driver's License for a period of at least one
year from the date of such conviction.
SECTION 15:
It shall be unlawful for any person to refuse to pay -the,
regular fare for a taxicab after having hired thesame.
SECTION 16:
It shall be unlawful for any person to cruise, drive, or
operate a taxicab repeatedly or persistently to and fro, upon €n.y
public street.
SECTION 17:
Any person violating or failing to comply with any of the
provisions.of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punished by a fine in.any sum
not exceeding one hundred dollars ($100.00) or by imprisonment in the

city jail for a period not exceeding thirty (3Q) days, or by both
such fine and imprisonment.
SECTION 18:
If any.section, subsectioh, subdivision, sentence, clause,
or phrase of this ordinance is for any reason held to unconstitutional
or void, such decision shall not affect the validity of the remaining
portions of this ordinance.
SECTION 19:
This ordinance shall take effect and be in force di'_days
from and after its passage and approval.
